BT appearing to the Court upon the application of
Ezekiel Buffington, of Hall county, und State afore- !
said, that'he became the purchaser of a tract or parcel of
Land, situate and lying in the said county of Hall, known
as No. 116, in the 12th dist. of said county, adjoining
land of Smallwood and Floyd, which was the joint prop
erty of James Spier of Upson county, and of Harrison
Smith, lute of Russell county, Alabama, deceased ; and
that the said Harrison Smith died, before the said James
Spier as his attorney, under a regular power did or
could make a deed for the part or interest of the said j
deceased, to the same. On motion, ordered that Robt. j
Collier, administrator of the said Harrison Smith, dec’d. i
make titles agreeably to the said power of attorney, til
tl.c next term of this court, if no sufficient objection he 1
made thereto during the said next term, in terms of the
act of I.sth February, 1799. And it is further erdered
that at least three months notice be given of this appli
cation agreeably to law.
