libel or complaint tu the District Court of tho United
States for tho Southern District or Georgia, alleging
and propounding that the said libellants aro the
true and legal owners of tho said ship Elizabeth, of
which Thomas Williams is and lately was muster,
that on tho night of the fifth or April, Iu the year
eighteen hundrod and fifty-six, tho said ship Eliza
beth was lying in tho River Savannah, at Venus’
Point, well lu shore, und was at that time a stauuch
and well built ship, of the burthen of nine hundred
and fiftv tons, or thereabouts, and sulllcleutly pro
vided witli apparel, tackle aud furuiturc, aud pro
perly manuod with a sulllclont crew to work and
navigate said ship, that ou the said night of tho fifth
of April, eighteen hundred and fifty-six, about seven
o'clock iu the evonlug, u signal lantern was hung
out iu the forestay of said ship Elizabeth; that about
eight o'clock ou tlio ulght of tho said fifth of April,
whilst the said ship Elizabeth was so lying at Venus*
Point, in tho Savautmh River, within the ebb and
(low of tlie tide, aud within the admiralty aud mara-
time jurisdiction of the District Court of the United
Stales, for the Southern District orGcorgla, securely
moored, the steamship Keyatouo State, whereof
Robert llurdlo was master on her way Irotu Phila
delphia to the city of Savannah, came up tho Sayan-
nali River under full headway* ami then and there,
with great force and violeuce, ran into and upon tho
said ship Elizabeth, smashing tho sldo of tho fore-
castle of said ship Elizabeth, brouklng five of tho
forecastlo beams, started tho dock, carried away
the bowsprit, and other damage did to tho suid ship
Elizabeth, os in said libel Is stated, rendering it ac
cessary to discharge a part or her cargo, und to
bring nor up to tho city of Savannah for repairs, at
great oxponso and loss of time: that it is lmi»sslblo
to ascertain exactly what will bo tho extent of tho
damages, but os fur os calculation enu be mudo the
damage sustained by such eollUtou to the suhl ship
Elizabeth, amounts to the sum of ten thousuud dol
lars; that this occurred in the admiralty ami mara-
time Jurisdiction or said Court, all of which the libel
lants pray leave to furnish proof of, and have also
prayed u decree for their damages aforesaid, and
costs, and thut tho ordluary process may Issue.
And whereas the Judge of the District Court afore
said hath ordered and directed that tho ordinary
process should issue, returnable to the United
Slates Court Room in the city of Savannah, ou tho
12th day of June next, ut eleven o'clock, A. M.,
