The object of this publication, according to the Harold of yesterday, ia firstly to show (hat the nobleman in question has the full right todisposo of tha fisheriea to whomsoever he may think fit, and secondly to back up the purchase said to have been mode by a newly formed company here, of the rights and privi leges thus claimed to have been conferred on the Earl in regard to tha Fisheries. Among the Directors of this Company and tho parties principally concerned in the purchase referred to, we find the names of many eminent states men of our country, who appear to regard this matter in a very strange and unrepublican light. The moral inveltiture ol one individual with absolute jurisdiction over an immense territory, and which would confer on hitn the power of disposing of public property in conformity “ilh his will and pleasure, is certainly a novel ittd In the Laf _ int of force to perfogm Iture. This official gets a dollar from the corporation for eacn body buried, and if from a niggard motive he failed to have the graves dug, to meet the require meets of the timer, he deserves the most un reserved'censure of the community. The burials have heretofore been made this Cemetery in such * careless manner of tbe aul, tfn- feature in these States, and one which we be lieve will scarcely hold water among tho great body of our people. The pamphlet claims for the present Lori 0f Stirling, a descent from a Sir William Alexander, of Menatrie," who is aguin reported to be descended from Burner- led, “King of the Isles," which may sound, very famously, hut, in truth, does not hear on the question. The rights claimed are said to have been granted by James VI., ol Scotland, aud 1. of England, ami the various privileges of the Stirling family uro ull duly sot forth, canvassed, and assertnd. Now, for the present, to let alone the fact that Englund. alter exercising the full rights of entire sovereignty over the North American Colonies since thoir establishment or conquest, is not likely now to relinquish them in defer ence to tho cloi. of an individual, let us glance at two important facts bearing on tho point at issue, iu connection with the attempt of the new company to purchase the Fisheries from Lord Stirling. In the first place, n special sovereignty held •y any individual subject of the British Crowu, iways bears a special obligation or subjec tion to the Throne, because il this provision were not made and acknowledged, the feudal sovereign iu possession might at will, not only cede the island out of the possession of tl. Lord Sterling is now in Washington. Commenting upon this novel claim, tha Washington Union soys: There are two circumstances connected with Lord Stirling's claim to the fisheries which are calculated, at first blush, to weaken its claim to a favorable consideration—its nn may easily ho proved L*y a supposititious case.' If for example, the Derby iVniiy or the Argyle family, hereditary sovereigns of tho Isles of Man and Hkye, respectively, had, at any period of tho various wars between England and France, chosen to dispose of those places to the latter power, the consequences to Britain must have been most disastrous, and this con sideration has doubtless been one of the causes which have led to the positive maintenance throughout all time, of tho rights of the Crown over all feudal grants. If Lord Stirling can grants B code tho fisheries to a foreign nation, lie can cede the whole colonies of Nova Scotia and Canada, of which ho is said to bo “hereditary Lord," and thin notion is too absurd to admit of consideration. Another and a more important point is, what the Colonials themselves would be likely to say to the pretensions of F-erl Stirling. They would probably reel inclined to put him in practical occupation of the fisheries ho claims, as the game keepers did in the case of young Easy, namely, by throwing him in. Can any sane man suppose, putting aside for the mo ment any consideration of the British Govern ment, that the Colonists would parmit posses sion to bo taken of their property under a sale bv Lord Stirling, even though the Hon. Mr. Walker, Mr. Hays, and Mr. Lawrence be the brokers of the transaction.
