The Joint Committee of the Senate and House of Repre
sentatives, to whom were referred the returns of the late cen
sus of this State,
Report that they have examined the snmc—and after mak
ing the proper calculations,they annex a tabular statement of

of white inhabitants, the number of slaves and free persons

Richmond, DeKalb, Elbert, Houston, Clarke, Columbia,
Coweta, Franklin, Jasper, Greene, Oglethorpe, Putnam,
Stewart, Walton, Warren, Washington, Wilkes, Bibb, Hab
ersham, Randolph, Cobb, Cass, Cherokee and Pike, being
the thirty-seven counties having the greatest representative
population, shall each have two Representatives, and that
the' counties of Hancock, Hall, Juekson, Jones, Morgan,
Bryan, Liberty, McIntosh, Glynn, Wayne, Cumdon, Ware,
Lowndes, Appling, Montgomery, Tatnall, Bulloch, Effing
ham, Scriven, Emanuel, Laurens, Wilkinson, Telfair, Ir
win, Decatur, Thomas, Baker, Early, Lee, Sumter, Macon,
Marion, Pulaski, Doolv, Twiggs, Jefferson, Taliaferro,
Baldwin, Crawford, Heard, Carroll, Campbell, Fayette,
Butts, Lincoln, Madison, Paulding, Forsyth, Kabtm, Union
Gilmer, Murray, Walker, Dude, Floyd and Chattooga shall
be entitled each to one Representative.
A BILL
To be entitled an net, to levy and collect Taxes for
the Support of Government.
lie it enacted by the Senate and House of Representatives of
the State of Georgia, in General Assembly met, and it is
hereby enacted by the authority of the same, That for the sup
port of Government for the fiscal year 1840, and for each
succeeding year thereafter, there shall bo levied and collect
ed on persons and property in this Stale the following umount
of Taxes.
On every free white male citizen of tlie age of
21 to 60 years,
On every slave,
On every free person of color,
Or every practicing Lawyer,
On every practicing Physician, Surgeon and
Dentist,
On every Billiud Table,
On every Auctioneer or Vendue Master in
Cities or Towns having a population of
5,000 or upwards, the sum of,
In Cities or Towns having a population of
3,000, or upwards,
In all other Towns or Counties,
On nil pleasure Carriages, Barouches, Bug
gies and Sulkcys, one-half of one per cent
on their respective value.
On all Gold and Silver Wutclics, one half of l
per cent on their respective value.
On every Stallion and Juek, the price of a season.
On nil goods, wares and merchandise, on each
hundred dollars value,
On Bnnk Stock, 40 cents on cacli hundred
dollars,
On auction sales, one percent on umount sold.
On all Lcgucics except Lineal descendants 1
per cent qji amount received.
On all monies loaned or invested at interest 10
cents oil each hundred dollars.
On all Ferries, Bridges and Turnpikes, hav
ing an income exceeding 100 dollars, one
per cent on receipts.
On all agencies of Insurance offices authorized
by other Stutes and kept within this, 1 per
cent on the premiums.
On all agencies of Banks authorised by other
States and kept within this, J per cent on
amount ofexchange sold and bought.
Oil all Land and real estate, with tho improve
ments thereon, including machinery of every
description, 10 cents for each hundred dol’s.
And be it Jurther enacted by the authority aforesaid, That
if any person or persons shall fail or refuse to mnke return ol
their taxable property, that such person or persons shall he
doubly taxed for the first year lie, she or they may refuse to
make return, trebly taxed for tho second year, and taxed
four fold for the third year, taking the tax of the preceding
year ns the basis of said double ta x.
And be it further enacted by the authority aforesaid, That
if any person shall make an insufficient return of the amount
or value of his or her property, that tho Tax Collector shall
I select one disinterested tnx-pnycr, and tho person making
I such insufficient return mny select- another, and the two so
j selected shall choose a third, who shull investigate the re
turn, and the finding of the suit! three persons so selected
shull be binding on the parties, and in case the person milk
ing such insufficient return shall fail or refuse to nominate
his referee, then the Tax Collector shull nominate two, and
tho two by him selected shall appoint the third as before pro
vided.
