Local governments do battle
with adult businesses
Bf MELISSA WEINMAN AND COLLIN KELLEY “I think what you look
at is community stan
dards of what citizens say
they’re looking for in the
safety and protection of
their community. And the
council listened to their
citizens,” Willard said.
“We recognize that [com
bining] nude dance clubs
with serving alcohol does
bring about sometimes
criminal elements, and
that’s what we’re trying to
protect against. We think
the outcome will be sup
portive of the effort that’s
been put forth.”
Atlanta City Coun
cilman Alex Wan’s high-
profile campaign to shut
down adult-oriented busi
nesses along Cheshire The Onyx Club sign on Cheshire Bridge Road.
Local politicians have spent a lot of
time talking about strip clubs lately.
Atlanta City Council is the latest
metro area government to go to battle
over adult businesses.
An Atlanta councilman proposed
an unsuccess
ful measure that
would have dis
placed the adult
businesses along
Cheshire Bridge
Road. The new
city of Brookhav-
en and the city of
Doraville are head
ed to court after
being sued by strip
clubs for adopt
ing regulations the
clubs say would
destroy their busi
nesses.
And Sandy
Springs has been
in litigation for the better part of a de
cade with strip clubs located within its
borders
What’s going on?
Attorneys and politicians can’t pin
point a single factor that has led to the
recent interest in measures that would
alter or ultimately shutter adult-orient
ed businesses, such as strip clubs and
head shops.
Each case is
slightly different.
But many gov
ernment officials
claim adult-orient
ed businesses bring
crime and noise,
and lower sur
rounding property
values. The busi
ness owners ar
gue that they have
property rights
and First Amend
ment protection
for their business
es.
Sandy Springs’
City Attorney
Wendell Willard said though the city
has been in litigation with strip clubs
for six years, officials feel like it has been
worth the cost and effort.
Bridge Road ultimately
failed after a 9-6 council
vote on June 3.
The majority of council members
objected to the measure because had
it passed, Atlanta’s zoning code would
have allowed businesses such as the
Onyx club, Kong’s Body Shop and In-
serection to relocate just about anywhere
in the city.
Atlanta’s Senior Assistant City Attor
ney Jeff Haymore said that only two of
the city’s 12 council districts offered no
compatible zoning available for adult-
oriented businesses.

Brookhaven City Council hired
Attorney Scott Bergthold to
help rewrite the city’s adult
business regulations.
