That tho State of Kansas bo and is hereby admitted into the Union on an equal footing with the original States in all respects whatever; but inasmuch us it is greatly disputed whether the Con stitution with which Kaosas is now ad mitted was fairly made, or expresses tho will of the peuplo of Kansas, this admis sion of her into tho Union ns a State is bore declared to be upon this fundamen tal condition precedent, namely: That tho saitl constitutional instrument shall bo first submitted to a vote of the people of Kansas and assented to by them, or n majority of the voters, at an election to be held for the purpose ; and as soon as such assent shall bo given and duly made known to tl.o President of the United Slates, lie shall announce the same by proclamation, and thereafter, and with out any further proceeding on the part of Congress, the admission of the said State of Kansas into the Union on an equal footing with the original States, in all respects whatever, shall be complete and absolute. At the saitl election the voting shall bo by ballot, and by indorsing on his ballot, as each voter may please, “for tho Constitution,” or “against the Con stitution.” Should the said Constitution bo rejected at tho said election by a ma jority of votes being cast against it, then, and in that, event, the inhabitants of said Territory ure hereby authorized and em powered to form for themselves a Consti tution and Stute Government by the name of tlie State of Kansas, preparatory to its admission into the Union according to the Federal Constitution, and to that end may elect delegates to a Convention as herein after provided. Section two relates to the State’s juris diction, and section four to tho manner of conducting the elections authorized by the first section. Section four is amend ed by Mr. Montgomery’s substitute by -trikiugout the clause which provides that “no person except citizens of the United .States should bo permitted to vote at any election” —ami substitutes “all white male inhabitants of the said Terri tory over twenty-one years of age, who are legal voters under tho laws of Kan sas, aud none others shall be permitted to vote.” • It is also provided, by amendment, that the returns of the constitutional election shall be made not to the Governor alone, but to a Hoard of Commissioners, a ma jority of whom can act. Tlie powers ami duties of tho new con vention are thus defined: “When assembled, the convention shall first determine, by a vote, whether it is the wish of (lie proposed Stato to be ad mitted into the Union at that time ; and if so shall proceed to form a constitution, and lake all necessary steps for the es tablishment of a State government iu conformity with the Federal Constitution, subject to the approval aud ratification of the people of the proposed State.
