eventually bo redeemed at pir value. There is a provision of the charier, how ever, which subjects the persons and pro perty of the original stockholders, and those holding stock by transfer,, to the payment of its bills, in proportion to the amount of stock owned, by which some of the holders of the bills have been ena bled to obtain not only the amount of the b its, but the cost ofsjit and interest upon these bills as the testimony ofMr Whee b>r shows.—The spirit of favoritism which seems to have influenced the < per’ aliens of this bank, while in character, appears not to have forsaken it now in disrepute. For while creditors at home have sacrificed their claims at various los ses from twelve and a half to sixty six percent, discount a debt of sl6, or 18, 000 has been paid, dollar for dollar, 'o the firm of Ogden, Ferguson, & Co. of New York. It is difficult to recognize the propriety of injury being sustained by the citizens of our State, while those of other States are held harmless from loss. And it would be unjust to suggest that any fur ther or greater sacrifice should be submit ted to by tho c who have as yet alone submitted to it. One fact more and your committea will conclude; oppression to this bank, has been resorted to, for the purpose of diverting public consul e from the authors of this wanton injury, upon the rights and pro perty of the people of Georgia. To the unjus’ifiable imprudence of the Bank, can alone be attribired their mis fortune, and our injury. This institution was not compelled to Saspond its operations, because the funds which it had reported but a lew days be fore to the Executive Department, as sol vent were not available, to relieve its pressures—but because, those .funds thus reported were not solvent. The bank had sought a lean from (ho several banks of he City of Augusta, of slqo, ooo, tu sustain itself. An assurance was given it by the president < f the Branch Slate Bank, that if it would permit two disin terested and competent poisons io exam ine i s condition and they should rbport it solvent, the !<>an would be immediately grained. The bank with a distaste then, as now fur investigation, declined the proposition—hence its utter insolveucy, mid not oppression on the part of others caused its failure. From an impartial re view of the facts, your committee tlSsert without hesitation, that the conduct of the hank hasjustly forfeited not only the con fidence of the Legislature, but of the whole community. They therefore re com trend the adoption of the follow ng Resolution— Tin l the Attorney Gen firal be instructed to instirutpj 'dicial pro ceedings against the J/erchants’un<l Plan ners’ Bank, for the purpose of procuring a forfeiture of said charter, and that a copy of ibis report together with the evi dence be furnished him. The committee also recommend the fid .priori <>f the following resolution , Resolved by the S note and House of Representatives of the State of Giorgio, Tjta' n« bills of the Merchants’ and Plan Bank of Augus’a, shall at any time be received into the Treasury of the State, (except from public officers liuthorizfd by resolu'io/'.s of this Legisla tive to.deposite them.) or in payment < f anv debt due to the Slate, or to any agent of die same, as such—and thqt no agent or officer <<f the State, be allotted to make any depo&ite in die said Bank, but at his individual jri k adventure. FIRE I About 2 o'clock this morning, our city was aroused by the cry of Fire. The Farmer's Ho tel, kept by J. J. B/rd, E-q was found to be on fire, and the flames had progressed so far, that many of the boarders escaped with only their under clothes. It commenced in the cel lar probably in the Shoe Black’s apartment. The building belonging to Mrs. Jones, of Phi ladelphia, was insured in the Charleston Office, Mr. By id, whose Furniture, &c. was burnt and injured, we believe, had no insurance. The Farmer's Hotel was the front building of the Fire-Proof Ware House of Messrs. Mason & Randle, not a bag of whose cotton received the slightest injury; None of it was moved, ex cept 8 or 10 bales mar a side door, thro’ which the flames appeared. Th re were about 6000 bales in the House. Thfe Hotel Consisted of three Tenements—the upper one in which the fire originated, was all consumed, from the roof to the cellar—the root only of the second tenement was entirely destroy, d to the first fl tor, which was saved, and the third fene. meat but comparatively little injured. This, we believe, was the first time a fl >or has been saved in this city, when all above it Iris been consum ed, and was owing to the powerful operation of the Fire Engines which were fully sup-died with water from the opposite Hydrant. Indeed, but for windows, which were strangely put tn the parapetted gables, the fire would have been ar rested in th- first tenement, and the window was discovered too late in the second to arrest sud denly the consequences, which were the result of its existence. This discovery saved the third.