Cal laghan, of the schooner Exuma, from New-Providence, reported the fame, which being read, was agreed to, and ordered to be publilhed in each of the Gazettes of the City. BY this public instrument of writing and protest, be it known ana made manifeft unto ail to whom it doth or may in any wife concern. That on the day of the date hereof, personally came and appeared before me, Josei* h Wel scher, one of the juitices alligned to keep the peace in and for the county of Chatham, in the said ftaie, and Notary Public for the fame, duly and by lawful authority admitted, commiilioned and lworn, residing in the said city of Sa vannah, John Love and John .Holland, Efquirus, two of the Aldermen of the laid city, who as a committee from, and in the name and behalf of the hon orable the Mayor and Aldermen of the said city of Savannah, delired and re quired me to protest, as well against William Norment, Esquire, collector of ‘Faxes for the said county of Chatham, as against the proceedings of the late Legrilaturc of this ftate,and of the Exe cutive Department, in purluance there of, refpeding certain Mulaitoesand Ne groes lately brought into this Hate. For that whereas, in and by a certain adi of the General Assembly, made and. palled on the twenty-lecond day of Feb ruary, one thousand seven hundred and ninety-fix, entitled, “ Anadt to organ “ ize the Militia in the several new “ counties in this state It was and is amongst other things enafted, 4< That “ the officers of Militia in the hrft bri “ gade in the firlt division, ftrould be “authorized and empowered in their “ refpedfive patrol diitridls, to appre “ hend any Negroe, Muftee or Mulatto, “ Freeman or Freemen, Have or (laves, “ who should thereafter arrive in any “ port of this state, from any of the “ Weft-India or Bahama Illunds, and to “ keep such Muftees, Negroes or Mu “ lattoes, in close and fate custody, un “ til they could be examined before the “ Corporation of Savannah, or any three “Just ices of the peace, for any of the “ counties lying in the said division, “ who are thereby authorized to cause “ such freeman or freemen, slave or “ (laves, to be exported at the expence “ of the importer or owner, which such “ importer or owner is thereby made “ liable for, as well as for the expence “ of apprehending or keeping such per “ fonsAnd whereas divers Mulat tocs and Negroes were, after passing of the said ads (to wit) on or about the day of September lall, imported, or brought into this port by the schooner Exuma, Callaghan Mailer, of and from New-Providence, one of the Bahama I Hands, consigned to Melfrs. Gairdner and Mitchei of Savannah, Merchants, and which laid Mulattoes and Negroes, were taken up by the said schooner Ex uma, on her passage from New-Provi dence, from the wreck of the Ihip Gen eral Nichols, of and from the Illand of G renada, and are direftly objeds of the laid ad, and expressly within the true intent and meaning of the fame : They having arrived in the port of Savannah, front the leVf-Indies ,and being all French and chiefly free people of colour, common- called Brigands, and absolutely con vids, transported (with others) from the said Illand of Grenada, lor treason and rebellion, and therefore jdangerous to the peace and fafety of the state, as fully appears by the following copy of a recognizance, entered into at the said Illand of Grenada, for their transpor tation, from thence (that is to fay) “ Grenada, Beit remembered, That on “ the 3th of July, in the thirty-seventh “ year of the reign of our fovercign “ Lord George the third, by the grace “ of God, King of Great-Britain, See. “ James M‘Burnie of the town of St. “George, in the Illand of Grenada’ “ Merchant, personally came before me “ William Arnold, Esq. one of the af “ fiirant Justices of his Majesty's court “ of Common Picas, held in and for the “ said Illand of Grenada, and acknow “ ledged himieif to owe to our laid “ Lord the King, two thousand pounds “ of good and lawful money of Great “ Britain, to be made and levied of hi* “ goods and chattels, lands and tenc “ ments, to the use of our said Lord the “ King, his heirs and fuccelfors, it dc “ fault lhall be made in the condition “ hereunder written : Taken and ac “ know ledged before me.