If in affording a shield to the debtor, a-

they ought never to have existed, the
interference, however doubilul in point
of poliev or principle, may, eventually,
he productive of more good than evil.”
“ The general system oferedit, which
has heen introduced through the agency
of banks, brought home to every men's
door, has produced a factitious state at
things, extremely adverse to the sober,
frugal, &i industrious habits whsoli ought
to lie cherished in a republic. In the
place of those virtufs, extravagance, idle
ness, and the spirit of gambling adventure
bare been engendered and fostered by
our institutions. So far as these evil*
have been product by the establish
ment of banks, where they are not re
quired; by the omission to impose upon
ihem wholesome restraints ; and by the
ignorance or misconduct of those who
have been entrusted withtheir direction,
thev are believed to be beyond the con
trol of the Federal government. Since
the resumption of specie payments, meu-<
snres have been adopted in some of the
states to enforce their continuance ; in
others, the evil has been left to the cor
rection of puplic opinion. 'There is.
however, some reason to apprehend,
that the authority of law may be interpos
ed in support of the circulation of notes,
not convertible into specie.
“ But the federal government has.'by
its measurcs T ,in some degree, contribu
ted to the spirit of speculation aod of ad
venturous enterprise, which, at this mo
ment, so strongly characterise the citi
zens of this,republic. The system of
credit, which, in the infancy of our com
merce, was indispensable to its prosperi
ty. if not to its existence, has been ex
tended at a period when the dictates of
ssund discretion seemed to require that
it should be shortened. The credit giv
en upon the sale of the national domain
has diffused this spirit of speculation and
of inordinate enterprise among the great
mass of our citizens. The public lands
are purchased, and splendid towns erect-
el upon them, with bank credits.—
Every thing is artificial. The rich inha
bitant of the commercial cities, and the
tenant of the forests, differ only, in the
object of their pursuit. Whether com
merce, splendid mansions, or public lands
be the object of desire, the means by
w hich the gratification is to be secured,
are bank credit*.
This state of things is no less un
friendly to the duration cf our republi
can institutions, than it is adverse to the
developement of onr national energies,
wlien great emergencies shall arise ; for,
upon such occasions, the attention of the
citizen will he directed to the preserva
tionofhis property from the grasp of
bis creditors, instead of being devoted to ;
the defence of his country. .Instead of
one to ten cent*, would be much more
suitable lor that object. This kind of
coinage has been adopted in other coun
tries, with great advantage.
“ It lias, however, been objected to
this coinage—
“1. That, as compounded mclals nre
much harder than the component ingre
dients, it would be dillicuU, and conse
quently expensive, to work.
•** 2. That the. coin itself would he of
little or no intrinsic value : copper or
brass being of superior value in the ma
nufactures to which it might be applied.
Audihal the public would scarcely sub
mit to the circulation of a coin so worth
less.
“ 3. Thnt'it might be counterfeitmlby
n composition of zinc and copper.
“ After giving to these objections their
due weight, it is believed, that a change
of this nature, in the copper coinage,
would be beneficial. Although the ex.
pense of such a coinage s!- ould he twice
ns much ns that of nu equal number of
silver coin, still it might be advantage
ous. Small change, both of silver ami
copper. may he abundant in Philadelphia
the sent of the mint; hut it is not gene'
rally so elsewhere. If it were, tickets
of 6 1-4. 10, 12 1-2, 25, and 60 cents,
issued by may.>1? and corporation offi
cers, and dollar hills torn in two pieces,
fertile purposes of change, would not be
employed for that purpose. This single
fact is an answer to the second objection.
The fractional parts of a dollar are so in
dispensable in the transactions of,indivi
duals, that any thing which assumes that
character will he employed. If the tick
ets, which, at this moment, form so great
a portion of the change of this city, anil
of various other places,are employed for
that purpose, it is inconceivable that the
community should refuse to permit a
compound coin, of silver and copper to
circulate, containing the iatrinsic value
which.it represent*, merely because, for
manufactures, it will not be worth more
than brass or copper, and that the ex
pense of refining will be equal to the va
lue of the silver. Change, that is, the
fractional parts of a dollar, is so indispen
sable 1o the community, that its inappli
cability to manufactures, «nd its-exemp
tion from liability to exportation, instead
of forming objections, are recommenda
tions in its favor.
“ The objection that this coin may br
easily counterfeited, is, if it cannot he
obviated, entitled to great consideration.
As has been before stated, this compound
coinage has been successfully practised
in other states. If compound metals are
much harder than their component in
gredients, may not a sufficient security
against counterfeiting be derived from
that circumstance ? The dimensions and
power of the machinery., which constitute
one of the objections'to-the coinage, wilf
render it extremely difficult to secure
that secrecy and concealment, which are
indispensable to the success of the coun
terfeiter. If this compound coinage
should not be carried higher than ten
cent, or distne, pieces, the inducement
compared with the danger of detection
resulting from the magnitude of the ma
chinery. would not, it is believed, be suf
ficient to encourage counterfeiting. If,
however, it should he deemed itnprnefi
cable to guard against this evil, in a coi
nage composed ef silver and copper, an
attempt might .be made to obtain a sup
ply of small change, hy a mixture of sil
ver and zinc. The danger of coueter-
feiting would then he removed.”

