Dawson County News November 24, 2021 Moragne Alexander (MA) Whitney III Moragne Alexander (MA) Whitney III, passed away on November 14, 2021. He was born on November 1, 1962, in Coral Gables, Florida. MA and his family moved to Lake Burton Georgia in 1973. MA attended the University of Georgia. MA is pre ceded in death by his mother Cynthia Smith Whitney. MA is survived by his father Moragne (Ranny) Whitney Jr of Sautee- Nacooche, GA, his sister DuGue Whitney Zion of Camden, SC and his brother Geer Arthur Whitney of Selma, AL. MA spent many years running the family-owned marina on Lake Burton, Cherokee Landing, where he grew up. He began selling boats at Cherokee Landing and later continued this work for JOA Marine in Marietta. MA was a dedicated member of the Wildcat Fire Department, part of the Rabun County EMT services, as well as a member of the Swift Water Rescue team. For the Man charged with simple battery after inappropriately touching toddler at Walmart Julia Fechter jfechter@dawsonnews.com A Dawsonville man has been charged with one misdemeanor count of simple battery after alleg edly inappropriately touching a toddler at the local Walmart last Saturday. Manuel Morales-Tzaj, 47, was arrested by the Dawson County Sheriff’s Office on Nov. 13, according to an arrest report released Nov. 19. A warrant for Morales- Tzaj’s arrest alleged that sometime between 7-8 p.m., he touched the female child while she was standing up in a grocery cart. The incident was immediately reported, and a DCSO deputy responded to the supermarket, located at 98 Power Center Drive, at about 7:30 p.m. Morales-Tzaj was arrested right at 9 p.m. that night and subse quently booked into the Dawson County Detention Center, accord ing to the weekly arrests press release. The victim’s father posted to the “Focus on Dawson” Facebook group Sunday night thanking the sher- iff’s office, Walmart’s security and a witness for their “fast response and inves tigation.” The warrant was issued for Morales-Tzaj not quite 48 hours later on Nov. 15. Two days later, on Nov. 17, he was released from DCSO cus tody on a bond of $5,700. Morales-Tzaj Bender case was first time jurors dismissed for COVID-19 mid-trial, court officials say Nick Watson DCN Regional Staff The high-profile murder trial for Austin Stryker is also the first time a judge has had to dismiss jurors mid-tri al for COVID-19 concerns since Hall and Dawson counties resumed trials, according to court officials. Stryker was found guilty for the September 2019 killing of Dahlonega woman Hannah Bender, who was shot to death in a black pickup truck and then stabbed. As the vehicle neared the Sweetwater Juno Road area of Dawson County, Bender was allegedly shot in the head without warning by Stryker, according to previous court testimony. According to a statement from Court Administrator Jason Stephenson’s office, a juror notified the court Nov. 4 that they had tested positive for COVID. Chief Superior Court Judge Kathlene Gosselin, who is presiding over the trial and has written the orders concerning courthouse operations amid COVID, dismissed the juror after consulting with the defense and prosecution. Gosselin’s orders concerning COVID gives the trial judge the authority on dismissing a juror. “All jurors, court officials, attorneys and anyone who had close contact with the juror over the previous 48 hours were instructed to self-monitor for symptoms, immediately report any onset, and to quarantine in accordance with current (Centers for Disease Control and Prevention) guidelines if unvaccinated,” according to the state ment from Stephenson. “These instruc tions resulted in the dismissal of two additional jurors.” If another juror were to be dismissed, Stephenson said it “very well could” lead to a mistrial. “The judge at that point would have a discussion with both sides and make a determination about what the result would be,” Stephenson said. “And of course, both sides could make their own arguments for what they think in the case. It’s hard to see how a trial could proceed without 12 jurors.” Northeastern Judicial Circuit District Attorney Lee Darragh did not return a call for comment Monday, Nov. 8. Stephenson said there are no require ments or orders compelling jurors to release or make the court aware of their vaccination statuses. Court officials said the courtrooms and deliberation rooms were cleaned and disinfected, and no one associated with the case has reported any symp toms.
