THE enemy perfiftiug in that barbarous line of
conduct they have pursued during the course of this
war, lave lately most inhumanely executed Capt.
John Huddy, of the Jersey Hate troops, taken pri
soner by them at a post on Tom’s river, and in
confcquence I have written to the Britith comman
der in chief, that unless the perpetrators of that
horrid deed were delivered up, I fliould be
the disagreeable necessity of retaliating, as the on
ly means to put a flop to such inhuman proceed
ings.
You will therefore immediately on receipt of
this, designate, by lot, for the above purpose, a
Britifti Captain who is an unconditional prisoner, if
such a one is in your pofTeffion ; if not, a Lieute
nant under the fame circumftanccs, from among
the prisoners at any of the poffs, either in Penn
sylvania or Maryland. £0 fcon as you have fixed

on tbeperfon, you will fend him with a fafe guard
to Philadelphia, where the Minister of War wilt
order a proper guard to receive and condutl him
to the place of his deftJnation.
For your information rcfpcfting the Officers who
are pril'oncrs in our possession, 1 have ordered the
Coimniffary ofprifoners to furnifh you with a lift
of them ; —it will be forwarded with this. / need
not mention to you, that every pofftble tenderness,
that is confident with the Jfturity of them , Jbouli bo

to fuffer.

SIR, •
I am informed by the Secretary at War, that
Captain Afgili of the British guards, an unfortunate
officer who is defiined to be the unhappy viftim to
atone for the death of Captain Huddy, was arrived
at Philadelphia, and would set off very soon for the
Jersey line, the place afligned for his execution.
He will probably arrive as soon as this will reach
you : and wiil be attended by Capt. Ludlow, his
friend, whom he withes to be permitted to go to
New-York, with an address to Sir Guy Carle ton,
in his behalf.
You will therefore give permifTion to Captain
Ludlow to go by the way ofDobb’s ferry into
New-York, with such representation as Capt. Af
gili ihall please to make to Sir Guy Carleton.
At the fame time I would wifli you to intimate
to the Gentleman, that tho’ I am deeply affected
which th# unhappy fate to which Captain Afgili is
fubjeded, yet, that it will be to no ptirpofe for
them to make any representation to Sir Guy Carle
ton, which may serve to draw on a diffusion of
the present point of retaliation: that in the flage
to which the matter has been fuffered to run, all
argumentation on the fubjedl is entirely precluded
on niy part i that my resolutions have bee*, found
ed on so mature deliberation, that they mud re
main unalterably fixed. You may also inform the
Gentlemen,* that while my duty calls me to make
this dccifive determination, humanity didates a tear
for the unfortunate offering, and inclines me to fay
-that 1 mojl devoutly wijh his life may be /pared.
This happy event may be attained, but it must be
effected by the Britirti commander in chief: lie
knows the alternative which will accomplirfi it;
and he knows that this alternative only can aveic
the dire extremity from the innocent, and that in