pel the King of .Spain to siga the act of
ratification, nnd therefore cannot make
the instrument a perfect treaty. But
they can, and are justifiable in so doing,
take that which the treaty, if perfect,
would have bound Spain to deliver up to
them; and they are further entitled to
indemnity for nil the expenses and dama
ges which they may sustain by conse
quence of the refusal of Spain to ratify.
The refusal to ratify gives them the same
right to do justice to themselves as the
refusal to fulfil would have given them,
if Spain had ratified, and then ordered the
governor of Florida not to deliver over
the province.
L*y considering the Treaty as the term
beyond which the United States will not
look back.-in -their controversial relati
ons with Spain, they .not only will mani
festo continued .respect for the sanctity 1
of..their own engagements, but they avoid
the inconvenience of re-entering upon a
field of mutual complaint and criminati
on, so extensive thatit would be scarcely
possible to decide where or when nego-
eiution should cease, «vr at what point
force should be stayed Tor satisfied right;
and. by resorting to force only -so far as
the Treaty hafl acknowledged their right,
they offer an inducement to Spain to
complete the transaction on her part,
without proceeding to general hostility.
But Spain must he responsible to the U.
Stutes'fnr every wrong done by her, af
ter the signature of the Treaty bv her,
Minister ; and the ref'isal to ratify bis
act is the first wrong for which they are
entitled to redress

cular information possessed hy the Exe
cutive with regard to the subjects men
tioned in your third enquiry. In the
month of September, a corps of 3000
men arrived at the Havana, from Spain,
one third of whom are said to have alrea
dy fallen victims to the disease of the cli
mate. By advices from the Havana, as
recent as the 3th of this month, we are
assured that no part of this force is inten
ded to be «ti any event employed in Flo
rida.

tained in your letter of the 12th instant,
1 have the honor to state, for the infor
mation of the committee,
1st. That information has been receiv
ed by the Government • of the U. States,
though not through a direct channel, nor
inauthentic form, that another motive
besides those alledgedin the letter of the
Duke of San Fernando to Mr. Forsyth,
did operate upon the Spanish cabinet, to
induce the withholding of the ratification
of the treaty, namely, the apprehension
that the ratification would he immediate
ly followed by the recognition by the U
States of the independence of one-or
more of the South American provinces

