— Griffin Daily News Friday, February 18,1977 Page 2 Third in robbery guilty; draws 12-year sentence The third of 3 men who robbed the Kwickie Food Store on the Zebulon road last month was found guilty in Spalding Superior Court Thursday. John Carton of Oregon was sentenced to 12 years in prison, the same sentences given his accomplices, Carmen Wilkerson and Michael Caldwell, who pleaded guilty Monday. Carton’s attorney, John Newton, said his client did not enter a guilty plea because he didn’t want to be in the same boat with the others who had prior felony convictions. Newton said he felt the 12- year sentences given them were excessive for the 18-year-old Carton who had no serious criminal record. I have no sympathy with people who go up and down the road with guns holding up people” Whalen said. According to Carton’s confession given police 6 days after the Jan. 12 incident, the 3 were “pretty drunk” and “just got a notion” to rob the store. Carton did not testify, but his statement was read by Capt. Wallace Pitts. It said the 3 were looking for the main part of town and stopped at Ken’s Pizza to ask directions. They then “got a notion” to rob the nearby Kwickie store. After entering the place, they became scared and almost changed their minds, but as they started to leave pulled the guns and committed the robbery. Carton’s statement said he opened the cash register and stuffed the bills into his pockets. An accomplice took rolls of coins from the safe. They then jumped in the car, with Carton driving, and took off. He didn't even know the direction, the statement said. Store employes, Donnie Higgins of Newnan and Debra Foster, identified Carton as one of the three gunmen who entered just before the 11 p.m. closing time and forced them at gunpoint to lie face down on the floor. The men were carrying pistols and a sawed off shotgun. Both described Carton as the robber with a small pistol who had very ragged jeans and a gold earring in his left ear. His hair was shoulder length, they said. David Rice, manager of Ken’s Pizza, testified the men stopped at his restaurant and asked directions to Macon. After the robbery, he gave police a description of their station wagon and it was stopped by Upson Sheriff’s deputies and Thomaston police some 30 minutes later. Upson County Deputy Al Brannon said he had received a lookout from Griffin and stopped the vehicle just outside of Thomaston. City police officers assisted him in stopping the vehicle. He identified Carton as one of the occupants. Upson Deputy Dick Barnes identified photos he had taken of the station wagon. Money was on the front floor. Capt. Wallace Pitts who searched the vehicle after it was brought to Griffin the next day found a large amount of money in the car, along with a sawed off shotgun, 3 pistols, stereo equipment, 60 to 80 rings, earrings, jewelry, silver dollars and liquor. There was a large pile of bills on the floor, he said. The $359.17 taken in the robbery was recovered. Carton frowned down at clenched fists during most of the proceedings. He seldom raised his eyes. The case was prosecuted by Assistant District Atty. Paschall English. Atty. Newton said he plans to appeal the conviction. Judge Whalen reminded Carton he could ask for a review of the sentence by a state board of 3 superior court judges. The trial ended the first week of criminal court. A new jury list has been drawn for next week’s session. District Atty. Ben Miller said he plans to call the cases of Ronald Fourts and Joseph Alford Gresham who are accused of murdering Randy Reeves and Stanley Darsey and of stealing guns from Reeves’ residence. Griffin man accused of rape A 28-year-old Griffin man was arrested by Henry County Sheriff’s officers and charged with raping a 15-year-old girl. He was identified as Robert Eugene Roland of 1002 Meriwether street. The incident allegedly happened Wednesday night in back of the Atlanta race track near Hampton. The girl, who also lives in Griffin, was treated in a doctor’s office, sheriff’s officials said. Thai Award The Atlanta Junior Chamber of Commerce presented the 1977 Honorary Lifetime Member Award to Jasper Dorsey, (1) Southern Bell vice president and chief executive of ficer for Georgia, at its annual awards. Making the presentation was Jaycee Vice President Atlee Harmon. Deaths Funerals Mr. Ellis Mr. Elijah Lloyd Ellis, 82, of 118 North Expressway, suffered a seizure early this morning and was dead on arrival at the Griffin-Spalding Hospital. Mr. Ellis was a retired employe of Crompton Highland Mill and a member of the East Griffin Baptist Church. He is survived by a son, D.M. “Joe” Ellis of Griffin; two daughters, Miss Annie Loyd Ellis of Griffin and Mrs. Alton Blackmon of Relle Rive, Ill.; four grandchildren and six great-grandchildren. Funeral plans will be announced by Haisten Funeral Home of Griffin. Brownies visit pizza parlor The East Griffin Brownie Troop 294 visited Ken’s Pizza parlor. They were shown how pizzas and other foods are prepared. Pizza and soft drinks were served the Brownies after which Valentines were exchanged and Valentine cupcakes were served by Mrs. Eunice Baggett, co-leader. Cody of Griffin and Mr. and Mrs. John Mayeske of East Point. City makes meter case If your electricity gets cut off because you haven’t paid your bill, don’t turn it back on yourself. You’ll end up with a heavy fine or a jail sentence. That’s what happened to a man in Griffin Criminal court Thursday. Judge Tom Lewis sentenced Tommy Beavers of 541 West Quilley street to 6 months in jail which may be suspended if he pays a $255 fine and makes $103.59 restitution to the City of Griffin. According to John Jones, engineer with the electric department, Beavers’ electricity was cut off because he didn’t pay his bill. Jones explained that Beavers moved into another house on West Quilley and had the current turned on under another name to keep from paying his old bill. He didn’t pay the new bill either and the electricity was again cut off, Jones said. Beavers then by-passed the meter and turned the current back on himself. Phone 522-2272 prosecute anyone who tampers with meters. All meters whether in use or not are checked at least once monthly, he said. He said such offenses run in spurts. When the city begins a crack down, word gets around and nobody tries it for a while until another offender is prosecuted. “We’ll prosecute all we can catch,” he promised.
