—An objection to a claim against an in
solvent estate, denying its justice, or set
ling up the statuto of limitations, must bo
made within twelvo months after tho dc
idaration of insolvency ; and the tirflo can
not bo enlarged by an agreement between
the probate judge and the administrator.

nishee.—After tho rendition of a judgment
discharging tho garnishee on his answer,
if an issue is made up between him and
the plaintiff, at tlwsainc torm, contesting
the answer, and triod without objection,
tho garnishee must be considered as hav
ing waived the judgment di charging him,
and cannot invoke it, in tho uppollatc
court, as precluding tho jilaintilf from
assigning errors upon the rulings of the
court on the trial of tho issue.

When the answer of a garnishee is con
tested by the attaching creditor, although
the onus is on tho plaintiff, the answer it
self is not evidence for the garnishee.

Establish Resulting Trust iu Slaves.
I. When a resulting trust will he raised in
equity. —Whero the surviving brothers
and sisters of a decedent agree that the
money agising from the sale of his lands
may he appropriated to tho use and sup
port of their father and mother, during
ihe rest of their lives; and one of them,
having the money ia Ids possession, in
vests it in the purchase of a slave, taking
the title in his own name, a resulting
trust arises, at the election of tho other
brothers and sisters, in their favor; but,
when they seek to enforce suuh trust,
they must allege that tho slave was pur
chased and paid for with the trust funds.
U. Dismissal of bill without, prejudice. —
When a bill is defective for want of necea
-ary allegations, but tho evidence shows
that the plaintiffs have a good cause of
action, the bill should he dismi- ed with
out prejudice; and ln reversing the chan
cellor’s decree, dismissing tho bill on final
hearing on pleadings and proof, tho ap
pellate court will itself dismiss the bill
wit bout prejudice.

1. Security for costs. —When the defend
int in a judgment at law, being a non
resident, makes application (Code, #2108)
for a rehearing, lie must, givo security for
tho costs, as in case of other suits by non
residents ; and this, notwithstanding lie
has given a supersedeas bond.

widow consents that her dower interest in

hold tho allowance inadequate, when it
appears that the widow is thirty-seven
years of age, however healthy she may be.

The New Orleans l’icayuno of Thurs
day, Hoth instant, say :
Wo had a call yesterday from Mr. l’aul
Emile Desduncs, who arrived here on
Sunday last from Eort-au-Erince, Hayti,
mi the hermaphrodite brig West Indian,
Capt Cook, which left that place on tho
Ist instant.
Mr. Desduncs is a citizen of Eort-au-
Erince, and is here for the second lime
on a mission from the Emperor Soulouquo’s
Government, to induce agriculturists aud
mechanic of our free colored population
io emigrate to Hay ti, under very flatter
ing promises of protection and assistance
itoin the Ilaytien Government, whose
desire it is to place under active and ex
tensive cultivation a largo quantity of
partially abandoned sugar and other es
tates.
Mr. Desduncs was here two months ago
mi the sauio errand, and was sufficiently
successful to induce him to return in
catch of more emigrants, lie will re
turn to llayti, he informs us, iu a fort
.light, and can ho seen in tho meantime
at the office of Messrs. Doudcusquic,
Eliilllps ,v Cos., on Common street.
Mr. Desduncs ha- furnished us villi
much information concerning the rcecut
insurrection in llayti, some notice of
which wo ha t by telegraph, via Boston,
iu last Tuesday's ELcayune.
Tim insurrection broke out on the 2(ith
December at Gonaivcs. a seaport town of
about four thousand inhabitants, sixty
five miles north of Fort nu l’rince. The
loader, General GeH'rad, was at Fort uu
Ermce at the time, occupying the oonti
lential position of tho Emperor Sou
louque’s chief of the military statT. lie
left Fort au Erinco at the first intimation
of the revolt, and, as stated in our tele
graphic dispatch, was proclaimed by the
.n-iiigouts at Gunaives Ercsideut of the
••republic” of llayti. He had under him
at l ist dates the troops of the department
of Artibonite, in which Gonaivcs is situ
ated, and held that town with about 2000
men.
The Emperor left Fort au Erinco on the
morning of the 27i!i, at the head of 0000
en, and on the Rlst. of December had
‘'cached the seaport town of Arcahaye,
me distance north of Fort au Erince,
on his way to attack Getfrad.
Mr. Desduncs says that all was quiet iu
llayti generally at the date of his depar
are. Tho Christmas and New Year fes
tivities were in full tide of enjoyment at
>rt au Erince and tho surrounding coun
try. Quiet reigned there in political af
t i,rs, and trade and commerce were un
interrupted.

For a number of years 1 have been suffering to
such au extent, that J became so much debilita
ted, ud tho digestive powers so much destroyed,
that it was with difficulty T could take and retain
sufficient nourishment to support life. Neither
myself nor my friends wore aware that my suffer
ing proceeded from indigestion; in tho year 1839
my attention was directed by my husband to your

tho city papers, explaining tho causes and symp
toms of dyspepsia, and confidently offering a
remedy I immediately procured and used your
