Gartrell, for the defense, stated that the prisoner wee not prepared fur a trial, sad moved for a continuance to ths ueii term of the Court. Judge Linton Stephens, counsel fur Slate, insisted that the reaeons fur such continuance should be submitted in writing, whereupon the prisoner and bit countsi retired to consult sod prepare the paper. The substance of that showing Is sa follows: 1. The very recent finding of the bill of Indict ment end the prisoner's confinement have allowed him no opportunity to prepare e defense. The long and comprehensive list uf ciuu gee render it neces sary that the prisoner should be allowed eoeeaa to Ms books, which hsd been refused him. 2. Mr. Oebcrne O. Bill, a young man detailed by the Western 4 Atlantic Rail road to act ea hie clerk end buok-fc daring the period of kis transectione with the Road, ■ oaaa, and the ouly one by wu oat he eould ex plain the alleged irregularities ia the hooka, then absent at Hot Springe, Arkansas, without Jurisdiction of ths Court. Due diligence had k made to eubpmua Ift. Hill (the counsel mid»; that Mr. Hill was not absent at the connivmaos or with U»e ooaeeet of the prisoner; and. oowoiuded by sub mitting to his learned friend. Judge Stephens, whether his sense of Justice and liberality did not revolt at the thought of forcing e prisoner to trial before he was prepared. Judge Stephens arose and replied that he stood there not to persecute but to prosecute. Such a proceeding, he stated, would be beneath the dignity of the greet State which he represented. It wi from her purpose to persecute and oppress any of her citizens; and even wore that true be himself oould never conscientiously participate lu or abet such prosecution. Yet, he was determined that prosecutions, insti tuted by the State of Georgia, should never be farose. The oounsel for the prisoner could make no appeals to the law or his liberality, for the nature of the and the character of the showing made by him in behalf of the prisoner, presented no claims to lew or liberality. The counsel for the prisoner bed intimated that It was e large and comprehensive charge, involving aeries of specifications, which demanded time for examination and Investigation. The oounsol for the prisoner was right; it was e greet case, Involving untold enormities end irregularities—one of colotsal dimensions. Nevertheless, it was very simple; It Involved no mystery. It wee e simple aooount tor eroas-ties furnished by Mr. Hoyt, a few accounts which a skilful aooouutant could explain in half n hour. The oounsel for the8!ate bad no intention of making anyooncealment The counsel for the prisoner should bive unrestrained access to all the books, and should be allowed every opportunity to explain their regularities," as they were termed. The counsel for the prieoner urged that they were net prepared for the defense on aooount of the ab- aenoe of Mr. O. 0. Hill. Would the oounsel evi prepared? Judge Stephens ventured to prediot that they never would. The prisoner end counsel knew two months ego of the nature of the charges. Why had they not taken eteps to secure the presence of Mr. Hill, whose testimony, they alleged, was ao vitally Important to the defendant? rae a little remarkable that this witness had disappeared Juat at the time when hie presence waa moat needed. Bo far from appe.rlnf that ha had left to recuperate hie health, his dieappearanoe rath suggested continuance on the part of the oounsel and prisoner. He hoped the motion for oontinuanoe would not pievail. Gen. Gartrell replied reiterating the points of the written statement of the prisoner, presenting them In as forcible a light as possible. Judge Hopkins thereupon overruled the motion for continuance, staling that though the charges In the warrant and the Indictment varied in their phra seology and purport, the transaction waa the I and the chargee were substantially alike; that the defendant well knew who his clerk wee, and that the pocutiar reint on of tho wit ness (the clerk) with the defendin evidouco of iho vital necessity of this testimony to tho cause of the defendant, yet proper diligence had not been used to secure his preaenco. While he saw no reasous for a couliuuance. be believed tho counsel for tho prisoner ought to have a fair opportunity to examine the books kept by the defeudaut while he was employed by the Western 4 Atlantic Railroad, to furnish cross-ties, Ae.
