Il ’ HEREAS, The safety of Passengers ttav
V 7 eling on Rail Roads requires the strictest
penal prohibitions to unauthorized persons in
any interfering with such Roads, or other appur
tcnenccs, or placing obstructions upon, or mov
ing, touching, or altering the Gates, Rails,
Switches, or other appendags of said Roads;
l Section 1. Be it enacted by the Senate and
Hanse of Representatives of the Slate of Gem
j gta, in General assembly met, and it is hereby
\ enacted by the authority of the same, That if
' any person, or persons, shall intrude upon any
: Rail Road in this State, constructed by any char
i tered Company, or any part thereof, contrary to
j the will of the Company owning said Road, the
' person, or persons so intruding, shall, and may l»e
: indicted as for a misdemeanor, and upon conviction
I fined or imprisoned, or both, at the discretion of
I the Court.
Section 2. And be it further enacted by Ju
thority aforesaid, That if any person shall wil
fully and maliciously destroy, or in any manner
hurt, damage,injure or obstruct: or shall wilfully
and maliciously cause, or aid and assist, or counj
scl, or advise any other person or persons, to de
joy, or in any manner to hurt, damage, or in
thc, ort obstruct any such Rail-Road, or branch
yonr.ef or any Bridge connected therewith, or
ans Vehicle, edifice, right or privilege granted by
charter, and constructed for use under authority
thereof, or if any unauthorized person or personr
shall turn, move, or in any manner interfere or
meddle with any Gate, Switch, sideling, or other
appurtenance to any such Rail-Road; such per
son or persons so offending. shall and may be in
dieted, and on conviction, shall be imprisoned at
hard labor in the Penitentiary for a term of years,
not less than four, nor longer than eight, and
shall further be liable for all civil damages occa
sioned by any such act; and if death to any
Passenger or other person on said Rail-Road shall
ensue, from any such act, such act or offence
shall be deemed and held to be murder,and shall
be punished accordingly.
