Names of the men Committed—Letter from Smith O'Brien. —Tho Northern Whig, (Bel fast paper) of the 29th ult., says : At our Police Court to-day, (Wcdnosday,) a con versation took place between Mr. John Ken, Solicitor, and Mr. Tracy, R. M., in regard to tho prisoners how in custody, charged with membership in an illegal society. Mr. Ron inquired of tho sitting Magistrate whether it was his intention to bring on tho investigation next Friday, in the county jail, and in private? Mr. Tracy replied that the investigation would be private, and that tho jail was, in his opinion, a proper place for the conduct of the investigation. Mr. Rea protested against tho inquiry taking place in the jail, and applied that it might be held in tlio County Court House. lie was of opinion that tho press ought to havo ad mission, but was willing to concede that point provided tho inquiries wero not held inside a common jail. Suclt a course, ho said, might do in Naples, but was contra ry to tho British Constitution, and pre vailed only where despots ruled. Mr. Tracy said tho jail vas quite suitable.— Mr. Rea then declared that lie would throw up his brief rather than lower his profession, by being compelled to defend his clients in such a place, lie had no doubt Mr. Tracy was acting under in structions. Mr. William Smith O'Brien—a compe tent authority on prison usngcs—thus writes about the “deluded youths” of the Phoenix Club: Although 1 disapprove more thin 1 can express of secret societies, and up to this moment am unacquainted with tlio objects of the Phoenix Club, I cannot but feel much sympathy for the young men who are now under arrest. The mode in which they have been dealt with hitherto reminds mo of the stories which we have heard of Austrian tyranny in tlio writings of Silvio l’ellico and others. Whatever their of fence may be, they ought to be confronted with their accuser—they ought to be in formed of tho charge that is brought against them—they ougiit to be assisted aud protected by tbo presence of their legal advisers. They ought to be treated as innocent until they are proved guilty, and not punished by severe treatment iu anticipation of a conviction which it is possible they may not liavo merited.— These are fundamental requisites of jus tice common to all countries ; but it ap pears, alas ! that they are still violated in Ireland. WILLIAM S. O’BRIEN. Death of the Karl of Oxford. The Earl of Oxford, the head of tho Walpole family, died on Wednesday, the 29th ult., at his seat, in Norfolk. The deceased nobleman, Horatio Walpole, third Earl of Oxford, under tho creation of IHOO, was born on tho 14th June, 1782, so that ho was in his 7Otli year, lie suc ceeded his father os third Earl iuJuue, 1822. lie was High Steward of the bor ough of Linn, a Deputy Lieutenant of Norfolk, and Colonel of the West Norfolk Militia. Ho sat iu the Houso of Commons in 1822 as Lord Walpole.