Awl be it further enacted by the aulhuiily afire said, That
such portions of existing tax-laws us are not incomputable
with this net, be and the same arc hereby continued in full
forco mid effect, and that such portions thereof us militate
! against the provisions of this net he and the same are lierc-
; by repealed.

To be entitled nn act to apportion the Representa
tives among the several Counties in this State, ac
cording to the seventh section of the first article
of the Constitution.
Sec. 1. Be it enacted by the Senate and House of Represen
tatives of the State of Georgia, in General Assembly met,
and it is hereby enacted by the authority of the same, That
until the next apportionment of Representatives among the
counties of this State, the representation of the several
comities shall be ns follows, to-wit: Tho counties of Chat
ham, Muscogee, Meriwether, Monroe, Troup, Harris, llcn-

To he entitled nn Act to reduce the number of Jus
tices of the Inferior Court in each County, to pre
scribe their duties and fees, and to authorize the
election of Commissioners of Hoads and Revenue
in each County, and to prescribe their duties.
Sec. 1. Be it enacted by the Senate and House of Repre-
sentat ires'of the State of Georgia, in General Assembly met, and
it is hereby enacted by the authority of the same, That there
shall he elected nt the time now proscribed by law for the
election of Justices of the Inferior Court, by the citizens of
oath county entitled to vote for members of the Legislature,
one Justice of the Inferior Court for each county in this
State, who shall hold his office for the term of four years,
unless removed according to law, and who shall exercise nil
the powers and authority, und perform nil the duties which
are now required of the Justices of the Inferior Court in this
State, while acting as nil Inferior Court or Court of Ordina
ry, except in cases where it mny lie otherwise directed by
this or any subsequent act. Each Justice of the Inferior
Court shall be commissioned by His Excellency the Govern
or, and shall take and subscribe the oaths now requited hy
luw, before some magistrate authorized to administer the
same.
Sf.c. 2. Be it further enacted, That the Justice of the In
ferior Court in each county, shall be allowed to draw und
ccivc the following fees to-wit:
For granting letters testamentary, or of
guardianship, or of administration,
including the necessary orders nml
bonds, the sum of
For probnte of a will and ordering it to
record,
For each order ni si. or order absolute,
For examining and passing upon the
annual accounts, vouchers mid re
ports of Guardians, Executors and
Administrators, and ordering the same
of file or record,
For each Verdict, Confession, or Judg.
ment in the Inferior Court,
All of which fees shall lie taxed intlie hill of costs, nnd cnllect-
cd by the proper officers, nnd paid over to the said Justice.
Sec. 3. Be it further enacted, Tlint nil bonds and recog
nizances which may have been given or made pnynble to the
Justices of the Inferior Court in nnv county in this Stnte,
shall inure nnd be payable to the Justice of the Inferior
Court of said county, mid his successors in office, nnd suits
may he prosecuted nnd judgments recovered thereon in the
name of such Justice, or any of his successors, against all
or any one or more of the obligors to any such bond.
Sec. 4. Be it further enacted, That if the Justices of tho
Inferior Court, now in ccgnuiisMoii, in any county in this
State, shall resign their commissions, it shall he the duty of
the Sheriff of such county, to order nn election for a Justice
of llie Inferior Court for such county, under this act, which
election shall bo bold nt the places of holding elections in
said county in the manner now prescribed hy law, after
twenty days notice to ho given hy said Sheriff, nt each place
of voting in said county, and the person elected shall lie com
missioned hy the Governor, and hold his office during the
unexpired term of his predecessors, und until his successor
limy be elected und qualified, and when a vacancy shall oc
cur in the said office of Justiceof the Inferior Court by death,
resignation, removal ov otherwise, it shall be the duty of tho
Sheriff of the comity in which such vacancy may happen, to
order an election to (ill the same, according to the provisions
of this uet, nnd the person so elected shall be commissioned
hy the Governor, and hold his office until the next regular
election for said officer, and until his successor is qualified.
