payment of a certain promissory note, drawn by
the said Willtnim I. Sims on the said third day of
June, the said year, in favour of James Robert*,
or order, for the sum of six hundred and thirty
eight dollars, und eight cents, payable on the first
day of January in the year eighteen hund e I and

date ; and unless the same be so paid, the equity
of redemption of them the said Magaret Sims,

U PON petition of the President, Directors and
Company, of the Bank of the United States,
praying the foreclosure of the Eqoi'yof redemp
tion or ail that lot of land and buildings known by
the number eight Wilmington tything Darby ward
in the City of Savannah and state of Georgia, con-
tabling sixty feet in front and ninety feet tn depth,
mortgaged by Matthew McAllister now deceased,
in his lifetime by deed of mortgage, dated on the
tenth day of March in the year eighteen hundred
and twenty three, to MaUnew Hall McAllister his
heirs and assigns to secure to the said Matthew
Hall McAllister, the payment of certain promisso
ry notes made by the said Matthew McAllister to
the said Matthew Hall McAllister or order, for
the sum of five thousand dollars, which said note
bears even date with the said mortgage and is pay
able at a day now past, and which said mortgage
and note were afterwards duly assigned, and in
dorsed by the said Matthew Hall McAllister to
the said petitioners. And the petitioners having
further staled that there is now due and owing
on the said note and mortgage the principal sum
of five thousand dollars with interest from the 30th
day of May 1823.
On motion of Habersham for the petitioners, it
is ordered that the principal, interests and costs
due upon the said mortgaged premises be paid
into court within twelve months from this date,
or on failure so to do, the Equity of redemption
in the said mortgaged premises shall from t (tense
forth be foreclosed ana such further and other
proceedings take place as are in pursuance of the
statute in such case made and provided. And it
is further ordained that this wifi be published in
one of the public Gazettes of this state at least
once a month for twelve months or a copy thereof
served upon the legal representatives or the said
Matthew McAllister, at least six months previous
to the time at which the said money is ordered to
be paid into court.

& Smets; he wane away a short Green Jacket and.
also carried with him a frock Coat, about, halt

O N tlie petition of Aaron Cleveland and Susan
(J, his wife, who was Susan C. Bona, stating
that Jacob Falitn, before the intermarriage of the
petitioners, to wit; on the 22<1 day pf June 1831,
did in conjunction with one Joseph A. Scott, 64*
ecute a joint bond to the s.iid Susan C. in the
penal sum offour thousand dollars conditioned
for the payment of two thousand dollars with in
terest from date, un or before the first day of
March then next, and that for-the better securing
the payment thereof, the said Jscob did oq the
day and year first aforesaid make his certain in
denture of mortgage, whereby he mortgaged to
said Susan C all that lot of ground known and
designated tut Garden lot number thirty nine, No
39, and nlso, that adjoining half part of another
lot known ns lot number forty two, No 43, con
taining together eight and a half acres more or
less situated to the East of the city of Savannah
and hou tided to the north west or Lot No 26, to
the South nnd East by lands belonging to the es
ta*e of Hampton Ltllibridgc, and the west by
the public road leading to Sltidaway island where
on a brick yard is now established and known by
the name of Fahma brick yard—that there ia now
on the said bond or mortgage obligatory the sum
of eighteen hundred dollars with interest from the
23d uay of January, 1823, and praying the fore
closure of the equity of redemption of the said
Jacob and hia heirs, executors, administrators and
assigns in & to the saidmortgaged premises.—On
motion of W. W. Gordon, attorney for the peti-
tioners— it is’ordered that the principal and in
terest due on the said bond or writing obligatory
together with the cost of this application Ije paid
into this court withintwelve months from this date,
or in case of default that the equity ol redemp
tion of said Jacob Fahm, his heirs executors, ad
ministratora, and assigns be from thenceforth for
ever forcloscd and that such further and other
proceedings be had thereon, aa are pursuant to
the statue in such case made and provided —
