cm k 10B | dawsonnews.com | DAWSON COUNTY NEWS Wednesday, January 15,2020 with the State Historic Preservation Officer, GDOT Bridge 085-0020-0 has been determined to be eligible for the National Register of Historic Places (NRHP). Due to its NRHP eligibility, GDOT is making this historic bridge available in compliance with 23 U.S. Code 144(g), which states: (5) Preservation.—Any State that proposes to demolish a historic bridge for a replacement project with funds made available to carry out this section shall first make the historic bridge available for donation to a State, locality, or responsible private entity if the State, locality, or responsible entity enters into an agreement— (A) to maintain the bridge and the features that give the historic bridge its historic significance; and (B) to assume all future legal and financial responsibility for the historic bridge, which may include an agreement to hold the State transportation department harmless in any liability action. (6) Costs incurred.— (A) In general.—Costs incurred by the State to preserve a historic bridge (including funds made available to the State, locality, or private entity to enable it to accept the bridge) shall be eligible as reimbursable project costs under this chapter in an amount not to exceed the cost of demolition. (B) Additional funding.— Any bridge preserved pursuant to this paragraph shall not be eligible for any other funds authorized pursuant to this title. GDOT Bridge 085-0020-0 is being made available "as is." The current condition of the bridge is as follows: The bridge was designed using an HS-20 vehicle, which is below current standards. The bridge is classified as functionally obsolete due to the narrow deck width. The deck is in fair condition with severe cracking and spalls with exposed rebar. The superstructure is in fair condition with corrosion and section loss. The substructure is in fair condition with moderate cracking and spalls with exposed rebar. The bridge is classified as having an unknown foundation and therefore could be at riskfor scour. Due to the age of the structure, the functionality obsolete classification, deterioration of the deck and substructure and section loss of the steel superstructure, along with the unknown foundation of the substructure, replacement of this bridge is recommended. All expenses incurred in removing, relocating, rebuilding, and maintaining the bridge at a new location, as well as the expenses associated with acquiring the newsite, shall be the sole responsibility of the state, locality, or responsible private entity (the "recipient") and not the Department. The recipient shall be required to enter into an agreement assuming responsibility for the bridge in its existing condition, including any and all structural deficiencies, and any unanticipated costs needed to repair these deficiencies; and holding harmless the Georgia Department of Transportation, the State of Georgia, the Federal Highway Administration, and any of their authorized agents from any and all liability, including but not limited liability arising from third party claims. In the event the structure becomes damaged or destroyed during removal and relocation, the applicant will be solely responsible for any repairs or removal of structural debris. Inquiries regarding the bridge in response to this notice should be directed to the following: Darrell Richardson, Project Manager, Georgia Department of Transportation, Office of Program Delivery, One Georgia Center, 600 West Peachtree Street, NW, Atlanta, Georgia 30308. 46793,1/15/2020,1/22, 1/29,2/5/2020 IN THE SUPERIOR COURT OF DAWSON COUNTY STATE OF GEORGIA Cavender, LLC, Petitioner, Civil Action File No.: 2019-CV-0321 vs. A Tract of Land in Land Lot 784 of the 4th Land District, 1st Section, Dawson County, Georgia, 2.689 acres more or less, A/K/A 220 Norma Road, A/K/A Tax Map/Parcel 095 045 001, Krystal Park, Unknown Heirs and Assigns of Krystal Park, and all other parties, known or unknown, who have or claim any right, title or interest in the subject property, Respondents.
