Judge Joseph Gaines
says society’s values
changing completely

The law had to change as sociely changes, but society's
problems have to be given ' proper study and consideration"
before we jump at fast solutions to them through the law, said
Judge Joseph J Gaines Tuesday afternoon at the annual Law
Day program of the Athens Kiwanis Club.
Changes taking place today "are as complete as at the time
when man went from hunter and gatherer to a man of
agriculture and crafts," said the Western Judicial Circuit
Superior Court judge who was elected to a 4-year term early this
year, after serving out a 2-year appointment to the post.
Gaines discussed what he fell were shifting values in such
social institutions as the family, education and his own profession
and what the courts have done in response
"We re redefining what the family is," he said. And when that
family breaks up. new court decisions have changed the divorce
procedures, he added
"In 1973. Georgia added its thirteenth ground for divorce—no
fault, where a relationship is irretrievably broken," he said, and
a 1979 Alabama decision now allows "either party to recover
alimonv from the other "
Discipline in the schools has suffered due to changes in the
family, said Gaines "Schools have to assume some of the
burdens that the family used to take care of," he said.
Games said that the typical youthful offender he sees in court
is a "school dropout with a sense of failure " He praised a
rehabilitation program at a Georgia prison for youthful offenders
which is helping such dropouts master the basic school courses
Gaines blasted members of his own profession who wish to take
advantage of their "right to advertise" by virtue of a recent
Arizona court ruling
"I don't think advertising does the profession any good." said
Gaines “I consider law a calling "
Holding up a copy of an 1952 Southern newspaper. Gaines
offered it as evidence for his contention that advertising is
nothing new for the law profession. "Over 100 years ago we
permitted ads by lawyers and even dentists," he said. "But I
think it was wrong then and I still do."
He mentioned that California now permits any type of attorney
advertising "right up through renting a blimp "
Responding to a question concerning his feelings on capital
punishment. Gaines said he fell there are "some crimes so
horrendous that the punishment should fit the crime "
One result of capital punishment, he commented, is that the
man who is executed will never repeat his crime.

If Athens does not receive its share of the money, whatever it
may be. there is a good chance that property taxes will have to
be levied once more Athens recently rolled back the property
tax to a one mill tax for landed indebtedness, expecting to make
up the lost funds with the sales tax money
The county must also take into consideration another Supreme
Court ruling which states that the county must roll back property
taxes not only in unincorporated Clarke County, but also for the
entire county
This would result in city residents receiving property tax
rollbacks from both the county and the city
