Fine rains fell yesterday between
Smith’s Station and Columbua.
Tho Cargill-Laalag Arbitration.
Laat Saturday Mr. John Cargill’s two-
mule team, whioh always in their playful
ness are inolined not to hold back going
down hill, got the start of Ihe driver
going down to the wharf, from the Mobile
and Oirard Railroad bridge. The driver
in trying to atop them broke hia lines and
they ran to the bottom of the hill and
atopped. Aa we understood our inform
ant, aome one then threw a briok at the
mulea and caused them to “dash” a second
time. They ran against a Mr. Lesley's
buggy, upset it and broke all of the
wheels. The damaged party claimed in
demnity, and it waa left to the arbitration
of two persona. Hr. Cargill chose Jndge J. F.
Pou and Mrs. Lesley, or her aon, who was
in charge of the buggy, seleoted Captain
0. A. Redd. The arbitrators did not
agree and they, aa waa understood in the
premises, decided to bring in a third
man. The day set apart for the second
sitting will be next Saturday two weeks.
The law bearing on tbia ia, aa we have
been informed, that a man who will drive
out a horse or horsea knowing them to be
vioiona runaways is liable for any
damages that may be inflioted. Mr. Car*
gill's mulea were not thought by hia arbi
trator to oome under thia law.

one might tell whether or not the blood
was boiling.
Newton was a grave man, but, being
avaricious, be was not satisfied with his
own gravity and sought to gain that the
Creator had given to the falling apple.
However,by parenthesis, and not meaning
to digress, the gravity of the apple inves

pear (Pair) traveled.
The eye of man discovered that some
points ware higher than others and they

boldt, Qay Luasao and others, who deter
mined the velooity of sound to be 1,118
feet per second, suggested that if any one
were anxious to determine the matter, it
could be very easily done by some one
going into the mouth of a sewer emptying
into the river, and yelling to a man listen
ing with an ear trumpet through a plug
on Brood street. Henoe, knowing the
pitoh and tone of the voioe, the velocity
of sound per seoond, the amount of sense
the fellows making these calculations
have and the difference of level of the
two points, the question would be settled.

merchants, and if it offered no enlighten
ment to the man who says meui liber eat

have to say ia that it was summer discus
sion.
If they had asked Mr. Basa, who sur
veyed the locations, and aaoertained the
levels exaotly, * they would have saved
many words and warmer feelings, and the
question would not have remained un
settled.

At a meeting of the Bupreaae Court Bar
held at the Cepitol thia morning, in tbs
Supreme Court Library, for the purpose
of paying tribute to the late Hon. Fern
M. Wood, of Opelika, tha following pro-
oeedings were bad: _
On motion of Attorney General Sand-
ford, Judge John T. Heflin, of Talladega,
was oalled to preside over the masting,
and F. B. Clark, jr., of Mobile, wasohoeen
Secretary. Hon. Leroy F. Box, of St.
Olair, then offered tbs following resolu
tions expressive of the sentiments of the
meeting, whioh were unanimously adopt
ed:
Whereas, the members of tbs bar of the
Supreme Oqprt have heard with profound
sorrow of the death of Hon. Fern M Wood,
and whereas, the aouteoeaa and breadth
of his intellect, his enthusiastic devotion
to, and study of hia profession aa a eoi-
enoe, and his fine abilities had distin
guished him as a jurist, while his kind na
ture and genial manners endeared him to
all bia brethren, and whereas, although
bla life was recklessly terminated in the
very midst of hia usefulness, the etrenu-
oua exertion of hia vigorous faculties had
attained a reputation which will long be
oherlabsd by hie countrymen; therefore

Manley Wood, the bar haa lost one of its
able, and moat useful members; society
one of ite brightest ornaments, and the
State an honored oitixen, whose life and
services have oonduoed to her welfare and

Integrity, of well direoted energies, and

profession dies for the survivors to meet
tad adopt resolutions commemorative of
his talenta, his learning and hia virtues.
During the laat three years it haa been
the misfortune of the Court to witness
the observanoe of this ouatom, upon sev
eral occasions.
Sometimes the ceremony haa elpressed
the disappointment of hopea inspired by
young men, who had given promise of
oellenoe, but the fulfillment of wbiob
death had prevented. At other times, it
haa been the solemn utterance of deep
sorrow over the untimely death of those
who had labored muob, and suffered
muob, and aohieved great things; of
those whose qualities of noble eitixenship
had won the confidence of, and endeared
them to, all their oonntrymen. One of
these, struggling upward, had reaohed a
high position—the summit of his profes
sional ambition—a place npon the benoh
of the Supreme Court of Alabama, and
thenee, with all bis glory undimmed,
stepped easily into the skies.
But the cireumstanoes attending the
death of none of them were ss aad as
those surrounding the laat days of the
Hon. Fern M. Wood. These are well
known, and it is unneosasary now to re
late them.
He waa neither so young as not to have
met the difficulties and borne the burdens
of a lawyer’s life; nor ao old as to have
effected all that hia foroe and abilities
oould accomplish. He had fait the anx
iety and weariness that wait upon the la
borious task of daily bread; but he bad
known also the joy that comes from the
■alneaer Abbey.

Mr. B. H. Hudson has been employed
to fill the vacancy caused by the death of
Mr. James Demon, Secretary and Treas
urer of tbe Company.

Mr. W. R. Brown’s oolt, Bramble, won
the three-quarter mile raoe at Saratoga,
end won $5,000. Bixty colts were en
tered and nine started. The summery
and time were in yesterday's paper. Mr.

We here received e neatly bound vol
ume of 124 pages, with tbe above title,
from the Constitution Publishing Com
pany at Atlanta, Georgia. Tba frontia-

ex-Gov. Jenkins, tbe Preeident of the
body. It oontains the vote of the State
by distriota, and brief biographies of tbe
