Litigation was then Instituted, charg ing that It aaa colluakut on the part of Mr. Mixon with Mr*. Loud to ob tain poaaeeslon of thl* property with out paying the mortgage on It. The caae was artru'-d acme time. In IW6 went to the supreme court and there was decld»d that the Jury should determine that whether the levy of the sheriff was excessive, and that, If It yeas, the deed to Mr. Mixon ahouid bo set aside a» Illegal and void. On yesterday this iaaue was tried by the Jury. a* well as the issue «a to whether the Improvements that Mr. Mixon had put on the property were put there by him In good faith, think ing that the property was his own. The juty rendered a verdict answ-erlng cer tain questions that were submitted to them by the Judge, wherein they decid ed that the levy « as excessive, and that Mr. Mixon was not a purchaser In good faith—thus setting aside the sale to Mr. Mixon, and allowing the mortgage to be collected from the land. The plaintiffs case was managed hv Mr. J. J- Spalding, of Atlanta, and by £*, Henry* Eohcn, of this city; the defendants were represented by Mr. Joseph R. Lamar and Judge H. C. Ro ney. .
