The assault was committed
while two white children looked

The two white women told
conflicting stories. One testified
the men did not touch the child.
The other said they wrestled
with the little Negro and pulled
off her clothes and assaulted
her.
On trial were James Marion

A third man, Louie Eugene By¬
ars, 20. of Rome, is under in¬
dictment. but wll be tried sep-
arately.
Two physicians, who exam¬
ined the Negro girl shortly aft¬
er the alleged attack, testified
they found “no evidence of
rape.” Drs. Clare J. Wyatt and
A. F. RouHedge said their'ex¬
aminations disclosed no abrais-
ions or lacerations on the child.
The girl told the court she
went to a spring in North Rome
for a bucket of water April 3 and |
found there the three men, twe
women, Geneva Davis and Eula
Byars, sister of Louie, ahd two
children, about two and four.
She said the men made her
drink some wine. Later, she
continued, Hicks pulled her tc
the top of a nearby hill, stripped
off her clothes and threw her
to the ground. Then, she related,
two men would hold her while
the third ravished her.
The girl srrd w ip. white women
stood by interestedly all the
while and laughed.
Hicks and Elder testified they
didn’t touch the girl. They said
they tried to get her to go away
and leave their party alone. The
men added that when they were
they thought it was for
drunk and disorderly, and
that they didn’t learn they were,
with rape until the fol¬
lowing day.
Eula Bynes gave a similar ac-
count. But Geneva Davis sail

that Byars did not par
in any way.
In opening his final argument'
to the jury, Solicitor Maddox
“Our system of justice and our
of dealing with the two ,
are on trial today. The
of Washington and the na¬
are on this jury.”
He said “Northern agitators”
always say the South doesn’t
the Negro. At this point
defense attorney Claude Pitt¬
, a state Senator, objected
the line of argument, and the
judge ordered Maddox to stick
to the evidence.

In Arpil, 1815, the American
Japtist Mission society, acting
in the retinal of southern mem¬
bers to comply with this rule,
adopted resolutions that sepa¬

A month later, upon a call by
'he Virginia Foreign Mission so¬

the now Southern Baptist

southern group was; precisely
that of the General convention
which later became known :v
the Northern Baptist conven

Now. tho Southei n Baptists are
on their way “north” to put de¬

the affair will mark the first
time that many delegates from
the south will be seated in the

been a matter of tradition that
the two races worship in sepa¬

south, but in most northern
churches.
The Southern Baptist conven¬
