to the clerks of the respective counties, so soon as j
they shall be elected and qualified; and that all per- <
sons may have notice of the transfer and to enable 1
them to prepare for trial at the next term of the Su- 1
perior court of the respective counties of Cherokee 1
Circuit, it is. further, ordered that this order be pub- i

Be i: enacted by trie Senate and House of Rep.
reseutatives oi tjte Slate ol Georgia in Gnera! as
' scmbly met, and it is hereby enacted by the au
thority ol the same, That from and n n ediately
alter this act shall nave passed, in confoimity with
the Constitution of tins State, it shall and nay
be lawful sot all Major Generals, to be elected by
(he people ofthe respective Divisions or Brigades,
ami all persons subject to to millilary duty shall be
ei titled to vote sot the same only.
And be u tmther enacted by the authority a
foresaid, That hereafiei when any vacancy of a
Major General or Brigadier General, shall happen
in any Division or Brigade tn tlfis State.it shall be
the dutj of Ins Excellency the Governor, to give
notice of such vacancy to the millilary officer high
est in command tn each county, ft moosing the di
vision or brigade nt which such vacancy lias hap
pened, ami it shall be the duty of the Colonel or
oilier Military officer high/st in con mand in each
’ comity, to give notice by adveitisen ent at three of
< the most public places in the county, at least
twenty days before the election, that an election
will be held on the first Monday in October next
ensuing, at all the places ofholding election, in
, said comity, to fill such vacancy, and it shall be
the duty of the managers of elections, to receive
the votes so given in for such military officers, and
’ to transmit immediately after the dose of the elec
tion a correct statement ofthe polls to hisEcellen
