general principle, and one of the amend

clared, “ that the powers not delcgatud to
the United States by the Constitution, nor
prohibitod by it to the States, aro reserv
ed to the Slates respectively, or to the
people,” therefore, also, the same net ol
Congress, passed on tho 14>h day of July,
1798, and entitled “ An act in addition to
the act entitled tin act for the punishment
of certain crime* against Ihe U. Slates,”
as also, the art paired by them on the
27ih dny uf June, 1798. entitled “An net
its punish frauds committed on the Bank
of the United Stales,” (und all other their
nets which assume to create, define, or
punish crimes other than those enumerated
in the Constitution,) are altogether void
and of no force, and that the power to cre
ate, define nnd punish such other crimes,
is reserved, nnd of right appertains solely
and exclusively to the respective Stales,
each within its own territory..
3. Resolved, That it.is true, as a gen
eral principle, and is nlso expressly de
clared by one of the amendments to ;he
Constitution, that “ the powers no[ dele
gated to the United States by the Constitu
tion, nor prohibited by't to the Slates, are

hibiting the free exercise thereof, or a-
bridging the freedom of speech, or of the
press," thereby guarding ill the same sen
tence, and under the seme words, the free
dom of religion, of speech, and of tho
press, insomuch, that whatever violates
either, throws down the sanctuary which
covers the others, and that libels, falsehood
ami defamation, equally with heresy and
false religion, are withheld from the cog
nizance of Federal tribauals. That there
fore the act of the Congress of the United
States, passed on tho 14th of July, 1798,
entitled “ An act in addition to the act en
titled an act for the punishment of certain

laws of the State wherein they are: that no
