—A Washington telegram of the 30th
to the Telegraph • Messenger says tbs ease
which Hon. A. H. Stephens argued in the
Supreme Court wars that of Root A Co.
against Stewart, Cults and others, from
Georgia. In his opening and oonoluding
argument be oocnpied not quite two hours
in all. He sat in his chair and spoke
with great clearness and vigor, and had
the riveted attention of a large audienoe
all the time.
—The Supreme Court haa overruled the
deoision of Judge Tompkins In the oaae
of the Ordinaay of Chatham vs the Coun
ty Commissioners. Judge T. granted the
petition for injunction restraining the
County Commissioners from the exercise
of the authority olaimed by them, and
the ease was carried up. The Commis
sioners will consequently oontinue the
management of oounty affairs for the
next four years.
—The Constitution says Gov. Colquitt
returned to Atlanta, from Washington,
with a oheok of the United State* tor
$199,000 to the eredit of the State of
Georgia. Just after the war the State of
Georgia purchased for the W. A A. B. R.
a large amount of rolling stock from the
Uniied States Government. A general
settlement was effeoted with the Govern
ment, under the direction of three United
States Commissioners—the State overpay
ing $300,000. The State oould only re
cover $200,000. Gen. Gordon and Col.
Alston, the latter a* lobbyist, are given
the ohief oredit. If Gov. Smith's con
tract with the lawyers—twenty-five per
cent, of what waa recovered—be ob
served, the fee to them will be $49,000.
—The Augusta Chronicle and Constitu
tionalist : “The following communica
tion was reoeived by several members of
the bar yesterday:

Mrs. Shaw, wife of Mr. Mike Shaw, who
lives in this county, about eleven miles
from this oity.near the Jones county line,
waa murdered in her house yeaterday
morning by two black fiends in human
shape. Mr. Shaw left home after an ear
ly breakfast, crossed Turkey oreek, near
by, to out some timber blown down by
the wind on Saturday. He heard a gun
ahot at his bouse and returned home to
find his wife lying at the door with her
brains beaten out with a light-
wood knot—her skull was broken
in several piaoea, also her arm
and hand wbieh ah* doubtless
used to ward off the blows. By her side
sat their little daughter, four years of
age, who said two blaok men had kUled
her mother. Mrs. Shaw was a young wo
man, about twenty-four year* of age.

in Davison Hall, in Troy, for the benefit

sent a delegation of six to the penitentia-
ty at the last session of the Circuit Court

tirely of Alabama timber and Alabama

—A little negro girl, whoee mother left
her to take oare of itself, orawled into a

have been ordered by European parties.
It will be shipped on English veaeels from

The Governor has pardoned Mr. Spi
gensr, who was sentenced at the laat term
of the Montgomery City Court to aix
months imprisonment for manslaughter.
—An ex-jailer of Huntsville has been
oonvioted in the Federal court for allow
ing prisoners to esoape. The penalty is a
fine of not more than $2,000, and impris.
onment for not longer than two years.
—Three tramps went out of their reg
ular line in plying their vocations, and
were chain-ganged by the Mayor of Mont
gomery. They were out begging, but
took some things tbat,were lying arouna
loose.
—Union Springs Herald: The Grand
Jury of Buliook Cirouit Court indicted,
laat week, Probate Judge W. H. Blaok,
Sheriff William Youngblood, Tax Col
lector K. T. Jouoh, and Tax Assessor
Watt Raiborn. The two first have
sent in their resignations to the Govern
or. The County Exeontive Committee
reoommended the Governor to appoint
Mr. James R. Dillard to fill the vaoanoy
oaused by the resignation of Wm. Young
blood. The committee is oalled by the
ohairman, H. O. Tompkins, to meet in
the court house here, on Saturday next
(May 5th), to reoommend a suitable per
son to fill the vacancy caused by the res
ignation of W. H. Black.

—The Montgomery Advertiser has this
novel oaae : In 1873, a young man named
Brook, in the employ ol the Bouth A North
Alabama Railroad, and while coupling
oars at Deoatnr, had on* of hi* hands
mashed. Buit was at onoe instituted by
the father of the young man, (the latter
alleged to be a minor,) for $26,000 dam
ages against the railroad company, in the
Cirouit Court of Morgan oonnty, the
plaintiff being represented by Gen. L. P.
Walker, of Huntsville, and the defendant
by Luke Pryor and S. P. Bathers, Eaqa.
1 ne case remained in Morgan oounty for
about a year, when it was transferred by
oonsent to limestone oounty, both ooun-
tiea being in tbe same judicial oirouit.
The esse wss continued from term to
term by the plaintiff, beosuse of tbe ab
sence and urgent business engagements,
etc., of bis attorney,the railroad company
beiqg ut> band with its witnesses from
term to term, and anxious for a trial ol
the osuse. Finally, at the spring term,
1876, of the Limestone court, the oase
was dismissed by Judge Wood for want
of proseention, after due notice to the
attorney of the plaintiff, and under an or
der of ibe court, that the case must be dis
posed of at that term. And, st the same
term, a motion was made before Judge
Wood to reinstate the oase, but was over
ruled by him. This was supposed to be a
settlement of the case, and an execution
;ainst Brock for the costs was sent to
adiaon oounty, his residence. To sn
pereede this judgment and get a stay of
exoution, we presume, proceedings were
commenced by the attorney of Brook be
fore Hon. Louis Wyeth, aoircuit judge of
another oircuit (and of concurrent juris
diction with Judge Wood), holding oourt
at Huntsville to reinstate the case on the
docket of Limestone. After considerable
argument by oounsel, Judge Wyeth
granted the petition, and ordered that the
oase be reinstated on Judge Wood's dock
et, whioh was accordingly done by tbe
olerk, in conformity to the order of Judge
Wyeth, of the other oirouit, and a stay of
execution given for the costs. As Roon
as the oase was reaohed on Judge Wood's
docket at Athens, the oourt being now in
session, it was, on motion of tbe attorney
for the railroad, promptly stricken off
again, as being on tbe docket without au
thority of law. This, we suppose finally
settles tbe case. The lawyers tell us this
is tbe first case of the kind that has oc
curred in the praotioe in Alabama, and in
view of its novelty, and for tbe informa
tion of our legal brethren we give it.
