I. Against the Hcofiuld Rolling Mill
Company ; alleging that said Company,
and alao that Lewis Bcofit-ld, Wui. D.
Cook und Asa L. Harris, as individuals,
have “defrauded the fitnbt of Georgia,
and unlawfully and fraudulently datains
from the State the sum of 857.150, bo
lides interest"—In this:
I. Thefintcountofthepetitioncharges
that on the 16th day of January, 1870, and
at divers times from that date kill the let
of February, 1871, (aid Bolling Mill Co.
“unlawfully and fraudulently collected
from the Treasury of the State the sum
of $47,600 for 660 tons of railroad iron,
pretended to have been furnished by
■aid Company to the W. A A. R. B., but
not tarnished in point of fact; bnt being
In excess over end above nils which were
actually furnished to the said road; and
the said defendants, Scofield, Cook and
Harris, assisted in the perpetration of
said fraud."
This is founded on a statement of col
lections set forth in ■ bill of particulars
accompanying the case, showing the
amounts collected by the Bolling Mill
Company from the treasury of the State
Road and the State Treasury, from the
15th of Januai7, 1870, to the let of Feb
ruary, 1871. The sum of $86 per ton
wu collected for all the rails furnished
up to the 6th of Ootober, 1870, on whioh
dsy, and also on the 17th of November
following, $80 per ton wu charged and
oolleoted; and on the 1st of February,
1871, the sum of $82 per ton.
X The next count charges that the
Company collected u aforesaid for 700
kegs of iron-spikes at 87.60 per keg,
“ being in exceu over and above spikes
aotually furnished to the Road by the
Company," whioh is founded on a like
bill of particulars, amounting to $5,250.
3. Another count chargee that the said
Company also oolleoted for 48C kegs of
iron-spikes, it $8.25 per keg in excess os
before, amounting to $4,005.
4. The lut count charges tho collec
tion of $301 daring the same period for
fish-bars, “over and above the quantity
aotually furnished, u shown on their
own booka."
The suit is brought to require tha said
Scofield Rolling Mill Company, and tho
■old Scofield, Cook and Harris to appear
at the next Superior Court, to answer the
demand of the State in the premises.
II. Against Varney A. Gaskill, a non
resident; bnt who holds property within
this county, alleging that ho has “de
frauded tho State of Oeorgia out of the
inm of $16,648."
That on or about tho 7th of Novem
ber, 1870, while unlawfully pretending
to act for the State, he compromised and
settled with Miles O. Dobbins, his suit
then pending against the Western and
Atlantic Railroad, for cotton alleged to
havo been lost between Atlanta and New
York, bv which 87.IHM) wero paid. Tliul
on pretext of making the payment, said
Gaskill fraudulently drew from the State
Treasury tho sum of 322,548, and after
paying Dobbins, rotained unlawfully and
fraudulently the sum of $15,548.
Col. MoCalla has made the proper affi
davit acoording to law for obtaining an
attaohment against a non-resident of this
[State. The petitioner prays that process
of attachment may iasuo against said de
fendant, to be levied upon any and up
on all of hla property, to answor the
aforesaid claim.
III. Against Asa L. Harris, alleging
that ho “ fraudulently detains from the
State of Georgia tho sum of 88,486.62,
besides interest,” which sum so unlaw
fully detained, was reeeivod by him in
sums at different times, os appears by a
bill of particulars, dating from December,
1870, to November 1st, 1871.
Wherefore the State brings this suit,
and pnyi that process may issue requir
ing said Harris to appear at tho next
Fulton oonnty Superior Court, then and
there to answor to the Stato iu the promi
see.
IV. Against John Rico, a non-resident,
holding property in this eoauty, alleging
that ha “fraudulently and unlawfully de
tains from this State tho sum of 829,600,
besides interest."
1. That on orabout Juno 1st, 1870, the
said Rloe got possession of 89,500 from
the Western and Atlantia Railroad, pro
perty of the State, under the fabricated,
unfounded end fraudulent pretext of re
ceiving payment for cars said to have
been furnished by the Teuueuwe Car
Company, of which ho claimed to be
President.
