Whereas the third section of the fust article of the
Constitution of the State of Georgia* is in the following
words, to-wit: “The Senate shall he elected annually on
thn first Monday in October until such day of elec-
lion shall be altored by law, and shall bo composed of
ono niemhni from each county, to be chosen by the elec-
ton thereof*.’* Aud whereas a part of the seventh sec
tion ofthe first nrticlo or the Constitution of the Htate of
Georgia, is in iho following words, to wit.' *■Tltd®mi«o
of Roprcientativos shall bo composed of members from
all the counties which now are or hereafter mny be inclu
ded within this State, according to their respective num
bers of free white persons and including three-fifths of
nil the people of color”—and in tho sanie section, the
following, to wit: “Each county containing three thou
sand persons, agreeably to tho (oregoiug plan of enumer
ation, shall ho entitled, th two members seven thousand
to three members, and twelve thousand to lour members,
but each county shall have at least one and not more than
four members.
And whereastho aforesaid third section, and the suid
parts ofthe seventh section ofthe said liist article of the
Constitution, touching tho ropiesentation of the General
Assembly ofthe Slute, has been found by experience to
bo dofective on account of tho great numbers in tho Le
gislature, and the enormous expense on account thereof
—wo the Delegates of the people of the Stale of Georgia,
In General Convention assembled, chosen and author
nod by them to revise, alter and amend the raid two
sections and other parts, if any, touching the rnpresontu
tion of tho people of Georgia in tho General Assembly,
have, after mature reflection and deliberation, declurcd
the following to he amendments in lieu of the aforesaid
third section, and (arts of the seventh section, winch
when ratified by the people ofthe Htate, shall Oe taken,
held and considered ns parts of the Constitution oi the
State of Georgia, in lieu ofthe aforesaid.
Tho .S'unato shall he elected annually on the first Mon
day in October, until such day of election shall be til
terftd by law, aud shall he compost'd ofone member(Vom
each &matorial District, to bo chosen by tho electors
thereof which said Senatorial Districts shall he formed
by adding two contiguous counties logetliei throughout
the Htate, without regard to population, as is hereiuuflei
specified and defined the county of Murray excepted
which shill constitute, together with such county or
counties as may be hereafter formed out ofthe territory
‘now composing said county of Murray, one ^Senatorial
District the whole number of districts shall be forty-five
and no more, and in the event of the formation of uny
new county or counties, tiro Legislature at the time of
eucli formation shall uttacn the same to some contiguous
tieuatoriul District.
Each Henirtor shall he a resident of the district for
which he may ho elected, 4s is required by the present
Constitution of residence in the county.
Tho following shall be the Henntoriul Districts:
The county of Murray shall constitute tho first district.
The second district shall ho composed i f the counties
pf Gilmer aud Union.
Tim third of the counties of Rahun and lfahorsham.
Tlie fourth of the counties of Lumpkin and Cherokee.
The fifth of dm counties of Cass and Lloyd.

The House of Representative* shall be composed of
member* from all the counties which now are, or may
be included within this Htate, according to litoir respec
tive numbers of free white persons.
Thu whole number of members in the^'uuse of Re
presentatives shall ho one hundred and forty four and no
more, except in the case of a new created county or coun
ties; such new county or’counties shall have one member
for each c.ouuty. until the taking ofthe next census there
after. and the'whole number shall be apportioned in the
following manner, viz: tliu fifteen counCiee having the
highest number of free white persons shall be entitled
to three members each; the twemy-five counties hating
the next highest number of free white persons shall have
two members each and the remaining forty-nine com
ties shaft have one member each. Whenever, from tho
creation of a new county or counties, the whole number
of members in the House of Representative* shaft ex
ceed tho number ofone hundred and loityTour, it shall
be tlie duty of tho Legislature, ut its first session after the
taking ofthe first census after the creation of such new
county or counties, in apportioning the members, to take
one metnborfrom one ofthe counties having three mem-

uing with the county that has tho smallest number of free
white persons that may be entitled to three members.
The census shall be taken us heretofore onee in seven

and is deemed by the neighbouring planters to be
