Phillips v. H. H. Spying, Pmaidant of
tho OhottahooehM National Bank, far tho
rooorary of ton bonds of $1,000 each,
whioh, nooording to tho evidence, oho had
given to Mr. Henry Motatt to optdoUy

but in bio noma. Whan aha demanded
the bonds of the bank, aba wm refused on
tho ground* Uul tha owner of thorn moat

in taming them over. Mm. Phillips no-
till ad the bonk not to giro np tha bonds
to Mr. Moffett, and ho gar* the Mm* no-
titoation m to her.
It wm tho Jodgmanf of tho Oonrt that
tha bonds ba awarded Mm. Phillips, tha
oom plainest.
Tha defendant obtained eertorari and
tha bonds will remain la tha hands of tha
Sheriff on till the Superior Court daoidM

Tbs oomplaiaaat, aoeondiag to law, was

fendant.
In farther explanation of this oaaa, w<
would state that Mr. Henry Moffett ia a
naphaw of Mm. Phillips. From the evi
dence, it appaand that Gan. Phillip*, a
short time before hla death, gars them
tan bonds to hla w 1/a to tab* oar* of. A
tow days after his dMth Mr. Haaiy Mof
fett called upon -the Widow, and after
some friendly conversation, tha latter laid
something about tha danger of kMplng
tha bonds about bar house, and gars them
to tba former, to dispose of a* mentioned
above, for aafa keeping. Ha oarrled them
to tha store of his brother, Captain O. J.
Moffett, where tha peokage wm opened
and the bond* looked at by both. Tha
Meeam. Moffett claim that Gan. Phillips
bad only a lifetime interest in three of
these bonds, and for this reason
it wm determined not to
allow Mm. PhUlips to oontrol
So after OMling them up In o
package Mr. Henry Moffat marked it
(package) in hi* own noma, oarriad them
to tha bank and without informing tho
oftMit of tho contents, deposited it in his
own name. This wm about tha lat of
November teat. A few day* afterward
Mrs. Phillips mw Mr.' Henry Moffett
again at bar house and asked him if ba
had a witneM with him whan he deposit-
ad tha bond*. Ha replied that bis broth
er, 0. 3. Moffett wm present, bnt ha did
not teU that ba made the deposit ia bis
own name. Mrs. Phillips did not find
out this fact until abont Christmas, whan
aha want to tba bank for th* boiAs to gat
ooupons off to pay th* taiM due by Gan.
Phillips, whan ah* wm informed
that no snob deposit had bean mad*, but
that Mr. Henry Moffett deposited a pack
age about the time whan the bonds opght
to have been. Yesterday Mrs. Phillips
by bar counsel, demanded tha peokage of
tha bank and on being refused, a pomm
aory warrant wm sued ont against Mr,
Epping.
