Hoc. 1. Hu it enacted l<y the Senate and House of Re
prescv.taticcs of the State‘s Georgia in General-Assem
bly met, a, d it is hereby enacted by the. authority vl Hie
same, That irom and alter tlie passage ol this act, the
seventh section ofthe above recited act, shall be al
tered as follow s, to-wit : T hat where if shall happen
in pny company district, that Hie privates neglect or
i retuse io elect any officer or officers to the command
i it shitll be tiie duty oi the Colonel, or commandant of
' the regiment to which they belong, or in counties con
taining t.ut one battalion, of the Major commandant
to nominate a fit and proper person or persons, as the

amended as follow.-, to-w it: Thai there shall be com

by the commanding officer of companies, within
twenty days alter each must* r, or on the next muster
day, to lie composed ol at least three oi the commis
sioned or brevetled officers oi said company, under
(he same rules and regulations as pointed out for vo
lunteer companies in said section, and the command
ing officer of said companies of every d< scription,
shall be allowed to stay the issuing ot execution
against any delinquent upon Lis making .iflicavit,
stating the facts before any officer, authorised to ad-

elect a Clerk or Provost Marshal, as the case may be
