The officers of the board shall consist of a President, Secretary and Treas urer; in the absence of either officer, the members present shall fill such offices, pro tern. i Section 2. The regular meetings of the . board >. shsffijho oa Ahft first and third Mon day nights in cacli month, unless chaug- J cd by the Board; three of said Boards shall constitute a Quorum to transact any busi ness. The President, or a quorum shall have power to call c-itra meetings of the Boards in ease of emergency. Any member of the Board, faiiing to attend any meeting of the Board without sufficient excuse, shall pay a fine of one dollar. Section 3. The Secretary shall read ell proceedings of the Board, and sign all Or dinances and precepts as Secretary of the Board. Section 4. The Treasurer shall give bond and security to this Board, and their suc cessors; in qJKc6, for fifteen hundred dollars, to be such upon in any (Joiivt of law by the present Board, or their successors in office, upon his failing to pay over all monies and other effects when required by the Board, or their successors in office. The Treasurer shall pay out money only by order of the Board and take receipts for the same. Bed ion 5. The .Secretary shall have power to issue executions, the same to be directed to tlio Marshall to levy on the I goods and chattels, lands and tenements against whom executions may be ordered from the Board”, under the same Rules arid Regulations that Constables now levy and sell. Executions to be issued against those who may become indebted to the Board, by fines, taxations, forfeitures. Ami it shall be the duty of the Marshall to make a return of all papers in his hands, mid ull his official acts, at each regular meeting of flic Board.— And the Secretary and Treasurer and Mar shall, shall receive the same cost as Consta bles and justices of the peace, in such cases for issuing and collecting and to be paid by defendants. All monies collected (cost ex cepted) shall be paid to the Secretary and Treasurer twice a month. Section 6. Each male inhabitant of this incorporation subject by the laws of this State to work on road-', slialbpav a tax of four dollars; aficl all owners of Heal Estate and Stock in trade, shall pay a tax of not more than three-eiglits of one per cent, on the value thereof; upon failure to give in, the Board shall have power to assess the same. Section 7. All owners of Billiard or Pool Tables, shall pay a tax of Fifty dollars per annum. All owners of Tenpin Alleys or Ball Alleys, shall pay a tax of Fifty Dollars per annum. All vendors of spirituous liq uors, in less quantities than one quart, shall take out a license, and pay at the rates of fifty dollars a year; Such persons desiring to retail spirituous liquors shall apply to the Secretary and Treasurer, and get license to authorize them to retail. All wholesale vendors of ardent .Spirituous shall apply to the Secretary and Treasurer, and get license, and pay ten dollars per year. Any person or persons retailing or wholesaling without gettimg out license to authorize them so to do, shall, on conviction thereof, pay a fine of Five Dollars per day, for each day they so sell, and the Secretary shall be allowed $1 25 for issuing license, to be paid by the applicant. The keeping open doors, or selling on tire Sabbath, is positively for bidden, and for a violation of sucli an of fence, a fine will be assessed, as such offense may demand. License on a two-horse dray shall be $15.00 per annum ; one-horse dray $10.00; wheelbarrow $5.00. Section 8- Firing guns, or pistols, or crackers, drunkness or noisy conduct, loud and profane swearing, fighting, public in decencies, drawing weapons likely to pro duce death, obstructions in the streets or side-walks, (except for building purposes) nuisances, prejudicial to the health or con venience of the inhabitants of this town. — Gambling of any kind; running or driving a lu.rse or animal of any kind, at an unusu .al rate; Feeding teams in the I‘ublic Square on any of the side-walks; exhibiting Stal kms or Jacks in the incorporation, (except ; n Stable lots) letting the same to mares; refusing to repair fire-places, chimneys or stoves which may be in an unsafe condition; refusing to cleanse public or private pvivys; for the commission or omission of any of the offences named in this section the offender shall pay a fine not. to exceed $25 or be imprisoned or both at the discretion of the board. Section 9. All shows of circuses or Me nageries, shall, before exhibiting in this town get license from the Secretary and Treasurer, and pay a tax of twenty-five dollars for each day, and $1 25 to the Sec retary for issuing the same. All shows of wax-figures, slight of hand performances, Organ-grinders &c., and all other shows or exhibitions for pay in said town, shall pay a tax of not more than five dollars, per day for each day. All trancient Auctioneers or Peddlers shall pay a tax of not less than $2 50 per day for each day they sell or offer to sell. All owners of property in this town shall assess the value from the first day of April in each year, and give in the same, to the Marshall or any other person, the board may appoint, as held by them either in their own right or any other person; and they shall first take an Oath to be prescribed by said Board. Section 21. All persons are forbidden to hitch a horse or other beast to shade trees, or pollings, or to injure shade trees in any way, Any person failing or willfully neg lecting to repeat either of the above Ordi nances shall be fined not less than one dol- lar or over five. Section 12. Any person, failing or refus ing to assist the Marshall (when summoned) in carrying out any of the provisions of the foregoing Ordinances, shall be fined not less than one dollar, or over five. And the Marshal shall have power to assess and collect fines for a violation of any of these Ordinances, but if the offender is not satisfied he may appeal to and have his fine remitted or reduced. Section 13. In accordance with law, au thorizing the passage of these Ordinances, for the government of the town of Cartors ville; and for the purpose of enforcing the same, it shall be the duty of the Marshall to see that these Ordinances and all by-laws are strictly enforced, or any Ordinance that may hereafter be passed by the Board, and the Marshal! shall give bond and security fer the faithful performance of his duties as Marsliiili of said U>"’n, and the said Marshall shall, before entering upon the duties of his oftiee, take an oath to carry out and admin ister the duties of his office impartially and without favor.