X That afterwards, early in June, the
said Rice reoeived $20,000 belonging to
the State from Rufus D. Bullock, thon
Governor, through the hands of Foster
Blodgett, “for the illegal and fraudulent
purpose of buying and publishing the
Era newspaper, in tho city ol Atlanta."
3. That the defendant has never ac
counted to the State in any way What
ever lor Wither of the aforesaid aums of
money; bat, on theooantrj, still detains
them illegally and fraudulently.
The informant aforesaid haw made
proper and lawful affidavit tor an attach
ment against a non-resident, and the
State prays that process may iaaao against
tuy and all the property of tha defendant
V. Against Nathan P. Hotchkiss, alleg
ing that he “fraudulently and unlawfully
detains from the State of Georgia tho
sum of $14,639.14, besides interest"
That daring the year 1869-70, ho was
acting os Auditor of the Western and At
lantic Railroad, and in that official capa
city, did fraudulently and unlawfully
rcoeive fioin its treasury largo sums of
money on divers fraudulent and pretend
ed claims; and did fraudulently audit and
approve claims iu faTorof other pereons,
as fully appears in a bill of particulars,
and refuses to pay the Stato any part of
tire sum aforesaid.
Wherefore the State bring* this suit, re
quiring add Hotchkiss to appear at the
next Fulton oonnty Superior Court, to
answer the demand in the premises.
VI. Against James Maliina, alleging
that he has “defrauded the State of
Georgia out of the sum of $6,867.81, be
sides interest."
That on the — of December, 1870, he
paid to one Walter S. Withers a lot of
scrap-iron belonging to the Western and
Atlantic Railroad, for an iron fence or
railing, “made and delivered for him
self," thereby defrauding the State out
of tho sum of $494, the price of the
scrap iron.
That on the 27th of December, 1870,
be unlawfully and fraudulently receired
from the Western and Atlantic Railroad,
State property, the sum of $233.31, as
■alary for Superintendent of the Cur-
sbop, from November 18tb to December
31st, 1870; snd the sum of 8146 on a pre
tended end fraudulent claim for expen-
■ to Philadelphia and New York.
8. That on the 7th of December, 1870,
he, os Master Mschinist, did fraudulently
spprove and account in favor of the
firm of J. M. and J. C. Alexander
against the Western snd Atlautio Rail
road, the som of 85,995.
Wherefore the State prays that legal
process may issue, requiring the said
James Mullins to appear at the next Su
perior Court for Fulton county, lo an
swer tho demand of the State in the
premises.
VII. Against Foster Blodgett, alleging
that he " fraudulently detains from the
State of Goorgia the sum of 850,188.73,
besides interest," whieh sum was unlaw
fully and fraudulently received by him
in sums at different times, as appears
from a large bill of particulars, dating
from February 25th, 1870, to the 24th ol
November following.
Wheroforo this snit is brought, pray
ing that process may issue requiring the
said Blodgett to appear at the next Ful
ton Connty Superior Court, to answer
the State in the premises.
Total amount, $182,385.66.
Alabama** Wealth.
The Montgomery Advertiser of the 19th
has the following brace of paragraphs:
At twenty dollars a ton tho iron of
Alabama will produce the State, five
thousand millions of dollars. Annual
interest, at 8 per cent, four hundred mil
lions. Annual tax on tho interest, at
1 i per cent, six millions. Annual tax on
interest on coal and iron combined, ten
millions eight hundred thousand dollars
■a very pretty revenue.
At fifty cents ■ ton tha cool mines of
Alabama are worth four thousand mil
lions of dollars. The annual interest on
this vast sum at 8 per cent, is three hun
dred and twenty millions of dollars!
The first question that arises upon read
ing these paragraphs is, why in the deuco
the people of Alabama don’t go to work,
dig oat that iron and coal and glut the
market at once and be rioh. With such
wealth, all ready for the market, it is a
ain for a Stato to be poor.
