Colquitt. xx-oov. smith's sxplt. Atlanta, Feb* 3. Hit Bxeelkncy, Alfred B. Colquitt, 0tr emor Bn—I am to reoaipt of yonr oommnni- oatlon of thia date, with the aooompany ing copy of a raaolation of the House of Representatives, to which you direot my attention. [Hers follows the resolution, j You aay to substance that tha employ- manta referred to were under my admin ietration, and that yon have deemed it dne to myeslf that yon ahonld submit the matter to me for enoh information a* I may think fit to give. Tha raoorda con taining foil and particular information not being before me, I shall be oompelled to trait in a measure to my memory in making statement* of faota toaohing the matter to qoaition. The first inquiry in th* resolution whioh requires notice ia, “wby were th* employments thereto re ferred to not made according to the pro vision! of the cod* eeotion 63?” The his tory of this eeotion ebowe that it wm passed to 1872 and wee intended to apply to a oltM of oases than just arising out of tba frauds, alleged to have been commit ted daring the administration of Gov. Ballook. At these casea wars involved in more or Ism doubt, it wm intended to be lift antirely in tha discretion of the Governor whether the soite ahonld be brought or not. And that tbe exeontive might not be misled by eager ooudmI and b* persuaded to embark in umIsm litiga tion, tb* compensation of the oounaal, m in the “Informer's eat” of 1871, for whioh the sot embraced in eeotion CSwM.to' tended to be a inbatitnte, was mads ooa ditional upon raoovery. Bnt m tba sot appears to ba general an its faoc, why wars not th* employments referred to in.the resolution made to ao- outdanee with’ita provisions? By refer ence to that Motion it will be seen that ita th* re. ‘or to reaoh, to a wall guarded manner, enoh aeeea that tha Mt embraced to lbs Motion was paired. It oertatoly wm not intended by tna Legislature to toolnd* actions for torts or for in jorire in tha nature of torts in thi* eeotion. Bnt there ia another reaeon wbiob ■hows oonrineively that the suite against Jones era not oovered by tho language of ■aid Motion. Aa has bMn already Inti mated, to bringing the enita authorized to be brought under the aaotion, th*Gov ernor la olothad with absolute diaeretion. It is not eontompleted that any salt shall be commenced unless “he shell deem it proper" to institute the Mm*. Bnt bow wm it to raferenM to instituting th* enita ■gainst Jones aad hia securitise. By re ferring to the sets of 1875, it will be seen that tha Legidstora by a iotot raaolation of th* two houses, ordered the Governor to toatttnt* the eoite. It wm not left to Me diMNtion to eoa or not m ha might "daare proper," bnt tb* bringing *f tea suit wm imposed upon Lim by the man date of the Legislature. Suite brought trader eeotion 63 must be instituted to tb* discretion of the Governor. In tbe Joum omm the Governor bed no deration, bnt wm forced to inetitnte enita by Legislative requisition. Again, motion 63 applies only to omm to ba brought after consultation with the Attorney General, if there Is such an offl- oer. The Joum omm were brought by apeoial order of tba Legislature. The original eat embreoed in motion 68 oon- tains no repealing danse. It wm intend ed to ba taken in pari materia with all othar laws on tha same snbjeot, repealing them only where it wm to eonfliot with them. Bnt I need not proceed farther to ■how that the Joum oases do not belong to the class of ossm referred to to eeotion 03 of the ooda. All of the other employments referred to in th* resolution were made (m I re member) to criminal cases except that of T. L. Snaad. Ha wm employed to exam ine the books and aoeonnteof Henry Clew* A Oo. to their tranMotione with the State. Hie work wm performed and hi* report is on file in the Exeontive offlo*. Neither this employment, nor tboMin the eriminri' oases, eaa to any way ba affect- •d by Mid Motion. For tbe raaeon* hereinbefore given, end for others whioh might be stated, the employment* referred to to the raaolation ware not made “according to tha provis ion* of the oode, Motion 63.” Bnt still another enquiry ia made in the resolution: under whet law wars tha amonnto referred to to th* rcMlntion dis bursed ? The Governor is obarged by the consti tution end laws with the duty of seeing that the lotos ere faithfully exeonted, and of premrving Ind defending tbe property end rights of the State. In performing these onerone duties, yonr Exoellenoy* predecessors, from tho foundation of the government, have sometimes found it necessary to employ tha eervioM of enoh oounml and othar aganta aa tha good of tha oommontoeritb seemed to require, end in enoh numbers m the gravity and im- lemandi H. W. G. Two Negroes Hang. Baltimobx, February 9.