Because of default in the pay
ment of a note secured by a deed
to secure debt executed by Ro
land T. Williams dated December
29, 2006, recorded in Deed Book
802, Pages 114-116, Toombs
County records, the undersigned
has declared the full unpaid
amount of the indebtedness re
ferred to due and payable and
acting under the power of sale
contained in said deed, for the
purpose of paying said indebted
ness, will on the first Tuesday in
July, 2021 during the legal hours
of sale at the Toombs County
Courthouse, sell at public outcry
to the highest bidder for cash, the
land described in said deed, to-
wit:
All that tract or parcel of land
lying and being in the 1536th
G.M. District, Toombs County,
Georgia, and containing 23.51
acres, more or less, and being
bounded, now or formerly, as fol
lows: On the North by a 200 foot
right-of-way on State Route 292;
on East by the run of Pendleton
Creek; on the South by the GA.
Central R/R; and on the West by

described on a plat of survey
dated, January 3, 1997, prepared
by Dykes & Dolan Land Survey
ing, Registered Land Surveyor,
and recorded in Plat Book 27,

Superior Court. Said plat is incor
porated herein and made a part
of hereof by reference.
Said property is to be sold sub
ject to any outstanding ad va
lorem taxes (including taxes,
which are liens, but not yet due
and payable), the right of re
demption of any taxing authority,
any matters which might be dis
closed by an accurate survey and
inspection of the property, any
assessments, liens and encum
brances, zoning ordinances, re
strictions, covenants and matters
superior to the aforesaid Deed to
Secure Debt first set out above.

The hearing scheduled above is

a.m. at the Toombs County Court
house in Lyons, Georgia. You are
hereby commanded and required
to appear before this Court at
said final hearing or pursuant to
O.C.G.A. §15-11-163 and O.C.
G.A. §15-11-282 the findings of
the Court made at the provisional
hearing will be made the perma
nent order of this Court in the
above case.
Be advised if you fail to attend
the provisional hearing, you must
attend the final hearing in order to
preserve your rights. At the final
hearing you will be given an op
portunity to show cause, if any
you have, why the relief re
quested in the petition should not
be granted.
If you fail to appear, the court
can terminate your parental rights
in your absence.
Any biological father, known or
unknown, is hereby notified that
he will lose all rights to the chil
dren and will not be entitled to
object to the termination of his
rights to the children unless,
within thirty days of receipt of this
notice, he files:
(a) a petition to legitimate the
children pursuant to O.C.G.A.
§19-7-22; and
(b) notice of the filing of the
petition to legitimate with the
Toombs County Juvenile Court.
If the court at the trial finds that
the facts set out in the petition to
terminate parental rights are true
and that termination of your rights
will serve the best interests of
your children, the court can enter
a judgment ending your rights to
your children.
If the judgment terminates your
parental rights, you will no longer
have any rights to your child.
This means that you will not have
the right to visit, contact, or have
custody of your child or make any
decisions affecting your child or
your child’s earnings or property.
Your child will be legally freed to
be adopted by someone else.
Even if your parental rights are
terminated:
(1) You will still be responsible
for providing financial support
(child support payments) for your
child’s care unless and until your
child is adopted; and
(2) Your child can still inherit
from you unless and until your
child is adopted.
This is a very serious matter.
You should contact an attorney
immediately so that you can be
prepared for the court hearing.
You have the right to hire an at
torney and to have him or her
represent you. If you cannot af
ford to hire an attorney, the court
will appoint an attorney if the
court finds that you are an indi
gent person. Whether or not you
decide to hire an attorney, you
have the right to attend the hear
ing of your case, to call witnesses
on your behalf, and to question
those witnesses brought against
you.