Sec. 5. Be it further enacted, That at the time an
election may lie ordered hy the sheriff to he held in any
county in this State, for n Justice of the Inferior Court under
the provisions of tho foregoing section, nnd on the first Mon
day in Jnnuary in each and every year thereafter, there shnll
he elected in each county in this State four Commissioners
of the Ronds and Revenue, any two of whom, together with
the Justice of the Inferior Court, shall constitute a Court to
levy the County tax, to lay out nnd discontinue roads, mid
shull have and exercise all the power in relation to roads,
bridges, highways, ferries and causeways, which are nt pre
sent given to nnd exorcised hy the Inferior Court, to innko
such contracts und orders und appointment of officers ns
may be necessary to enrry into effect tlie powers herein
granted.
Sec. C. Be it further enacted, That on the second
Monduy in January, and on the second Monday in every
other montli thereafter in each year, tho Justice of the Infe
rior Court, together with the two Coin inissioners of Roads and
Revenue, or with any two of them, shnll hold a Court for the
purposes prescribed in the foregoing section, nnd the said
Justice and Commissioners shall continue in session until the
business is completed, provided, that if snid Commissioners
shall fuil to appear and attend on or before the second day
of said term, the Justice of the Inferior Court of such county
shall proceed to discharge nil the duties required of said
Justice and Commissoncrs hy law.
Sec. 7. Be it further enacted, Tlmt said Justice of tho
Inferior Court, together with the Commissioners aforesaid, or
a majority of them, shall lmve control over the funds in tho
County Treasury, and they or a majority of them shall have
power to appoint a County Treasurer, as now authorized hy
law, nml to make appropriations for defraying expenses in
curred for county purposes, und to exercise all the powers
now exercised hy the Inferior Court of each county, in rela
tion to the preservation of the public health, and for the care
nml benefit of the poor, and of such poor or common school
fund as may belong to their respective comities.
Sec. 8. Be it farther enacted, That within five days af
ter each election, it shall he the duty of the Sheriff of each
county to return to the Justiceof the Inferior Court, n list of
four persons having the greatest numhci of votes for Com
missioners aforesaid, whose duty it shall he to commission
them for the term of one year, and until their successors nre
elected und qualified, nml the persons so commissioned shall,
before they proceed to tho discharge of their duties, take
and subscribe the following ontli, to-wit: I- do solemnly
swear (or affirm) that I will faithfully discharge the duties
imposed on incus a Commissioner for Roads nml Revenue for
the comity of so help me God. Provided, that if any
mitten objection slnill he filed with the said Justice of the
Inferior Court within five days after said election, to his com
missioning any one or more of the persons returned by the
Sheriff ns elected, it shall he the duty of said Justice to with
hold said commission ami examine the said objections, and
act ns the right anil justice of the matter requires.
Sec. 9. Be it further enacted, That should u vacancy oc
cur, the Justice of the Inferior Court, together with the Com
missioners in office, ure hereby authorized lo fill such va
cancy, and the person so appointed shall hold his office until
the next regular election for Commissioners, und when any
vacancy occurs hy resignation or otherwise, in any office, the
appointment of which is vested in said Justiceund Commis
sioners, it shall he lawful for them or a majority of them to
make the appointment between the terms of Court, und the
appointment slnill be us vulid us if made at the regular term.
Sec\ If). Be it further enacted, That it shall be lawful fur
the Commissioners of Rouils mid Revenue ill each und
every county in this State to hold their respective Courts,
notwithstanding tho absence of the Justice of the Inferior
Court, on the first day of the regular term.
Sec. II. Beit further enacted, Tlint the Commissioners
of Ronds and Revenue shall lie exempt from serving on ju
ries, working on ronds, und performing ordinary militia duty
dining the lime they net as such.
Sec. 12. Be it further enacted, That this uet in ull its
provisions shall lie fully in force mill effect in each nnd every
county, when the Justices oftlie Inferior Court in such comi
ty now in commission mny resign the same pievious to the
regular election of Justices of the Inferior Court, nnd tho
next regular election for said officer shall he held in refer
ence to the provisions hereof in all the Comities in this State.