Paris, Feb. 8.
The last courier left Madrid on the 30th
ult. Advices from Cadiz were to the 26th,
w lieu it still held out. An insurrection was
attempted on the night of the 21th, hy the
inhabitants,who wished to open the gates to
the insurgents,hut were prevented hy tin-
troops.
Letters from Madrid of the Sfith state
that general Elio remained there. (It had
been said that he -was to supersede General
Freyre, at SeviHe, whose fidelity had heen
suspected.) CM."LopesBagnos, an officer ol
great merit, has gone over to the insurgents.
The couriers hourly arriving from Andalusia,
firing no favorable news.
Madrid. Jan. 29.
The minister of justice has advised a con
vocation of the Cortes, such as it was in
1814, but the minister of foreign affairs has
thought it better to wait till tranquility is
restored. Two thousand men, unde.r the
command of General Jos. O’Dounel, with
which he was marching to join General
Freyre, have deserted him and gone over to
the insurgents. General Cruz Murgo, w't
commanded a division of troops, having sus
picion of their fidelity, has dismissed them

SiAce that period, it is believed, the
number ofbanks in the United Suites has
h(*en more than doubled. They have
keen established in the little-inland towns
and villages, and have brought distress
and ruin upon the inhabitants. When
the cause and the extent of the evil is
known, no doubt is entertained that the
appropriate remedies will be applied by
those, who, in our complex form of go
vernment, are invested with the neces
sary authority.
“ If, by any constitutional exercise of
the power of Congress, banks can be re
strained, 1st. From issuing notes of small
denominations : and 2d. From excessive
issues when their uotes are not returned"

currency to an extent to derange the in
terests of society, may he prevented.—,
But it the imposition of these restraints
are not withiu the constitutional power
of Congress, the evils which have been
suffered for the want of those restraints,
must continue, until the present system
of banking shall be abandoned.

have the honor to state, that the Presi
dent considers the Treaty of the 22<i of
February last as obligatory upon the ho
nor ami good faith of Spain, not as a per
fect treaty, ^(ratification being an cssen-
tialiorfinality to that*) but as n compact
which Spain was bound to ratify—as an
adjustment of the diflerences between
the tw« nations, which the King of Spain
by his full power to his Minister, had so
lemnly promised to approve, ratify and
fulfil. Tliis adjustment is assumed as
the measure of what the United States
had a right to obtain from Spain, from
the signature of the Treaty. The prin
ciple cnav he illustrated bv reference to
rub's of jnunicipal law relative to trans
actions 'between individuals. The dif
ference’between the treuty unratified St
ratified, may be fijionedtothe difference
between a covenant to convey lands and
the deed of conveyance itself. Upon a
breach of the oovenant to convey, courts'
of equity decree that the party who has
broken his covenant shall convey, and,
further, shall make good to the other
party all damages which he has sustaiu
ed hy the breach of contract.
As there is no court of chancery be
tween nations, their differences can be
settled only by agreement, or by force,
't he resort to force is justifiable only
w hen justice cannot he obtained by ne-
gociation. And the resort to force is li
mited to the attainment of justice. The
wrong received marks the boundaries of
the right to be obtained.
The King of Spain wns bound to rati
fy the treaty, bound by the principles of

some pledge may be required of the ef
fectual execution against these practices,
of laws, which appear to exist in theSta-

