Louis Re publican, writing from St. Louis, under date of June 28. and after slating that a i constnble named Timmons had been mur dered hy a party of ruffians, says: Citizens collected and arrested Kessler and Milligan. Linn made his escape.— There wuh great excitement. Hundreds of persons gathered nnd a vote was taken whether they should hang thorn on the spot. 1 1 was lost by only three or four majority. It was then resolved that they should be tried in one month, in Gentry county, and if they npplied for a change of venue or a continuance, they- should be summarily executed. Judge Norton wa- sent for and called a court last Thursday, lie ordered the Sheriff to summon twenty-five select and reliable men to guard the prisoners ngninit violence. A grand jury was em pannelled, and a true bill found for mur der iu the first degree. The prisoners wore arraigned on Friday morning, when they jdead ‘not guilty.’ Their counsel requested until one o’clock to determine upon their course. At that hour they asked for a continuance in Kessler’s case, and having shown sufficient cause it was granted. The State then continued the case of Milligan. When the court adjourned, six or seven hundred persons left the court house pre cipitately, when some twenty or thirty who remained rushed upon the prisoner, Kessler, and (ore him from the hands of the Sheriff'. The Sheriff’s posse, with the exception of three oi four, deserted him. Col. John iScott went to his assistance, and had almost secured Kessler from further violence, when the suddenly aug mented inob overpowered him and bore Kessler away amid the screams and en treaties of his wife aud three children.— He was taken to tho edge of a body of woods only one hundred and fifty yards from ihe court house, and in full view of the town, and a rope was placed around his neck. A preacher then exhorted and prayed, and Kessler prayed. A lawyer was sent for to write his will. lie then asked permission to see his wife and children nnd bid them adieu. The hand kerchief which bad been tied over his face, was removed for Hint last, sacred purpose, when he wn told by an old man that he bad given no such opportunity to Timmons. Mr. Albin mi l Mr. Mothershead then made earnest addresses to the crowd in favor of letting the law take its course, when the same old man arose and re marked, “He ihat sheddeth man’s blood by man shall his blood be shed.” He was (lieu placed under the limb over which the rope was thrown, one end of which, lied by a hangman’s knot, had been alt the while around liis neck. The leader gave orders for him to be drawn up.— Three men made a effort but could nut draw him from the ground. The leader j ordered more men to take hold. They did so, nnd with the fii>t draw raised him ! eighteen inches, and with tlie second about three feet, when the rope broke.—- It appeared, upon examination, to have been cut half in two. He was again placed upon ii is feet, (he rope was tied, orders were given to draw, the leader look hold of tlie unfortunate man ami lifted him up several feet, when, in the presence of ten or fifteen hundred people, many of whom were women, Itis soul was launched in o eternity, and his body was left hanging lor an hour. The poor victim exhibited great cour age thougliout. He asked his counsel to apply for a continuance, because he would rathor be hung by the mob than go into a trial unprepared, aud have a verdict recorded against him, which would dis honor his wife and children. Jim Milligan was permitted to live for the present, ns tlie State continued his case. He was suspected of having shot tho Sheriff some time ago, nnd many persons say his execution would have been more excusablo than that of Kessler. Tho hanging of Kessler was a terrible murd.r lie declared to the Inst that he was not guilty. Ho said he had been or dered by the constable pro. tcm. to take that place with his gun, and to stop Tim mons; that he hailed Timmons, when Timmons drew his gun upon him and was about to fire, when he, being ready, shot first; aud that Ihe killing was in execution of duty and in self defence. Kessler had stood high ns a citizen in Gentry; but Timmons was very popular, and Gentry has been considerably in fested with outlaws and murderers, and the people are determined to put a stop to such things in a summary way if possi ble.
