Ula speech was clear, cogent, pointed, exhaustive aud eloquent. His points wars strong and unan swerable. The following is a portion of bis brief: The Keister Is confined in the Fulton ooouty jail upon three bench warrants from the Superior Coart, for false Imprisonment of Hancock, for an attempt to kidnap him, and for falsely and fraudulently altering the bench warrant issued by United States Court at Charleston, 8. O., by inserting in it the names of Hancock and Spears. He seeks to be relieved undor the 7th section of the Act of Congress of 2d March, 1KM, known as the Force BllL 4 Statues United States, <94; 1st Hr. Di gest, 802, section 2. It Is for tbe relief of persons confined “for any act dons, or omitted to be done, in pursuance of slaw of tbs United States, or any order, process or decree, of any Judge or any Court thereof." “Hie right to Issue the writ can only arise by a total nullification of tbe Federal authority; aud the Imprisonment of one of its officers, not for scrims, but for tbs performance of duties enjoined on him by law, and which he was sworn to perform.’’ McLean In Ktparte Robinson <th McL. B. 858. Hendricks Is a Deputy United States Marshal of South Carolina, duly sworn. In this State he has no authority, except that conferred by tbe Marshal of this State having specially deputed him to oxecute eight or ten warrants. He took no oath of offlos in this State. He was, therefore, not an officer of the United States hers. He must have bean sworn. See 8th McLean, 858, ante; Br. Digest. 698 McLean, 97: Conklin’s Tr. 202. A Deputy Marshal Is an officer subject to removal by Judge—1 Br. Digest, 698. Hendricks bad no process against Hancock. Tbe proof 1s that no indictment was ever found Hancock. (So for as Is known, no charge was aver made against Hancock.) The bench warrant which Hendricks bad issued, against Scott only. Bench warrants from that Court never contained mon than one name, and this Hendricks knew. He ad mils Hancock's and Spears' names were inserted in thewirraut; but says be did not Insert them, know who did, nor when it was done. It Is clear that the process as Issued at Charleston, was no process against Hancock. But it is said the indorsement at Savannah, Geor gia, was the process under which Hendricks acted. It does not appear that Hancock's name was therein. First we ssy. that process was not the warrant is sued by tbe Judge, but by the Clerk without the Judge’s knowledge, and without any authority of law. Had the process been good In South Carolina against Hsnoock.it oould not with that indorsement, be executed in this State. The Capiat “can be ecuted only within the district. If the defendant Is elsewhere, he can be brought within tbs Jurisdiction of the Court only by the means pointed out for the removal of prisoners from one district to another.' Conklin’s Treatise, 699. That is, he must be com mitted where he is found, and thsrethe Judgs must order his removal. 35 Sec. Judicial Act, Conkljn'i Treatise, 682, 683. No commitment can be had except upon warrant issued upon oath and upon evidence dofoored un der oath. If Hendricks was an officer of the United States, and said paper is held to be process against Hancock, then for the folse Imprisonment of Hancock and the attempt to kidnap him, Hendricks should be dis charged. But surely the alteration of the process by insert ing Hancock's name, wae not an act done 11 pursu- of any law bffthe United State*, or of any order, procees or decreo of one of Its Judges; and for that this Court cannot release him. It was no part of the arrest—was made on a different (lay, etc. 2 Abbot’s U. 8. It. 279, (Roberts case.) LLe Indictment is bad, the Superior Court will quaah It If he is not guilty, Its jury will acquit This Court has uo Jurisdiction over those questions, and therefore tbe State has declined to argue the first or introduoe evidence as to the last. This forgery is patent on the face of the paper to any observer. It is tbe plain duty of this Court to remaud Hendricks for trial, at least on the bill for altering said process, aud let the Superior Court deal with him. Col. He gave a general review of the authorities cited In the opening argument by (ten. Gartrell, but fined himself chicfiy to an analysis of the foots of this case, as disclosed by the evidence.
