JPs react to court’s ruling on warrant fees

A Mitchell County justice of the peace
said Monday’s U. S. Supreme Court
decision that Georgia JPs can no longer
be paid a fee for issuing a search
warrant, “is not going to affect my
income too much."
“It wasn’t enough money to have
anything to do with the way I handle my
job,” said Elliot Curies, despite the
court’s statement that the system gives
JPs a financial interest in authorizing
police searches.
Assistant state Atty. Gen. Robert
Stubbs said his office considered a $5
fee for the issuance of a warrant “small
potatoes.”
But some JPs were not pleased.
“It’s not good, said Hugh Allen of
Waycross. “We don’t get a salary and I

don’t see why the court ruled that ’
way."
Allen said he only issued two or three 1
warrants per year. i
Jake Tyre, also a Waycross JP, said 1
the court’s decision won’t change his i
standards for issuing a warrant, “but
sometimes you have to get out of bed in 1
the middle of the night and we have I
time we must put into issuing search I
warrants.”
Judge Joseph S. Crespi Sr., a justice
of the peace in Atlanta, said he denies
most of the requests for search
warrants he gets “because they are
mostly frivolous, anyway.”
He said he agreed with the decision.
“I would frown upon any judge having
to issue a warrant for which he is paid a
fee."
