found drank on the streets yesterday—
Sunday. It is rumored that restaurant
keepers and draagists, a* well aa whole
sale and retail liquor dee'ers, may hare
furnished Sunday drinks. I respectfully
ask all peraons not to sell or allow liquor
to be drank about their places of busi
ness on 0undsy. The law will be en
forced without regard to persons.

11th insb, we learn that Dr. B. D. Ar
nold, Ohairman of the Board of Public
Schools in Savannah, left that city on the
evening of the 13th insi with a petition
to Gov. Smith, urging the appointment
of Mr. B. Motion, tho efficient Superin
tendent of Publio Schools in our city, as
State Commissioner of Education, to
succeed Col Lewis, just resigned.
BThe Kspublicm, further takes oocasicn
to commend Mr. Mallon in the moat un
qualified terms. While ww would have
greatly dapMeated tho loos of Mr. Mal-
lon’s experience and energy os director
of the school system, so auspiciously es
tablished by him in our city, yet candor
compels ua to say ho is a man eminently
qualified for the position.
We have reason, though, to rejoice
now in the happy selection of Prof. Ore,
and the continued services of Hr. Mallou,
as an aMa Superintendent and a man
calculated to exalt the standard of edu
cation in our city.

ing with the following conditions: The
owner, his agent or attorney, shall make
an affidavit, stating the ownership and
description of the property, that it is in
tended to make improvements on the'
ie, either fencing or building or oth
erwise, that such improvements are to
oast shove the sum of one hundred dot
lore, and that be desires to have the grade
of such street or streets established.
A copy of such affidavit shall then he
served on the oity surveyor, whose duty
it shall be, within thirty days thereafter,
to make the necsMry surrey, and fix
the grade of euoh street and make a plat
or profile showing the sume, and shall
deliver it to the affiant, together with the
affidavit of said survey, or showing that
the same is correct and fair ; and upon
the mime being filed together with the
original affidavit in the office of the Clerk
of the*8uperior Court of the County of
Fulton for Reoord, the owner shall there
upon have a rested right in such grads,
and shall be entitled to recover damages
from tbe oity for any injury done to suid
property, in view of any improvements
thereafter made upon tho same, should
the oity thereafter alter the grade, stick
damages to be ascertained, recovered and
paid in the mr iner in which the- laws
and ordinances iu force at the time may
provide for ascertaining, recovering and
paying damages done to property in lay
ing out or widening streets.
Section 2. Re it further enacted, That
in case there be no Oity Surveyor, the
copy affidavit aforesaid may bo served
upon the Mayor of the city, with like
effect as above provided, and il, within
thirty days after service, os aforesaid,
either upon the City Surveyor or the
Mayor, such survey and plat is not made
and delivered to such affiant or left at his
place of residence, the owner, his agent
or attorney, may cause a plat or profile
of the grads as it thou exists, to be made
by any competent surveyor, which may
be extended and filed in like manner
and with like effect ns provided in the
foregoing section; and it shall be the du
ty of the Clerk of tbe Superior Court of
Fulton county to reoord such return in
the book of deeds of said county when
filed in bis office under any of tho pro
visions of this bill.
Seotio i 3. Be it further enacted, That
nothing in this sot contained ahull oper
ate to interfere with the control had
by the Mayor and Gounoil of said
city over the manner in which tho
City Surveyor shall oxcento their instrnc-
tions or tbs instructions of their com
mittees in regard to tho grado of any
street, but any failure or diaputo which
may happen therein shall not operate to
delay, hinder, or affect tho remedy given
by this aet to any owner of property
soekiug to bavo bis grado established as
aforesaid.
Section A Be it farther onaoted, etc.,
That in ease the owner of any real estate
in said city deaires to have the grade
fixed as aforesaid, for any reason other
than a purpose to make improvements on
the same, he eliajl make his application
in writing, not undor oath, to the City
Surveyor, but need not incorporate any
reason therein, npon which all subsequent
proceedings shall be tho same as above
sot forth, such written application taking
the pUoo provided for iu tho foregoing
sections |of this bill Provided. That

Ho, I'on New Zealand.—Edward
Parsons, of the firm of J. 0. Allen
Co., n few days ago sent to New Zealand
a box full of acorns, nuts, and other of
oar native hard fruits, both wild and
domestic.
To-day he will send another box of
articles of Georgia manufacture and pro
ducts—among which will be specimens
of the Daily and Weokly Sun.
Fibs.—The alarm of fire was given
about 10 o’clock last night, occasioned
by the burning of a wooden shantv, be
longing to A. W. Mitchell, situated in
the rear of what is known as McDaniel
A Strong's warehouse. The shanty was
not oooupied. Tbe fire companies were
out promptly — Nnmber 1 getting the
fir-t water on tho fire. Number 3, how
ever, was uot far hchiud. The building
was consumed in a very short time. Loss
immaterial.
The Gband Ikauoubal Ball, iu honor
of Gov. Smith, at the Kimball House,
was the largest soeial entertainment ever
given in Atlanta. Three thousand of
tho fashion, intelligence and elite of tho
city thronged every room and lmll until
it was scarcely possible to move among
the happy throng.
Templeton performed last night to a
largo and appreciative andienee, and tho
whole company unstained their merited
reputation. A dry old codger, who is
vory hard to plooae, whenever ho hoars
that Templeton is earning, always ex
claims, “that do sottlo it," and rushes
straightway to secure a reserved seat.
To-night ho will present “Fashion" and
tho Irish Doctor, and every one sutler-
iug from “bines" should avail themselves
of tblB chance to worship at the shrine of
the God of Drama.

Treasury, such as to render successful legislation In
