Matthew Bouler Choir Director . . . Mrs. Linda Freeman Conviction overturned ATLANTA (AP) — The prosecutor who won conviction of a young woman accused of murdering her newborn child in a Georgia prison says he’ll petition the Georgia Supreme Court to reconsider its reversal of that con viction. The court ruled unanimously this week that evidence in dicated Edna White of Jackson was the mother of the child, but there was insufficient proof the child had been born alive. The state pathologist testified the baby had air in its lungs, but Justice Robert Howell Hall wrote in his opinion that this was not necessarily proof that the baby had lived. “Hence there is no proof of the corpus delecti beyond a reasonable doubt,” Hall wrote. The court also ruled that the prosecution failed to prove the baby died by drowning in the toilet where it was found, because there was no water in the its stomach, mouth, nose or lungs. Dist. Atty. Joe Briley, who prosecuted the case in Baldwin County Superior Court, said he will ask the court to reconsider because testimony showed the baby died from suffocation, not drowning, when it was unable to breathe in the toilet. The case received considerable publicity last year when it was learned Miss White went through her entire pregnancy and delivery without prison officials learning of it.