—The condi “ tion of the abTWe written recogniz “ ance is such, That whereas the* laid “ James M‘Burnie, for and on the pait “of his Brother and Partner j oha “ M‘Burnie, now in Europe, and nim “ felf, is and Hands bound to carry oil, “ and transport from this Illand, diveis (t white and free coloured perjons, who “ have been convidtd and attainted o> “ treajon and rebellion, but have received “ his Majesty’s molt gracious pardon, “ upon condition of being tranlporieu “ from this Illand, for each of which “ said persons, whom the laid John and “ ‘James M‘Burnie, ihaii so carry elf “ and transport, it hath been agreed they “ fhalibe entitled to, and fhaii receive “ of and from the public Treasurer of “ this Illand, the linn of pouncs “ ten (hillings current money, provi “ lions and other neceliaries ouring the “ voyage : Now theretore if the laid “ John and James or the per “ son or perlons appointed td take charge “ of the veifel or velleis, in which tne “ said white and free coioured persons “ are to be put on board and tranfpor “ ted, ihall and do receive and take on “ board all such said persons, who lhall “ be delivered to them, and fhaii net “ land or put on lhore the said persons “ or any ol them, in any place lying and “ being to the caftward of the Illand of “ Cuba, or in any Britifti Colony or “ Illand whatever, or other than “ a civilized country, and Ihaii w’ithm (< a realonable time from the date of the “ foregoing recognizance, duly return a “ deposition, the oath of the mailer and “ mate of the veiiel or velleis, in which “ the said white and free coloured per “ sons aforefaid, lhall be conveyed, lpt„ “ cifying the times and places refpec “ lively, when and where they and eve “ ry of them lhall have been landed and “ put ori lhore, such depolition to be “ taken and certihed by a magiftraie or “ iome other public officer, at the firlt (e Bfitilh or Ameiicau port the said “ veifel or velleis lhall arrive at, alter “ having so landed and put on lhore the “ said white and free coloured perlons “ as aforelaid, the dangers of the le3s “ and capture by the enemy to be con “ liderecl as a general exception. Then “ the laid obligation to be void, other “ wife to remain in full force.” 4 hat the said Mulattoes and Negroes, so being persons expressly meant ana intended to be prohibited from being imported by the laid act, the said Mayor and Aluer men, felt it their duty, and did therefore in pursuance and execution of the lame ad, and of the power and authority tr* them thereby given, cause the laid Mu la t toes and Negroes, to be put and kept in close and fate custody, until they could be exported from the state according to the directions of the laid ad. But whillt the laid Mulattoes and Negroes wero so con lined in cullody, and the Mayor and Aldermen, were proceeding to such other lteps as were necellaiy to fully execute the purposes intended by the laid ad ; the laid William Norment, as Tax Coliedor, as aforeiaid, leized the laid Mulattoes and Negroes, pretending they were forleited to the state, under an act of Allembiy, entitled “ An ad “ to raile a tax lor the support of gc “ vernment, for the year oi one thouland “ seven hundred and ninety-seven,” by which (amongst ether things) it is “ enaded, That the sum oi fifteendol “ Jars, lhall be levied on all Begrois “ brought into the slate by sea for Jtitle “ ment or jale; except such as may be “ brought in by emigrants, from any “ other part of the United States lor “ fettlcment i to be paid to the ‘1 ax “ Coliedor of the county, within which “ such Negroes may arrive, within the “ space oi twenty days alter such ar “ nva), and a return of such Negroes “ fliall be made to the receiver of tax “ returns of the county,within five day* “ after such arrival, fpeciiying the num (( ber and sexes of Negroes so imported; “ and in case of neglcd or reiulal to ** make such returns or payment, the “ said Negroes fliall be and are hereby “ declared to be forfeited to and lor the “ use of the state, ana such Tax Coilcc “ tor is hereby and required “ to fell and dispose of such “ and to lodge the amount ol laies “ thereof in the Trcafury.” V. hereas the said Mulattoes and Negroes so far from being forfeited to the state, No. 404.
