Georgia Republican & State Intelligencer. Six Dollars a 1 ear, I hi/ in Advance, GEORGIA REPUBLICAN\ Volume I. No. 13. DIVISION ORDERS, Savannah,October 25, 1802. The Court Martial,'of which Major Shad was Prrfident, ordered for the trial of Lieu tenant Stackhoufe, on the charges exhibited against him by Lt. Cos!. Mitchell, having , Tound him gudey of the firft, third, 2nd fourth charges— to wit : c> “ 1 ft. For uncfficerlike conduifl on the eve ning of the 29th of September last, whiift on duty, in breaking open, and raking pofttfilon by military force, of tire houlc ot Mr. Isom CLy, on Tybee Tfland. yd. For disobedience of orders and nnoffi cerlike conduft, in leaving his poll from the morning of the 30th of 6’eptembcr until his detachment was re iIC vcd. 4th. For disobedience of orders and unoffi, ciahke conduct, on the eleventh infract, i n not delivering up his fvvord when arretled.’* And thereon having* fentenccd him to re ceive a reprimand from the Major-General rnd s o pay a sum of one hundred’ and eighty dollars, being equal to months pay when in adual fervice —the Major-General con firms the sentence and difibives the court. V/liilft however, the Major-General is in duced to confirm the sentence, he is impelled to remark that it has been more indulgent than Lieutenant Stackhoufe had a rihr to expect. The Lieutenant was sent to the sta tion at Cockfpur, to piotetft the citizens and their property—nor to violate their rights and break open their houses. He was in a final service—the country in a flute of alarm, not only in Georgia, but along the whole fouchern route ot the TJrdcrd 3veCics . lirvufjxjp and fjj„ furrefbion were expefled, against either cf which the ft ate had a right to proted herfelf until the arm of the Union could be extended so her support. In such a situation as this, for an officer to leave his post— the post of I iONOR as regarded himftlf, and of TRUST as it rcipeded his country — was unpardona ble. It afftded his com million, if the rigour of the law had been pursued—is not his life. Again, as it refpeds the fourth charge.— The refufai of his sword to the order of the ‘Colonel, is a gross violation of aii military rule—the commiftlon is the authority under which the officer has a right to wear the fwor* s as such —and the fvvord is the security or bail to the date, that the officer will faithfully perform the trust reposed in him—if the prin cipal fails the lecurity becomes liable, and the sword mud be taken from the cfficeF charged with violating his contrails. But the idea of cn officer’s sword beinc private property after he receives Ids com iniffion is a mistaken one—the commiftlon is an exchange tor its value—lt belongs foltdv to his country as rcipeCts its life whiift he holds his commiftlon, and may legally and iliall be- demanded hereafter on all oegafions of arrdt, in the firft divifton, and the refuting (hall be punished if a Court Martial wilt order it—or be confined if the officer requires it. is hoped thatgthe leniency of the sentence in the case cf Lieut. Stackhoufe will never be relied on by any officer on any future oecafion. Lieutenant Stackhoufe (lands highly culpable in the Major-Generai’s view, and is hereby leverely reprimanded, with a hope that it wd! be a warning to him in his future milita ry walks. The Lieutenant will pay intp the hands of the proper officer of the Chatham Regi ment, the fine of one hundred and eighty dol lars—-being the sentence of the court, within one month from the date of this order, and iland arrefled until the fame is discharged— no resignation will be accepted—and if the fame be not paid in one month, the com manding officer of the Chatham Regiment will ifTue his warrant to levy the fame. Fourth —And be it further ordained, That inch Haves as fiiall be actually employed and enrolled, to make up any deficiency in the number of free negroes or mulattoes, to man the engines as aforefaid, shall be allowed a “cafonabie compcYilation for their services to! he fixed by the board of fire mailers not ex- j cteding feventy-five cents each, for the half! day they may be actually employed. That! m cases of alarm, or fire, the laid Haves Ihall be col open fated and rewarded by the board oi nre mailers, according to their merit, in time of iuch alarm or fire. Eif th And be it further ordained, That all orders and relolutions which shall be made by the board of fire mailers, pursuant to this or any other ordinance veiling authority in the Lid board, shall be obeyed, observed, and executed by the said managers and assistants,. and alio by the Lid Haves to be employed under this ordinance ; and if any manager or affillant negiedt cr refufe to obev or exe cute the fame, such manager or a Tift ant, on convi<sl ion thereof before the Mayor aid Al dermen, ihall be fined*in a sum not exceeding fifty dollars; and if any Have enrolled or em ployed, in pur dance of this oidinance, shall neglect or refufc to obey or execute the ftme, the m aster and owner shall, on conviction o ; iuch Have before the board of fire matters, pay a fine not exceeding five dollars, and in de-’ fault of his or her paying said fine, the Lid Have shall receive such number of iafhcs, nor exceeding thirty-nine, as the said fire mailers ihall order and dire<st. Sixth—A nd be it further ordained, That the third section of the ordinance entitled “ An ordinance for preventing as much as may be, accidents which may happen by fire in Sav annah, for preserving the fire engines in said city, and for rendering the lame as ufeful 2s may be in caie of fire, and for other purposes therein mentioned,” paffied the 2d December, 1799, be, and the fame is hereby repealed.
