Because of default in payment of indebted¬
ness secured by a deed to secure debt execut¬
ed by JOHN WESLEY COLLIER, JR. to
THE BANK OF PERRY, dated October 11,
1996 and recorded in Deed Book 0170, page
864, Clerk's Office, Peach Superior Court,
the undersigned THE BANK OF PERRY,
pursuant to the power of sale contained in
said security deed, will, on the first Tuesday
in May, 1997, during the legal hours of sale,
at the couithouse door in Fort Valley, Peach
County, Georgia, sell at public outcry to the
highest and best bidder for cash the property
described in said deed, to-wit:
All that tract or parcel of land situate, lying
and being in the east or southeast part of
Land Lot Number Thirteen (13) in the Fifth
Land District of Peach County, Georgia, (but
not in the immediate southeast comer of said
comer of said land lot) containing twenty
five and one-fourth (25-1/4) acres, more or
less. The said tract being that parcel of land
shown as “TRACT NO. 3" on plat of survey
made by T.F. Flournoy, Surveyor, on Novem¬
ber 20, 1948. and recorded in Plat Book 2,
page 34, Clerk's Office, Peach Superior
Court, and it has such shape, courses, bounds
and distances as shown on said plat.
Said property will be sold subject to all ease¬
ments, restrictions and the outstanding ad
valorem taxes and/or assessments, if any.
To the best of the undersigned's knowledge
and belief, John Wesley Collier, Jr is in pos¬
session of the property.
A deed will be made by the undersigned to
the.purchaser at said sale. The proceeds of
said sale will be applied as provided in said

295 and 296, Clerks Office, Superior Court,
Peach County, Georgia, the full unpaid
amount of indebtness was declared due and
payable, and pursuant to power of sale con¬

On May 13. 1997 this Georgia Department of
Transportation vgill hold a public hearing
concerning the proposed Location and
Design of Project i. TP-1253(5), Peach
COunty. The hearing will be held from 4:00
pm to 7:00 pm in the Fellowship Hall of the
Byron United Methodist Church, 103 West
Heritage Blvd., in Byron, Georgia.
STP-1253(S), Peach County, represents the
relocation of SR 42 in Byron. The relocation
would remove the existing job in the State
Route in the downtown area, allowing travel
between SR 42 and SR 49 as one continuous
movement. The new roadway would be a
two-land, undivided, rural facility.
The relocation of SR 42 would begin just
west of the intersection of Old Fort Valley
Road, now called Moseley Road, and SR 42.
The alignment would transition onto new
location, cross Moseley Road, the Central of
Georgia Railroad, an undeveloped grassed
lot, and terminate at the intersection with SR
49 approximately 274 meters (900 feet)
southwest .of Church Street. The project pro¬
poses a grade separation at the Central of
Georgia Railroad with construction of a 61.6
x 13.2 meter (202 x 44 foot) bridge. The
total length of the project is 0.619 kilometer
(0.384 mile). Th existing section of SR 42
that lies between the beginning of the project
and Moseley Road would be removed and
left turns onto Moseley Road provided for at
the newly constructed SR 42/Moseley Road
intersection.
The right-of-way requirement for project
construction would vary from 3 meters (10
feet) on the north side of SR 42 at the
beginning of the project to 70 meters (230
feet) in the area of the area of the bridge con¬
struction at the Central of Georgia Railroad.
Local roads would be used to detour traffic
on Moseley Road to SR 42 without traveling
through the construction area at the Moseley
Road/SR 42 intersection. At this time, there
are no plans to close the existing road
through town after the route is relocated. As
this section of roadway will no longer have a
State Route designation, the city will deter¬
mine any changes in use or access along the
street.
Representatives from the Department of
Transportation will be available from 4:00
pm. to 7:00 pm. with plans and displays.
The public will have an opportunity to attemi
the hearing at its convenience to ask question
s and discuss the project with a Department
representative. Relocation assistance will be
discussed at the hearing.
A court reponer will be available during thi
time to allow the public an opportunity to
make comments about the project. These
comments will be included in the transcript
of the hearing.
