If we never asked the reason for such
enfranchisement, it must be found, first,

cure the best services of the slaves; and
second, in its intrinsic justice and hu
manity. In brief the Government; can
not be so Improvident and so foolish, as
t<trattempt to obtain the services of the
slave at the hazard of life, without secur
ing, to him the boon of freedom. Nor, if
the? Government were so bereft of com
mon sense as to forego this temptation
to the enlistment of efficient service,
could it be guilty of the unutterable
*ess of using the slave in the na
, defence and then returning him to
bondage. Therefore, the slave who
fights is enfrancised, but every argument,
and every consideration which pleadß
fo£ the enfranchisement of the family.—
There is the same practical necessity
or doing it, and the same unutterable
shjijbbmess in not doing it. There is no
pyuuSple of law better established than
the rule that any acknowledged right
caries with it all incidents essential to
its exercise. Ido not employ technical
jmguage, but I give the idea which is
founded in reason and the nature of
ihfctgsT It would be vain to confer a

joyment were denied, From this simple

in this service can enfranchise the slave
which it enlists, but that it is impotent

’nent. The human heart regrets this in
sufferable pretention. But it is said the

belong to another. Surely this
unrighteous pretension will not be made
the apology for a denial of rights. If the
amfly of the slave he not designated by
saw, or by the forms of legal marriage,
then it must be ascertained by the next
best evidence possible* that is, by cohab
itation and mutual recognition as man and
wife; and any uncertainty in the evidence
must bo regarded as a natural incident
of slavery. As men cannot take advan
tage of their own wrong, so slaveholders
cannot on this occasion take advantage
of Slavery. Any other rule would prac
tically unite with Slavery U denying to
the slave his wife and child. There is a
well known French maxim which says

And on this occasion permit me to say
that it is only the first stage of the argu
ment which merits attention. Concede
i&ftt the soidier -may be enfranchised,
«and It follows that by the same coosti-
power his family may be admit
ted to an equal liberty. Any other con
efasiou would be as illogical as it is in
human, and discredible alike to the
head and heart. There is no argument,
vihether of reason or of humanity, for the
enfranchisement of the soldier, which
does not plead equally for that of his fam-

we fed so perform this duty. I cannot
close what I have to gay without adding
that in my opinion Congress at this mo
ment is complete master of the whole
question of Slavery everywhere in the ’

The question was then, taken on the
reference of the resolution, and it was de
cided in the negative, yeas, 15; nay3, 10.
At the request of Mr. Saulsbury, who
wished to debate the proposition, ftirther
consideration of the subject was post
poned.

The Senate Committee on Foreign Rela
tions have agreed to report a bill giving
notice to England of the abrogation of
the treaty limiting the number of war
vessels to be kept on the Lakes.

Whenever refugees from within the Rebel
lines, or deserters from the Rebel armies, pre
sent themselves at U. S. Camps or Military
Posts, they will be immediately examined by the
Provost Marshal with a view tt> determine their
character, and their motive is giving themselves
up. If it appear that they arehonest in their in
tention of forever deserting the Rebel cause, care
will be taken to explain to them that they will
not be forced to serve in tho U. S. Army *£*£?**•
the Rebels, nor be kept in confinement. The
President’s Proclamation of December 8, 1863,
will be read to them, and If they so desire, the
oath therein prescribed will be administered to
them. They will them be questioned as to
whether they desife employment from the Uni
ted States; and if so, such arrangements as may
be expedient will be made by the several Army
Commanders for employing them on Govern
ment works within their commands. Those who
come to the Army of the Potomac will be for
warded to the Military Governor of the District
of Columbia, at Washington, with reports in
their casea, that employment may be g von them
if desired* or, i? not, that they may bosanfcM ftr
