Admr. ~~ AN ACT. ■ TBAO appoint Commissioners to settle the claims of the creditors of the Bank ol Darien upon the S ate ol Georgia.and to provide lor r.iisr ! mg the money which may be required to pay such i claims by sale of Suite Bonds. See. Ist. Be it enacted by the Senate and House of Representatives of the State of Georgia, m General Assembly met, and it is hereby enact ed by the authority ol the same, that Hines Holt, Williaiv. S. Rockwell, Jttuius Wingfield, Samuel Barin lland Eli LI. Baxtt r, be, and thay are here by appointed, Cammissioners, to settle the claims of creditors ol the Bank of Darien, upon the State. That all claims against the State by those who hold Bills on the Darien Bank, or judgments or eviden ces of debt against said Bank, be referred to the award ofsuid Commissioners, that said Cmrimis sioners meet to determine said claims at. .VI illodgr ville on the 2d V\ rdnesday in the month of April next, that any three of said Commissioners so at tending shall form a quorum and proceed on the business aforesaid, unu that ciiiier the creditors ol said Rank, or the Governor as the representative of the State, by Attorney at Law, being dissatis fied with said award, may enter nn appeal to the Superior Court of the county of Baldwin fr m said award, within thirty days after the same is made, by written notice to the other par/y, and the (kith of the Stale uc pledged to pay any award said Commissioners may make, if not appealed I'.om, and if appculcd from, to p y the amount of the verdict and judgment in lavor of any such claim ant, and that the Governor appoint some competent Attorney or Attorneys, not exceeding two, to rep rescnttlie State. The said Board of Commissioners may adjourn and meet at pleasure, giving notice by publication. A majority of the Commissioners present6liall have power to render awards, and if a vacancy shill occur by death, resignation or other wise, Ins Excellency,the Governor, shall fill such vacancy. The Commissioners shall receive such competition for their services ns the Governor may dcternaiue. Sec- 2d. And be it furlber enacted, That when the said Board ol Commissioners shall return their awards, if not appealed from, or when such ver dict shall he rendered, the claimant shall bo paid on the Governor’s order, by the Treasurer of the S'ale, from the fund to b® raised under this Act.— His Excellency, the Governor, is hereby author ized to issue Bonds of the State of Georgia for such an amount and to such an extent, as he may find necessary to pay the claimants, that such Bonds shall be in sums urnmouiitsof five hundred dollars eueli, be payable ten years alter date, within tercst at l e rate of six per centum per annum, pay able semiannually according to tlie coupons or into eet, warrants annexed at Snvannah or at Augusta. The Bonds shall be signed by the Governor, and be countersigned by the Treasurer, and the Cou pons shall be signed by the Treasurer. See. 3d. Bo it further enacted by tne authority aforesaid, That the Governor is hereby author ized to sell such bonds, provided, that they be not sold under par, and the proceeds shall be placed in the Treasmy. Sec 4tli. And be it further enacted,That should the award of said Commissioners be, to make the State liable for more than silty cents in the dollar of the outstanding bona fide liabilities of the Bank ol Darien, allowed by the Commissioners, or should any claim be allowed to take its pro-rata by said Commissioners, that the Governor should bdlieve ought not to be allowed,then and in either of said cases, the Govcrnoi is directed and required to make said papeal from the award in any such ease, in conformity with the terms ol this Act, and the appeal and decision from any one case which eliali settLi the principle for all, shall he sufficient and the Governor is also directed to take thejudg ment ol the Superior Court of Baldwin county fid the Supreme Court for final judgment, if the judg ment of said Snpcrior Court shall not be in accord dance with the requirements ana directions ofthis section. And that any creditor dissatisfied and appealing shall have the same rights And be it further enacted, That said Commis sioners who act, shall before proceeding to their duty, make affidavit before some person qualified to administer an oath, that they nor either ol them are now-, and never have been, a creditor of the Darien Bank, nor Attorney at Law, nor in fact, for any creditor of said Bank, and that they are not inter ested directly or indirectly in the event of their a ward.
