The notice to Borrower, pursu
ant to O.C.G.A. §44-14-162.2,
has been provided by Holder to
Borrower in accordance with
said O.C.G.A. §44-14-162.2.
The undersigned may sell the
Property (less and except the
Funds) or any part of the Prop
erty (less and except the
Funds) in such manner and or
der as Holder may elect and
may sell that portion of the
Property (less and except the
Funds), which, under the laws
of the State of Georgia, consti
tutes an estate or interest in
real estate separately from that
portion of the Property (less
and except the Funds), which,
under the laws of the State of
Georgia, constitutes personalty
and not an interest in the real
estate, in which case separate
bids will be taken therefor, or
collectively in a single sale or
lot, in which case a single bid
will be taken therefor or separ

given by announcement made

The indebtedness evidenced
by the Note is due and payable
and remains unpaid. The Se
curity Deed therefore has be
come and is now foreclosable
according to its terms. Accord
ingly, the Premises will be sold
at public outcry pursuant to the
terms of the power of sale
provided in the Security Deed.
The Premises will be sold on
an “as is, where is” basis
without recourse against
Lender and without representa
tion or warranty of any kind or
nature whatsoever by Lender
with respect thereto.
The proceeds of the sale are to
be applied first to the ex
penses of the sale and all pro
ceedings in connection there
with, including attorneys' fees
(notice of intention to collect at
torneys’ fees having been giv
en), then to the payment of all
sums secured by the Security
Deed, and the remainder, if
any, will be paid to the person
or persons legally entitled
thereto, all as provided in the
Note and Security Deed. The
Premises shall be sold as the
property of Grantor, subject to
all restrictions, easements and
other matters of record that are
prior to the Security Deed and
to which the Security Deed is
subject and to any unpaid city,
county and state ad valorem
taxes or assessments relating
to the Premises.

modify all terms of the Note
