The State vs. Leah AT Gor alias Ogletree.
The defendant, Leah M’Gar, was in
dicted for bigamy. On the trial, the pio-
secutor was unable to prove a marriage in
that his cause w-as put off till another term ;
that money was wanted, to retain ; and
that all the world was of opinion that the
very next hearing, would bring bin) off
victorious. If so, then, cries my friend,
I believe it v ill be my wisest way t<> con
tinue the cause for another term, and in
the mean time, my friend here and f, will
go and sep Bedlam.

evidence was objected to bv I lournoy and
Reid, of counsel for the defendant, on the
ground that Bigamy and Crim. Con. are
exceptions to the general rule of evidence,
and that in such cases u<> other evidence
is admissible, except proof >>f actual mar
riage.—They cited 7 John. Rep. 314,and
other authorities.
For the prosecution, the Attorney Ge
neral cited and relied on the case of Tru
man, 1 East’s Plea Crown 470.
By tue Court.—Upon principle, I
can see no reason why this case shodd be
excepted from the general rule of evi
dence, although it may often be entitled
to very little weight with a jury; because,
such acknowledgements may be made
without consideration of the consequences,
and palpably for other purposes, at the
time ; as for instance, to induce the pub
lic to believe that ihe party is not living
in a state of fornication, &c. &c., yet such
acknowledgements ought to be evidence
?o go to the jury, where it should have
such weight as it is entilled to, according
to the circumstances under which the ac
knowledgements were made. But when
such men as Mansfield and Kent, have
laid down the rule and adhered to it, I am
not willing to differ from them arid d ; sre-
.vard the law which has so long prevailed,
and against which not a single decided
-ase can be produced. Freeman’s case,
in 1 East’s P. C. 470 is not like lit is, be
cause the evidence there received, was
not the bare acknowledgement of the pris
oner, but a confession in writing before a
Court, both by the prisoner and his firs;
wife, of the fact of marriage, together
with the sentence of the Court. And in
Morris v. Miller, 4 Burr. 2059, is was said
by the Court that in Bigamy and Crim.
Con., there must be a marriage in fact
proved.*

GOING TO LAW.
In the. Citizen of the World, there is a
description of the courts of justice in the
Westminster Hall, 50 years ago ; which
being applicable to the present state of
court proceeding here, I lake this liberty
of extracting some ol the observations,
and of altering others, to suit the times,
which I beg you to publish.
I had some intentions lately, of visiting
Bedlam, the place where those who go
mad, are confined. I called upon a friend
to accompanv mebuttound him prepared
to go to court, to attend a lain suit, which
he informed me had been depending for
several yeats.
How is it possible, said I, fora man
who knows the world to go to law, except
on emergencies: Many ot our courts of
justice are not only lotteries, butraf traps
. easy to get in but difficult and hazard
ous to get out again. I should not have
gone to law, said my friend, but that I
was assured of success before I began. I
have been on the eave ot an imaginary
triumph, everv term these ten yeats, & at
the present one,l expect to lay my antago
nist on his back. My lawyer encourages
me in the belief, and I am determined to
persevere. But, remember said I, more
