tion of the law, and without reflection on
my pradeoeaaor, I doubted whether I bad
the authority to pay tbs snma, and referred
the question to tha Attorney General.

lay the whole matter before tha General
Assembly for ita oonaiderstion. I respect
fully suggest that yon definitely state two

ed to ba taken in pari materia with all
othar laws on tha same snbjeot, repealing
them only where it wm to eonfliot with

All of the other employments referred
to in th* resolution were made (m I re
member) to criminal cases except that of
T. L. Snaad. Ha wm employed to exam

The Governor is obarged by the consti
tution end laws with the duty of seeing
that the lotos ere faithfully exeonted, and

volved a large amount and were exceed
ingly complicated in their oharaoter.

were retained were the case of the State
vs. John Jones, tbe several indiotmente

insurrectionary cases in Washington

Esoh one of these proseontiona wm con
sidered of enffloient importance to tbe
pnblio to require the employment of ad
ditional counsel to rid tbe proMonting
officers to enforoing the lews.
Most of the aforementioned oases, with
mroy others of grMt magnitude, are still
pending to this end other States.
Among others that might be mention
ed, ere several omm brought in the State
of Tennessee, involving over $100,000
end in whioh the State is the reel defend
ant. There oannot be any recovery for
tbe State in theM oases, and counsel could
not be paid m provided under seotion 63.
Still, the interests of the Htato demanded
that oonnMl should be engaged to repre
sent her in the cases. Can it be BuppoMd
that tbe Governor is left at liberty to em
ploy oonnsel to defend the State, and fix
and pay oartsin fees therefor, bnt is for
bidden to engage oonnsel to sne for the
State, no matter whet amount or interest*
may be involved, unless be oan find com -
patent lawyers who will take the oases
offered on speculation.
In oonolnsion, I bag to say that while
considerable amounts have been paid for
oonnsel face during the late administra
tion, each payments, in every instance,
wets rendered neoeaMry for tbe protec
tion of the pnblio interests. The compli
cation! of the treMury rendered legal rid
and service necessary in New York, end
■iso at home. Resistance in the oourts
to the oollection of the State revenues
also involved heavy. expenditures for
oonnMl fees in the State, end also

required occasional disbursements

were made necessary by the condition of
