A N act to alt. rand amend the ninth section of
t ILilie third article of the Constitution relative
to divorces.
Whereas the said section and article of ths Con
stitution of the State of Georgia, requires alteration,
Be it therefore enacted hy the Senate and House
ot Representatives of the State of Georgia in Gen
eral Assembly met. and it is hereby enacted by the
authority of the same. That so soon as the fol
lowing amendment shall be passed agreeable to the
fifteenth sei lion ofthe fourth article of the consti
tution, it shall be received in lieu of ninth section
ofthe third article to wit :
•‘Thai the superior courts of the several counties
in this Slate shall have full power, to decide on
the last resort in all cases of divorces, in the follow
ing manner, to wit ; The parties concerned shall
bring their case before a petit jury, as a common
issue at law, and as such the proceedings shall bo
had thereon: That in the verdict is in favor of a
divorce, the said cause shall be put on the appeal
docket and be tried by a special jur), and it the
special jury confirms the verdic t of tne petit jury
and the next succeeding grand jury ohall, by their
recommendation confirm the verdicts of the a
foresaid juries, the said divorce between the parties
shall be final: and it shall be rhe duty of the J'udgo
of the superior court to have all the evidence and
proceeding on said divorce, down to the last de
cision as heretofore directed, entered on the mino
utes of said court, and from this proceeding ther
shall be no appeal--but the divorce shall be final
and compleF* a vinculo matrimonii.”
Sec. 2. And ba it further enacted. That this,
i act having passed both branches of the legislature,,
l aud having been advertised six months and all tho
requisites of the. constitution complied with, shall
thereafter be the law ofthe land iu the case of di
vorces.

AN act to alter the third section of the fourth
article of the Constitution of this State, so
far as to authorise the people to elect the general
officers ofthe iVlillitia of this State.
i Be it enacted by the Senate and House of Rep
resentatives of the State of Georgia in Gueral as
; sembly met, and it is hereby enacted by (he au
thority of the same, That from and in.mediately
after this act shall have passed, in conformity with,
the Constitution of this State, it shall anil may
be lawful for all Major Generals, to be elected by
the people of the respective Divisions or Brigades,
aud all persons subject to lo millitary duty shall be
entitled to vote for the same only.
And be it further enacted by the authority a
foresaid, That hereafter when any vacancy of a
Major Ganernl or Brigadier General, shall happen
i in any Division or Brigade in this State.it shall be
the duty of his Excellency the Governor, to give
notice of such vacancy to the ini Hilary officer high
est in command in each county, composing the di
vision or brigade in which such vacancy has hap
pened, and it shall be the duty ofthe Colonel or
i other Military officer highest in command in each
I county, to give notice by advertisement at three of
the most public places in the county, at least
twenty days belore the election, that an electioti
-will be held on the first Monday in October next
ensuing, at all the places ol'holding election, in
said coudty, to fill such vacancy, and it shall be
the duty of the managers of elections, to receive
the votes so given in for such military officers, and
to transmit immediately alter the close ol the elec
tion a correct staleihent ofthe polls to his Ecellen-
Icy the Governor, and it shall be the duty of his
'Excellency the Governor, to cause the votes so
given in for each canditate to be counted, and to
issue a commission to the person having the high
est number of votes so given in.
And be it further enacted by the authority afore
said, That all laws and pans of laws militating a
gainst this act, be and the same aie hereby re