It may be proper to remark that, du
ring the negociation of the Florida trea
ty, repeated-fa very earnest efforts were
made, both by Mr. Pizarro, at Madrid,
mid by Mr. Onis here, to obtain from the
Government of the United States either
a positive stipulation or a ta-'it promise,
that the United States would not recog
nize any of the South American revolu
tionary governments, and that the Jjpan-
ish negociator* were distinctly and ex
plicitly informed that this government
would not assent to any such engagement,
either ex press or implied.
2. By all the information which has
been obtained of the prospective views
of the French and Russian governments,
in relation to the course which it was bv-
them thought probable would bn pursued,
hy the United Stab's, .it is apparent that
they strongly apprt>hended the immedi
ate forcible occupation of Florida by the
United States, on the non-ratification hy
Spain of the treaty, within the stipulated
time, Franee S: Russia both have most
earnestly dissuaded ns from that course,
not by any regular official communication,
but by informal friendly advice ; depre
rating immediate hostility, on account of
its tendency to kindle a general war,
which they 'fear would be the conse
quence of a war between the U. States
and Spain. It was nlledged tint, in the
present -state of onr controversy with
Spain, the opinion of ill Fiiiropc on the
point at issue was in our favor k against
her. That by exercising patience a lit
tle longer, by waiting at least to hear the
Minister, who was announced as coming
to give and receive explanations, we
could not fail of obtaining ultimately
without resort to force, the right to
which it was admitted we were entitled
But that precipitate measures of violence
might not only provoke Spain to war,
but would change the state of the ques
lion between us ; would exhibit us to the
world as the Aggressors, and would indis
pose against us those now the most decid
ed in our favor.
It is not expected that in the event of
a war with Spain any European power
will openlv take a part in it against the
, United States ; but there ia so doubt that
of finance, and one of the favorites of th
Kioe, have been arrested, and conducted to
the inquisition.

Assassination of the Duke de Berri.

•The inhabitants of (his metropolis have
been horror-struck hy an atrocious assassi
nation, perpetrated last night, at 10 o’clock,
on tiie person of his royal highness tile Duke
Berri. The Prince intended the Duchess
ner carriage in quitting the Opera house;
she was already seated,when a person pas
sing quickly by his royal highness, encircled
him with his left arm. and thrust a poiuard,
four inches & a halfllwng, in his right breast,
up to the hilt. On ferifing the wound lie ut-
tcpol n cry and fell senseless into the arms
of bis servant. The 'Duchess herself sprang
o’.rt of the carriage, and drew the dagger
from the Duke's breast, whose only excla
mation was, “je me mtum. n The Duke,
was conveyed into,one of the. saloons nf the
Opera, and the nearest surgeon sent for.—
The Duchess never quitted theeourih of her
husband. The Duke of Orleans who was
it tiie Opera, arrived immediately, accom
panied hy the Duchess and MndemoiseVle
M. Pasqiuer name shortly afterwards, bring
ing with him, in his carriage, M. Dupuytrcm.
The surgeon Idl'd the Prince thru- times,
nd washed ihe wound with vvrum lotions.
The internal haemorrhage making an alarm
ing progress, cupping was applied, which
made his royal highness suffer so much,
that lie exclaimed, Duuvytren, Lparg-

pas qw edit serve a rirr>.”
M. de Cazes was seated in one corner of
the chamber, in indescribable grief. The
assassin was interrogated, in the presence of
M. tie Cazes, and declared holdly that he
had meditated the murder ever sinee 1811,
and Mint lie had quitted Meta for Calais in
the intention of assassinating the king on
his rentree, but that he arrived too late; that
lie had at length resolved on the extirmina-
tion of the Duke de Berri, as the youngest
of the family, knowing that nature would
soon dispense him from the necessity of a*
bridging the days of the King. This mons
ter was employed in the saddlery of the
King.

