2d, publishes its annual statement of the
pork packing in the West, showing an
increase in number of 228,000 hogs, but
a decrease in weight of ti,\ per cent., and
a decrease in bird of 7) per cent. The
int increase in the crop, a- compared
with last year, is 70,000 hogs, or 3;j per
cent.

It i- stilted in tho papers that Senator
Toombs intends, in the course of this
week, to bring forward a bankrupt bill,
similar in its details to tho one reported
by tho Judiciary Committee at the last
so- ion, and sustain it by a speech. Al
though there is much pressure of public
bu-iness, some of the prominent friends
at the measure in both houses, if it is
presented, think the bill will pass, pro
vided it is advocated with zeal. It is
claimed that the Senate being opposed to
interfering with the tariff, gives the bill
additional strength.
In Trouble.
It is said the Michigan Legislature lias
“put its foot in it,” by voting fi 10 acres of
land to Mrs. Rogers, because rho pro
'iuccil four little Rogerses at one and the
same birth. It has set a precedent which
may cost tho State thousands of acres of
land. The Detroit Free Press says Mr.
Job lbiriiap, of Sumter, Wayne county,
has applied to the Legislature to divide
its favors, llis papers sot forth that
Mrs. liiirniip “has given birth to nineehil
dren at four births, three of whom were
born ten months after marriage,” that ho
is a poor man, and tlioreforc prays for a
donation of land, as in the case of Mrs.
Rogers.
Tin’ Wanderer’* Africans.
In the course of an article under this
head, the Savannah Republican of Satur
day asks what is to be done with tho two
Africans now lying prisoners in the ('hat
ham county jail; and cays that the act ot
ISI7 authorizes the Governor of tho State
of Georgia, upon information that Afri
cans have been landed within the limits
of the State, “to appoint a commissioner
or commissioners, who shall take them in
possession and convey them to Millodgo
ville, where the Governor, after giving
sisiy days’ notice in a public gazette,
shall proceed to dispose of them at public
outcry to the highest bidder.”
The Republican suggests that this law
be enforced in relation to the two Afri
cans, mid thinks Governor Brown would
meet with no opposition from tho Federal
authorities in enforcing the statute. It
would not only benefit the prisoner#
themselvcH, by providing them with cotn
forlable home and employment with kind
masters, but relieve tho govonrfncnt of a
soi ions burden, and au expense that is
daily augmenting.

The legislature of Missouri has pasred
an act limiting the maximum of tlie State
debt to $50,000,000.

Os the 41,000 bales sold for the week,
1 speculators took 500 and exporters 5,500
bales. There is some little discrepancy
in the reports of the circulars—some state
Uplands hud declined l-llid., others that
Mobile and Uplands had slightly declined,
and again that tho market closed with a
declining tendency. Tho sales on Friday
were 0,000 bales, closing dull. Tho fol

all qualities slightly advanced. Bacon
heavy. Bard dull, at 565. Sugar firm.
Coffee steady. Naval stores firm. Rice
unchanged.
Tho steamship Fulton, with accounts
from tho United States to tho Bth of Jan.,
reached Havre on tlie 21st.
Tho growing confidence in the continu
ance of peace had caused a partial revival
in the Paris Bourse.
Tlie death of the King of Naples had
been reported, but was discredited.
The Austrian loan of six millions .ster-
I'ng had boon announced.
The latest correspondence from the
continent states that confidence in the
continuance of peace is losing ground.
Warlike preparations are continued in
France.
It is reported that au offensive and de
fensive alliance has been concluded be
tween France and Sardinia.
It is said that Great Britain has re
solved to protect her interests in Mexico.
The Swiss National Council has voted
five hundred thousand pounds sterling to
immediately convert all the public guns
into tho permission principle.
Austrian troops are pouring into Lom
bardy, but no outbreaks are announced.
Many steamers for transports are pre
paring for sea, in France.
Overland Mall from California.
St. Louis, Feb. 7. — The overland mail
from California lias arrived, and dates
from San Francisco to the 14th January,
have been received.
The Suprme Court of California has
decided against tho constitutionality of
the acts of tho legislature taxing mining
claims, and prohibiting the immigration
of Chinese laborers.
Latest from lluytf.
Boston, Feb. 7. —Intelligence from
liayti to the 10th Januury has been re
ceived. The revolution has extended to
all parts of the empire, and Soluoquo lias
been defeated on land and at sea. At St.
Marks there had been severe fighting with
considerable loss of life. The imperial
licet had taken refuge at Port au Prince,
but it was thought Souloque’s retreat had
been cut off. llis coffee had all been
■ eized and sold at auction.

