Trials Hasten Destruction
VATICAN CITY (Radio,
NC) — The trials of Catholic
priests and laymen in com
munist-ruled Hungary is no
thing but an effort to hasten
the destruction of the Church
there, according to an edi
torial in L’Osservatore Roma
no.
The more than a dozen de
fendants at the Budapest trial
—including nine priests—are
charged with conspiring to ov
erthrow Hungary’s commun
ist regime with the aid of an
unidentified foreign power.
All but one of the defendants,
Father Oedon Lenard, have
pleaded guilty after months in
Red prisons.
The editorial — signed by
the assistant editor of the Vat
ican City daily, Federico Ales-
sandrini — stated:
“It is quite clear that the
purpose of this new demon
stration of terrorism by the
courts is to increase the suf
focating oppression that for
some time past has weighed
on the consciences of\Hungari-
ans and in particular on the

By trying the Catholics for
a nonexistent conspiracy, the
editorial went on, the Buda
pest court is seeking to hasten
the weakening and destruction
of the Church. The trial is not
the only weapon of the Reds
in their stepped-up campaign
against the Church, the edito
rial said. The communists are
also trying to force Hungarian
Catholics to submit to the so-
called “peace priests,” who are
puppets of the regime.
The editorial recalled that
Soviet Premier Nikita Khru
shchev in 1956 denounced the
terrorism of the courts under
the Stalin regime. It pointed
out that Mr. Khrushchev con
demned both the false tes
timony and the obtaining of
confessions by torture and pro
mises of pardon. It also recall
ed that he said he denounced
these things because they
were directed not against the
exploiting classes, but against
the honest workers of the par
ty and the Soviet state. But
apparently, the editorial con
cluded, Marxist logic and com
munist morality permit the
same condemned tactics to be
used against Catholics.

WASHINGTON — The De
partment of Justice is bracing
itself for another long, drawn-
out legal battle with the Com
munist party of the United
States, despite the fact that
the Supreme Court has fin
ally supported convictions
under the Internal Security
Act of 1952 and the Smith Act
of 1940.
After 10 years of litigation,
the Supreme Court upheld the
McCarran Act requiring the
Communist party of the U. S.
to register as a tool of the
Soviet Union. On the same
day, it upheld the Smith Act
of 1940 making it a crime to
be an active and knowing
member of an organization

Under the law, the Com
munist party has until August
9 to comply, or be subject to a
fine of $10,000 a day. Its offi
cers would be subject to a sim
ilar fine or five years in jail
or both.
Gus Hall, secretary of the
Communist party, told a news
conference that the party
would not register as the law
requires, and would not turn
over its membership lists “if
we had them.”
The case involving the In
ternal Security Act began on
November 22, 1950. At that
time the Department of Jus
tice asked the Subversive Ac
tivities Control Board to re
quire the Communist party to
comply with the law. The first
hearing took more than a year
and filled 14,000 pages of
stenographic record. The
SACB three times found the
party to be a communist-ac
tion group under direction
from abroad. Twice — by the
Supreme Court in 1956 and by
the Court of Appeals in 1958
— the case was sent back to
the board.
Now the Supreme Court has
finally decided both cases. But
it is expected that another
long legal battle will set in.
The communists are expected
to ask the Supreme Court for
a rehearing of the cases and a
stay of execution of its decis
ions.
If this move fails, and the
communists, as their secretary
has promised, refuse to regis
ter, y then the Department of
JusStice will go into the Fed
eral District Court here and
bring action to impose the
penalties provided under the
/aw.
When that action is taken,
it is expected here that indi
vidual communists will then
invoke the Fifth Amendment
against self-incrimination. The
argument probably would be
that if one registers as a com
munist under the McCarran
Act he gives evidence against
himself under the Smith Act.
In writing the majority de
cisions in two cases recently
decided,! Justice Frankfurter
said it ^was “premature” to
raise the defense of the Fifth
Amendment in those actions.
He said the amendment could
be invoked if and when pen
alties were imposed under the
law.
Fault-finding is easy—culti
vate the habit of seeing the
good in people.