—Charles Henry Simpson and Martin Hanry, both oolored man, ware hanged to-day at Port Tobeoeo. Simpson's neek wm broken by the fell, and Henry died from strangulation. About 4,000 persona, mostly oolored, witnessed the execution. Weather. Washinoton, Feb. 9.—Indication*.— For the Bonth Atlantio States, northeast wind*, tiring, followed by falling barom eter, increasing olondinees, light rains aad stationary or lower temparatur* will prevail. language Applies only to anita for thi oovary of “debt*" dne tbe State, money or property belonging to the State.” In refarenoe to thMe, a very broad discretion wm given to tbe Gover nor. He might institute eoite if, in his opinion, he deemed it proper to do so. 'There wm no compulsion upon him, but he wee left to act entirely upon hia own dieoretion. Were the proceedings in whioh ■rid employments were made instituted for the purpose of reoovering “debts due th* Btate, or money or property belonging to the Btate?” If eo, then there might be some reason to doubt whether the am- iloymente mentioned ought not to have men made in aooordance with the provi sions of Mid eeotion. Bnt if, on the con trary, arid proceedings were not instituted to reeover “debts dne or property belong ing to the State,” then tbe atid eeotion is not applieeble thereto end there existed no legal obligation to make tha employ ments referred to in aooordanoe with lta provisions. Were the employments made in the suits instituted for the reoovery of “debts” due to the State ? The employments of Mseers. MoCey A Trippe, of w. A. Haw kins, end of W. T. Newman were made to rid in tbe proseontion of the ossm brought in favor of the Slate against John Joum end tbe MonritiM on bis offi cial bonds given m TreMnrer of the State. The objeet of the salts It to re- oover damages for alleged misfeasance and nonfeaMnoee while Jones WM Mttog m Treasurer. Tbe dernagM sought to be recovered do not in any legal sense con- etitnte e debt or debt due to the State. As well might tbe damage whioh wonld ■nene from a wrongful injury done to th* Capitol or Exeontive mansion of th* State be termed e debt due to the State, M to ■o style the damage whioh roanlte to tb* Common we rith from e breach of official doty on tbe part or one of her Mrvante. Section 63, as baa already bMn stated, originated at s time when it wm supposed that much proparty or mousy of th* Stats wm in th* possession of pereona who wrongfully withheld th* earn*; and it wm portanoe of tha ocoaaion demanded. Both th* right and duty to do thia has been tally recognized by the Supreme Court of tb* State. At the January term of last year the Court deoided, to use ita own lan guage, “that the Governor bed the power end authority to institute suit against th* defendants under tbe general power granted him of a general supervision over ell the property of the State, with power tb make ell necessary regulations for the protection thereof when not other- wiM provided for, and to engage the Mr- vices of any oompetent person for the disobarge of anv duty required by the lews ana esMntel to the interests of the State, or neoeMsry in en emergency to S reMrve th* property or fande of the tate." The cases against the late treMorer in volved a large amount and were exceed ingly complicated in their oharaoter. When ordered to bring the enita by tbe Legislature, it wm oleerly tbe doty of the Governor to exeroise the powers confer red by law upon th* executive that the Legislative will might be oerried out. A strong array of eminent oouusel repre sented the defendants, end high M is my opinion of the abilities and experiano* of tbe lets at torney general, I should have fallen below the measure of mydntyto theStaM if I had left him to oontend, single-hand ed in enoh oases end against snob odds: The criminal esses in which oonnMl were retained were the case of the State vs. John Jones, tbe several indiotmente againat H. B. Ballook end others, end tb* insurrectionary cases in Washington oounty. Esoh one of these proseontiona wm con sidered of enffloient importance to tbe pnblio to require the employment of ad ditional counsel to rid tbe proMonting officers to enforoing the lews. Most of the aforementioned oases, with mroy others of grMt magnitude, are still pending to this end other States. Among others that might be mention ed, ere several omm brought in the State of Tennessee, involving over $100,000 end in whioh the State is the reel defend ant. There oannot be any recovery for tbe State in theM oases, and counsel could not be paid m provided under seotion 63. Still, the interests of the Htato demanded that oonnMl should be engaged to repre sent her in the cases. Can it be BuppoMd that tbe Governor is left at liberty to em ploy oonnsel to defend the State, and fix and pay oartsin fees