Thn Duke de Berri died at 0 o’clock, in

This alarming truth wAs distinctly admitted,
not only by the members of the two Cham
bers, who met to address his Majesty, upon
the mournful occasion, but it is recognized
hy the King himself, in the ronrluding sen
tence of his answer to the nddress of the
Deputies. “ The Chamber cannot doubt,”
Haul his Majesty,“ that, feeling us a man, and
acting as a King, I shall adopt every neces
sary measure to preserve the State from dan
gers of which 1 am but loo Jortiblyforewarned
by the crime of this day."
({uiroga, Chief of the Insurgents at the Isle
of Leon, in a proclamation to his soldiers,
says, “ In the ranks of those whom the gov
eminent may assemble, yon will find breth
ren who are united with you.”
Tile health of King George the 4th was
improving rapidly. He was enabled to at
tend business, and to preside in Council at
Carlton Place.
The London papers contain advices from
Cadiz up to the 2!ith January; nt which
time the city appears to have heen in posses
sion nf the legitimate authorities. Some arm
ed inhabitants, and some soldiers, having
two field pieces, dismounted, had made an
attack, on the. evening of the 24th, upon the
soldiers of the barrack of St. Helena. The
King's troops opened upon them a brisk fire
which was returned for a moment ;the con
stitutionalists soon retired leaving 14 killed
and a great number wounded, on the ground
The captain general of the Spanish navy
has given notice to the English consul, that
the mouth of the river Santi Petri, (Isle of
Leon,) is in a state, of blockade, and that
the entrance of any foreign vessel is prohib
ited.
Parliament.—Agreeably to adjournment,
(tie two houses of Parliament met on the
17th, when the following message from the
King was rrceived and read:
“ GEORGE R.
The King is persuaded that the House
of Lords deeply participates in the grief and
affliction of his Majesty for a loss which his
Majesty and the nation have sustained by
the lamented death of the late King his fa
ther.
This melancholy event imposing upon his
Majesty the necessity of summoning, within
a limited period, a new Parliament, tiie King
has taken into consideration the present state
of public business, and is of opinion that it
will tie, in all respects, most conducive to
tiie public interest and convenience, to call
the Parliament without delay.
The King, therefore, recommends to the
House of Lords to adopt such measures as
may be found indispensably necessary to
provide for the exigencies of the public ser
vice during ihe interval which must elapse
between the t. ’ mination of the present ses
sion and the opening of a new Parliament.

To add to thpse expressions of regret and
coadoh-nce on this common calamity, oui-
most sincere eongrai illations upon liis Ma
jesty's accession to tiie throne of his ances
tors,
To testify to hts Majesty the dutiful assu
rance of our loyal and affectionate attach
ment to his sacred person, to entreat him to
believe that we. derive from experience of
the past, as well as our confidence in his Ma
jesty’s character and virtues, tiie firm con
victinn that his reign will he marked by a
constant endeavor to promote the general
prosperity ami happiness of his people.”
In the House, at the instigation of Lord
Casttrrcagh, who wished time to consider
the nature of the course intended to he pur
sued, the further consideration of the nies

The Spanish insurrection, according to
the most recent and best authenticated ac
counts, still continues to languish. General
Freyre, who commands the royal troops,
has removed from Seville, and taken up his
position close to the head quarters of the in
surgents, of which, it is said, they are ex
pected to obtain possession in the course of
the present month. The leader of the mu
tinoiis soldiers has addressed a proclamation
to the army and the people, in which Iu-
complains, very justly, of the tyranny and
ignorance of tiie royal councils, and the ab
surdity of sacrificing more armies in useless
crusades against the South American colo
nies; hut, unfortunately, he proposes no spe
ci fie object injiis insurrectionary movements,
and holds "out no prospect of any reform