— We are requested by several gentlemen uncon nected with the Fire Companies, tp bear public testimony to their«activity and efficiency, on this occasion. The big Engine, No. 1, of the Independent Fire Company, powerfully manned as she was, and judiciously directed, was a IFatrr-S/ioirt. io reality. The present occasion reminded ns of an April day—if there were showers, the sun shout too— if there were tears, they were not unadorned with smiles. Several incidents could not have been witnessed wit out smiling even in the glare of the dreadful clement. A gentleman who had exposed hiirtself very much on (he parapet wall throwing w Ater on the roof, when he saw all was safe, descended, and very coolly began whistling up a, favorite dog, which had followed bis master to the file. A Musician, in the house, who lost every thing, lamented only his Tuning Fork pnd a Cost ,\n buyer considered he hid lost his all i:i the destruction of his Gimbld. His t'tmkof clothes, &c. which he hid lost, it was observed, were more valuable. "Ah !” said he, •* the gimblet m ide them all.” M ssr< Lockhart Si Na-ulee were true to their promise about Fat Meats. On Saturday morning, titfer Stall in the Market was tastefully ornamented. The heads of the slnughtered bul locks were placed over theif behfeh, their horns adorned with ribbons of various, colors, and ar tificial flowers The stall was covered with a per fectly white sheet of cloth, and two archss sprung froin the centre,w ith appropriate hoi ks.on which were distributed the dissected poitions of the beef, with pigs, mutton, fcc. The b’feef was very fine, raised by Col. Fitesintons; and the promis ed Hoo was a wonder It was of the Guinea bre.qd—very fat—l 3 months old, and weighed 325 lbs. Its head, weighing H>s., was sole for $4 00. It was faised in this city, by Mr. Bouyssou. One of the Muttons weighed 154 lbs —a hindquarter, which was sold for $8 62<J, was carried to Savannah. The heaviest t>ul lock weighed 972 lbs. The big mutton was from Noith Carolina. We wish we cottlj more fre quently see such sights in our market. Duel.—We understand that a duel « as fought on the morning of the 26th ult. at Coosawatchie, between Col. Benjamin Allston and Col Isaag W. Hatne, The parties engaged t > fire, we are informed, nt five pa<~es. Col. Al ston was shot in both thighs, we understand, dangerous ly. Col. Hayne received the ball of his antago nist in the fleshy part of one of his thighs, which wound, we are told, it is not thought will be at tended with any serious inconvenience.— South ern Patriot. Loss by fire of the Steam Boat Water Nymph, from Macon for Savannah.— We learn by tbe pilot of this boat [a colored man J that said boat left Darien for Savannah on Sunday last about 9 o’clock, with about 500 bales cotton on board 1 hat on the night of that day, immediately af ter cr ssing St. Catharine’s Sound, the boat was discovered to be on fire on the boiler deck and in less than ten minutes after she was in a blaze. She was run ashore on Milligan’s Island. All the cotton was burnt with the exception of aoout 209 bales thrown overboard, 150 of which were carried to sea, 48 passed down tne Sound, and 2 picked up by Capt. Deverger We regret to state, that a negro woman and h-r grand child, owned by Messrs. Low, Taylor Sy Co. of this city, have been burnt to death. They were in the Cook’s Office, and had n« op . portuaity toescape. The captain* crew aadthe other pussOi gers, fwith tfae cxctJpjldn of the engineer and pilot.) 30 in all, went on board the sloop Jackson, Capt. Dcvdiger, from Sunbury bound to this port, but not y-1 arrived. We leatn that (her? w*s no insurance on the boat which was totally consumed Most of the cotton, principally consigned to Messrs. J. Stone 6z Co. was insured. The engineer, Mr. Holland, who has since reached this city, confirms the above, and states that the survivors had barely time to escape Gapt.