therefor, bnt is for bidden to engage oonnsel to sne for the State, no matter whet amount or interest* may be involved, unless be oan find com - patent lawyers who will take the oases offered on speculation. In oonolnsion, I bag to say that while considerable amounts have been paid for oonnsel face during the late administra tion, each payments, in every instance, wets rendered neoeaMry for tbe protec tion of the pnblio interests. The compli cation! of the treMury rendered legal rid and service necessary in New York, end ■iso at home. Resistance in the oourts to the oollection of the State revenues also involved heavy. expenditures for oonnMl fees in the State, end also at WMhington oity before tbe Su preme Court of the United States. The dne enforcement of tbe laws required occasional disbursements from the TreMnry. These expenditures were made necessary by the condition of the finanoes end people of the State. Tho theory of tb* oonspiraoy wm that tho row over the rioetorel vote of tho SIMl would have n toadonay to reader th* consolidated loan shaky, and snake it eerily soeoeptible of being hammered down by a wall- planned raid. Fart of Kellogg's mission to tha North wm to Hours th* reoogqi- tion of tbe PMksrd government, but the most important part of it wm flaenoial rather than political. It seems that np to data th* hupea of the conspirators in regard to the dapreMion of tha loan by tbe poliUoal troubles of Louisiana have not bMn rarilised, and within th* last two or three days .sinoe the Mtonnding developments oonoerning the Returning Board oame oot and particularly einoa the President's refusal,to reoogniM tha Pack ard government, together with the publi cation of th* probability that he Would ultimately recognize the Niohollir govern ment, the oonenle have materially atiffeu- •n np. Thia plaeM th* short ring in a oIom oornar, ond they will make a dee - pent* move, both to New York end New Orleans, early to th* weak, probably on Monday, to spring tbair trap and close ont their ehorte. The following telegram wm raoeived here yesterday from New Orleans to olpher, dated New Orleans, Feb. 1, 1877: To Hon. William P. Kbllooo, Will- abd'i Hotel, Washinoton : Balloon—65 —stipple—advent—J im—Clark—solitary —halt—mineralise—ahovel—ware*— You —temple—him—confirm—has—adz—ap plication—chant. Conquest Class. The translation of this dispatch is m follow*: State bonds (oonaola) steady at 65 with other stooka advancing. Jim Clark bH Mid half a million short. Telegraph him immediately whether he shall oonflrm tbe Mia. Hu Packard atill any ehnnoe ? Conquest Clask. The ring ie supposed to be from eight hundred thousand to thirteen hnndrsd thousand short on ooneole sold at from 62 to 66, oontraete dosing from the 8tb to the 15th toet.,' Th* intention ie to make a raid limnltanaonriy to Naw York and New Orleana.by raising a question m to tha validity of the consolidated loan by pleading want of legality in tbe Legisla ture whioh passed the bill, and in the Governor who signed it; also to oiroulete a rnmor npon tha authority of Kellogg, Packard A Co., to tha effeot that it ie the intention of the Nioholle Government, in the event of its recognition, to repudiate that loan, or at leMt to allow the interest to default and to oon test ita validity to the oonrti. It la also the intention of there oonapiratora to oironlate a report npon the New York stock board that a confederate ring to Louisiana hM bought np what are known m the Chattanooga railroad bond* at nominal rates, and that tbe first sot of tha Nioholla Legislature will ba to ’fund these bonds, whioh have bMn virtnrily repudiated for aome time with a new preferred State loan, whereby- the indebtedness of Louisiana would be inorsaeed several million* end tbe veins of tbe securities already on the market materially depressed. This, to brief, ie .the history of the oonepiraey to wbiob the cipher telegram from Clark to Kellogg af ford* a key. Of oourae after this publi cation it will be impoMible for the ring to oreate tb* panto they dMired on tbe ■took board in New York. This conspir acy hra only recently oome to the knowl edge of the Louisians Democrats, aud they ere taking all possible precautions to head it off. It ie not tbe intention of the Nioholle government or Legislatnre to intofere with the prerent fintnoiri ar rangement* of Louisiana, exempt in ao far aa it may be necessary to make farther end more adequate provirion for the pay ment of the iniereet on all just and lawfnl debts of th* Btats. nary a June. 6 17-1 Uplands, low middling elaaM, shipped la Janasry ut February, per tall, sKd; Kanh and April, IU-1M. ^ I lit r. a.—Uplands, low middling els use, Msreh end April delivery, * St-SXd; else, * l(-ied I April aad May, * W aid; May and Joes,« Sited.