The House again resolved itself into
:i committee of the whole, Mr. Beecher
in the chuir, on the appropriation bill f 0 p
defraying the Civil Expenses of the go
vernment.
Mr. Cobb renewed the motion which
he minje the other day on another hill,
but then withdrew, to insert in the bill
an appropriation of thirty thousand dol
lars for negociating a Treaty with the
Creek and Cherokee Indians for the ex
tinguishment of their title to certain lands
in the state of Georgia.
'I he motion was supported by Mr.
Cobb at considerable length, und also hy
Mr. Culhbert and Mr. Abbot, all of Geor
gia. Messrs. Rea, Livermore and Camp
bell, also engaged in the Debate.
The motion was agreed to by a large
majority.
Norfolk, March 17.
INSURRECTION IN ST. J,\G0 DE-CUBA.
Cnptain Doane, of the sloop Roxana,
from Havana, states that an insurrection
hud taken place at St. Jago-de-Cubu,
the account of which reached Havana a-
bout ten days before he sailed. The
Governor of Hnvana had fitted out an
expedition consisting of two transport
ships, under convoy cf a sloop-of-war,
which sailed for St. Jagoon the 3d, and
Captain Doane fell ia with them on the
5th off Cape Florida. Captain Dom e
did not understand the strength of the
force which had embarked in. the expe-
diton, nor did he understand whether
the insurrection was considered very a-
larming;hnt thinks it was not, from the
tardiness with which the expedition was
fitted out.
NATURAL CURIOSITY.
The following account ofa remark
able Icicle is copied from one of the
late English papers:
“ On Sunday the 6th of January,
the inhabitants of Askrigg and its vi
cinity were led by curiosity to visit au
icicle, which had fornipd itself from a
small fall of w ater, at the turn-ofl’, on
its course to drive a mill-wheel, the
form being a cone, with an opening a-
boutsix feet from its base sufficient t«
admit the body of any person to the
interior, which was descended into by
means of a ladder ; its height tw enty-
three feet, and base seven; when, after
further examination, another apart
ment was found, formed behind, by
means of two grand pillars of solid ice,
with a base of three feet and a half;
both were proved, by admission, to
hold twenty people. In the afternoon,
a company of ladies and gentlemen, of
not less than eight or ten, regaled
themselves with a bottle of wine. The
night being mild, several lights were
placed in the inside ; when the trans
parent view s'truck the eye with such
splendid grandeur that it is impossible
for any tongue to describe it. At the
same time, a party of vocal and instru
mental performers were placed in one
of the apartments, and entertained the
company assembled round with seve
ral pieces of sacred music to a very
late hour.”
Winchester, (Penn.) March 15.
A very strange affair.—On Sunday af
ternoon last, a deputy constable Iron*
Kastuantiuel township arrived in this Bo
rough, with the corpse ofa man, which,
while on the way to interment, he had
seized for debt, and br.ouglit to jail. 'I lie
gherifl very properly refused to leceivc
it. The constable was immediately ar
rested and hound over for hi9 appear
ance nt court for the. net. The corpse
was removed and decently interred.
Our feelings would lead us to speak iu
terms of warmth, of this foul transaction,
which would have disgraced the darkest
ages of heathen barbarism ; but, as the
subject will undergo a judicial investiga
tion, we suppress them.

The President communicated a letter
from the Secretary of the Treasury,
transmitting, iu obedience ton resolution
of the 13th inst. a statement of the lands
sold, the umouut remaining unsold, &.r.
in the states of Ohio, Indiana and Illi
nois.
On motion of Mr. F.llintt, the message
cf the President of the United S ates, of
the 17th inst. relative to a treaty with
certain Indian tribes for lands within the
Washington, March !fi.
A private letter from an Officer oa
board of the U. S ; ship Congress, to his
friend in this city, announces the arrival
of that ship in China (oft - the Island of
Eintin) about the 10th of November last,
after a passage of 106 days from Rio
Janeiro, and 167 from the United States,
146 of which she has been at sea. On the
2nd of September she made the Island
of Saint Paul’s in the Indian ocean, amt
on the 20th entered the straits of Sunda
Dutch. On tlje 24th the ship left Anjier,
and it was not until the 31st of Novem
ber, after having separated from two or
three merchant shifts in company, that
she made the coast of China. “ We are
now,” says the writer of the letter, “ at
anchor at the Island of Liutin, about 30
miles above Macao, and 60 miles below
Canton ; we have not yet heard from the
Consul, but there is no hopes of our
getting to Wampoa, the rendezvous
of merchant ships, as it is contrary to
the Chinese custom to nllow vessels of
war to go there. How long we are to
remain here, or when we are to go away,
it is impossible for me to say. These
are things known only to our comman
der.”