Washington, F'eb. 7.—ln the Senate
to-day, tho agricultural college bill was
passed : and District of Columbia affairs
wove discussed.
In the House, tho Senate resolutions
were passed refunding to tho States of
Georgia and Tennessee the amounts ex
pended in the Irulintr wars.
Resignation of Hon. Jiitm Forsyth.
Washington, Feb. 7.—Mr. Forsyth has
resigned his mission in Mexico. It is un
derstood that Gen. Cass has assured him
that the Administration expresses full sat
isfaction at his course in Mexico.
A New National Democratic Paper.
Washington, Feb. 7.—lt is stated that
Messrs. Forsyth and Pryor are about to
take charge of a national Democratic
journal in New York, with a capital of
one hundred thousand dollars.
Lost ami ntiiilili’d Schooners.
Wilmington, Feb. 7.—The bark Exact,
from New York for Savannah, got ashore
at Frying Pan Shoals on Saturday. The
vessel and cargo are totally lost. The
crow wore saved.
The schooner George Harris, from Bal
timore for Charleston, was put in here
dismasted and leaking.
From Africa.
A writer on board tho U. S. Hag ship
Cumberland, in a letter from Porto l’raya
to the Boston Courier, gives an interest
ing description of Uengucla and the eouti
try adjacent. Deng lola is tho capital of
tlie Portuguese province of tho same
name, and contains about 2,000 inhabit
ants, of whom about 100 are whites, or
of mixed blood, and tlie rest pure blacks.
Tho country abounds ; n game, and tho
river swarms with crocodiles and hippo
jiutouii, wHilo twenty miles in the interior,
lions, tigers and elephants arc to be found.
During the stay of the Cumberland at
Bcngucla, a party of natives from the in
terior arrived, laden with elephants’ tusks
and gum copal. They arc described as
being tall and erect, and some of them
good looking and of graceful carriage ;
lmt they were all miserably dirty aud
emaciated, and nearly—some of them
quite—without elothiug. They exchange
their ivory und gum with the Portuguese
for coarse cotton cloth, some old con
demned government muskets, powder,
and a few bottles of rum—the Portuguese
getting the best of tlie bargain; and they
were again lleeccd by the women of near
ly all they obtained, save the rum, which
they took good care to drink at once*.
The writer describes a native village
which he visited, where there was such
dancing, jumping and shouting among
the natives, in honor of the Americans,
that they seemed to be so many happy
maniacs.
The Cumberland remained two days at
the 1 mouth of tlie Congo river, sending a
boat up the river to look for slavers, but
finding nouc. Several American slavers
had lately made their escape with full
cargoes of slaves—among them the brig
Charlotte with S(H), tho Ellen with 300,
and tho yacht Wanderer, (’apt. Corrie,
with 350; but unluckily they wero just
too late.

from tho same quarter, one of which was
dated 10th July, 1834, and recorded sth
May, 1830—tho other dated 3d April,
1834, and recorded in the yenr 184.).
Held: that tho older deed takes prece
dence, notwithstanding the younger was
first recorded.
James Gorham, vs. Rabun G. Hood, i
et aL —Trespass, in error from Harris.
Judgment below affirmed on the first
ground, and reversed on the second.
1. A constable may, on tbe trial of a
ease of trespass ri cl armis against him,
for the seizure of property, make a nunc
pro tunc entry on the fi. fas. showing that
such seizure was made as a levy.
2. Trespass vi ct armis is the proper
remedy against a constable for a levy on
negroes, where there is sufficient personal
property other than tho negroes to satis
fy tho fi. fas. in his hands—the constable
in such case not being authorized to levy
on negroes.
Asa Marshall, vs. Thos. J. Draw
horn — Bill, ike. In error from Taylor.
Judgment below reversed.
Marshall sued Drawhorn at law on a
contract of general warranty, in tlie sale
of a slave. Drawhorn filed a bill against
Marshall, asking an injunction of the
suit, and praying a reformation of the
bill of sale, in which the warranty was
included. The bill alleged that the con
tract, as really made, excepted from the
general warranty of soundness tho stiff
neck of the slave and the effects of the whip
ping that had just been inflicted upon him.
.Marshall demurred to the bill in tho Court
below, and tho Court overruled the de
murrer. Held: that the demurrer ought
to have been sustained ; the seller not be
ing liable, on the warranty for these de
fects; they being patent defects, and hav
ing been shown to the purchaser before
the sale.

This case was withdrawn by Plaintiff’

Tlie decision of the Court, below refus
ing to set aside the verdict, and grant a
new trial in the above cause, was affirmed;
the Supreme Court holding (as the Court
below did) that the evidence justified tho
finding.
Sterling J. McCrouy, vs. Samuel
Casky —Debt. In error from Schley.
On the 20th day of December, 1853,
suit w r as brought on a promissory note,
bearing date “Dec mber Ist, 1852,” and
due “the 25th of December next.” Held,
that on the trial of such a case, and to
prevent the dismissal of the suit, plaintiff
may prove that tho note was so written
by mistake, and was intended to be made
due, the 25th of December, 1852.

Caveat to Will. In error from Schley.
Judgment below affirmed.
Wm. Wimbish died in the county of
Sumter. Elizabeth Wimbish propounded
for probate, in the Court of Ordinary of
said county, the Will of decedent, and an
appeal was taken to the Superior Court.
Pending said appeal, the county of Schley
was formed, and the residence of testator
(while in life) was cut off from Sumter
into Schley. Held: That the transfer of
the record from Sumter to Schley was
proper, and that the Superior Court of
Schley county had jurisdiction oi’ the
cause.
Henry J. Lamar, vs. Tiios. P. Cottle,
et at. —Assumpsit. In error from Schley.
This case was transferred from Sumter.
Lamar brought suit in the Superior
Court of Sumter county, vs. Cottle, of
the county of Sumter, as principal on a
promissory note, and Burnam of the coun
ty of Houston, as endorser. Cottle lived,
at the time of suit, in Sumter. The Sher
iff of Sumter made a return of non cst
inventus, as to Cottle. Burnam was prop
erly served with a copy of the second
original declaration. At the trial term of
the cause, Lamar obtained an order that
service bo perfectc 1 on Cottle by the next
term of the Court, which order was pur
sued. Both defendants appeared and
pleaded to the merits. Held, that the
Court below erred, iu dismissing tho suit
at the hearing on appeal, the original de
fect in the service having been cured.
