PAGE 11 — The Georgia Bulletin, April 23, 1987 Pregnancy Prevention Funds For Teens Ruled Unconstitutional Official Denies Hunthausen News Story SEATTLE (NC) — A National Catholic Register story that the Vatican hopes to solve the ongoing con troversy surrounding Archbishop Raymond G. Hunt hausen of Seattle by eventually retiring the arch bishop is “speculative” and “incorrect,” said the chancellor of the Seattle Archdiocese. The chancellor, Father Michael G. Ryan, told priests of the archdiocese in an April 15 letter to “disregard” the story. He said the information in the article “was apparently leaked ... by an uninformed and irresponsible party.” Francis X. Maier, editor of the Register, which published the article in its April 19 issue, said the story was “correct” and said the newspaper would not have published it unless it was “absolutely cer tain” of the facts. The story in the Los Angeles-based Register said that “according to highly placed sources” the Vatican hopes to “diffuse tensions” in the Seattle Archdiocese by promoting Auxiliary Bishop Donald Wuerl to his own diocese “and eventually retiring Hunthausen.” The Vatican last year instructed Archbishop Hunt hausen to hand over authority in several key areas of archdiocesan life to Bishop Wuerl. The move provok ed widespread controversy and led to the appoint ment by the Vatican in February of a commission of three leading U.S. archbishops “to assess the current situation” in the Seattle Archdiocese. The Register article said the “unusual, phased-in resolution to the continuing crisis” in the archdiocese “may bring a measure of peace” before Pope John Paul II visits the United States in September. In his letter to priests Father Ryan said the “gist” of the article was that the Vatican has “formulated some sort of ‘deal’ in an attempt to force Archbishop Hunthausen into accepting early retirement.” He said it is “common knowledge” that Archbishop Hunthausen has had “very recent discussions” with the commission. “I can assure you that the arch bishop has not been asked to retire or resign, nor are any ‘deals’ being made in that direction,” Father Ryan said. Mercy Sister Joy Clough, spokeswoman for Car dinal Joseph Bernardin of Chicago, a member of the Vatican commission, said Cardinal Bernardin had no comment on the article. BY LIZ SCHEVTCHUK WASHINGTON (NC) — A federal judge, ruling on a government program aimed at preventing teen-age pregnancies, said April 15 that funding church agencies under the program is unconstitutional. U.S. District Judge Charles R. Richey ruled that the pro vision of the Adolescent Family Life Act allowing religious groups to*get money for pregnancy prevention efforts violated the First Amendment’s mandate of separation of church and state. Richey’s ruling was promptly criticized by Mark E. Chopko, general counsel for the U.S. Catholic Conference, who said the program did not violate the Constitution. Richey issued an injunction preventing religious organizations from receiving funds but left open the ques tion of whether the entire law, passed by Congress in 1981, should be thrown out. The law “seemed to offer a choice — a choice that Con gress was entitled to make,” Chopko said April 16. “What I’m disappointed with is it appears we (church groups) will be excluded just because we’re religious. I don’t think that’s what the Constitution requires.” Often dubbed the “chastity law,” the program authorized by the legislation provides grants for projects that en courage “self-discipline and other prudent choices” to the problems of adolescent sexual activity and pregnancy. The program specifically denies funds for “abortions or abortion counseling or referral” and calls for support for ef forts by “religious and charitable organizations” and other private sector entities. The law was attacked in a 1983 lawsuit against the government by a coalition of citizens, by the American Jewish Congress, and by three United Methodist clergy. The lawsuit said grants in the program included $75,000 to Catholic Charities of the Diocese of Arlington, Va., for a sex education program in Catholic schools and parishes; $446,806 to St. Margaret’s Hospital, Dorchester, Mass., for a program of parochial school sex education; and $177,437 to PaineWebber Brian .VI. The judge ruled that although the provision of the law at issue “has a valid secular purpose, it is unconstitutional on its face because it has the primary effect of advancing religion and fosters an excessive entanglement between government and religion.” “Because these religious organizations use federal funds to educate or counsel on matters inseparable from religious dogma, the constitutional implications of the grants are clear and clearly troubling,” the judge wrote. “The in escapable conclusion is that federal funds have been used by pervasively sectarian institutions to teach matters in herently tied to religion.” Citing examples involving Catholic and Lutheran agen cies, he noted that at the Dorchester hospital a counselor was told to follow the “Ethical and Religious Directives of Catholic Facilities."
