The Congress of the Confederate States^ oft America do enact, That no officer char ged with the rate keeping, transfer or dis-^ liursetnent of public moneys, shall convert to Lis own use, or invest in any kind of, property or merchandise,on private account, or iend with or without interest, any por tion of the public moneys entrusted to him tor sale keeping, transfer, disbursement or_ any other purpose. Sec. 2. That no ofiicer charged with the. safe keeping, trausfev or disbursement of public moneys, or charged with or assigned to the duty of purchasing for the govern-' ment or any department thereof, shall buv,_ trade, traffic or speculate, in, either direct ly or indirectly for the purpose of gain to_ himself or others by re-sale or otherwise, any article of food or clothing or material^ of which the same is made, or which enters into or constitutes a part of the same, or^ any material of war or article whatsoever, which is or may be required to be purchas-. ed for the use of the army or the prosecu tion of the war. Sec. 3. No officer shall take a receipt in blank for any article or articles purchased^ by him for tbe government or any depart ment thereof; and every receipt shall set forth the true amount paid, and on what account; and when payment is made on account of property purchased, the receipt shall set forth the name of the persom from, whom such property was purchased, and the place of his residence, the thing or. tilings purchased by items, number, weight or measurement, as may be customary in the particular cajK-rtbe price thereof, and" the date of payment/ Sec. 4. No offiqpr who is in charge of transportation, or Vhrr-is empowered to grant the same, shall forward by govern ment conveyance or at the expense of gov-, eminent, or to the exclusion or delay of government freight, any commodity or property of any kind, unless the same be" longs 10 the government or some depart ment thereof, except as authorized by law. Sec. 5. Any officer who shall violate any provision in-fire foregoing section,shall upon a conviction before a court martial or. military court, be cashiered, and placed in the ranks as a private fo serve during the war: Provided, That nothing herein con tained shall impair (lie civil remedy which the govei nineiit may have against any of ficer or his sureties for fraud, speculation or misapplication of the public moneys en trusted to him by tin: government. Sec. G. lie it further enacted, That any person in the employment or service of the government as aforesaid, and all other per sons coming within the purview of this act, wlio shall violate any of the provisions of the foregoing sections, shall be liable to in dictment, and fined in a sum not less than one thousand dollars, and imprisoned not less than one year, nor longer than five years, to be imposed by tbe judge or jury trying tbe cause, according to tlie course of judicial proceeding in force in the several •states: Provided, Tlie provisions of this act shall iu no wise interfere with or impair the civil remedy which tlie government may have against - any of said officers or their securities or employees for frauds, speculation or misapplication of the moneys entrusted to them respectively', by the Con federate btates : Provided also, That all cons irvators of the peace, wiio, by the laws of (he several btates, have jurisdiction to commit or bind over offenders for breaches of the criminal laws of tbe State iu which they may reside, shall have power to com mit or bind over in a sufficient recogni zance offenders against the provisions of this law, to appear at the next term of the district court of the Confederate States within the jurisdiction of which the offence was committed, for tiial, in the same man ner and under the same rules as if such preliminary trial, were had before the tne judge of such district court, and the judges of the Confederate courts having ju risdiction of tlie offence defined by this act shall at the commencement of <m,pK set.ion of their respective courts give this act and its provisions especially in charge to the different grand juries. June 9, lSd3. 3 4t fNo. 78 ] • AN ACT to pay Officers, Non-Commis sioned Officers and Privates not Legally Mustered into the Service of the Con federate States, for Services Actually Performed. 'The Congress of the Confederate States of America do enact. That all officers, non commissioned officers and privates of any legally cons’ituted military organization, which may have bt en actually received into the service of tl e f ’‘•nfederate States by any general officer thereof, but were never legally mustered inlo service, in consequence of tlie loss of tlie muster-rolls of such military organization, shall be entitled to receive pay from tbe time they! were so received: Provided, 'J he fact of their having been so received into the ser vice, and the time they served, is duly proved to the satisfaction of the Secretary of War, under rules to he prescribed by him. ' Approved May 1, 1SG3. 4 3t. of America do enact, Timt sick, wounded, aud disabled soldiers in hospitals shall be entitled to furloughs and discharges undi f the following rules and regulations: In jdaces where there afe three or more hospitals, three surgeons in charge oil hospitals or divisions in hospitals, shall constitute a Board of Examiners for the hospitals to which they belong, whose duty it shall he, twice in each week, to visit said hospitals, and examine applicants for furloughs and discharges ; and in all cases where they shall find an applicant tor furlough utifit for military duty, either from disease or wounds, and likely so to remain for thirty days or upwards, they shall grant a furlough for such time as they shall deem him unfit for duty, not to exceed sixty days. Said board shall keep a secretary or clerk, who shall issue all furloughs bv order of tbe board, and shall specify therein the time of furlough, the place of the residence of the soldier, his company, regiment, and brigade. Sec. 2. Be it furtlieie^acted, 1 hat no further regulation shall He required of the soldier, and no passportrgjfiffred other than his furlough. Sec. 3. Be it further enacted. That the said board may recommend discharges, stating the ground thereof, which, when approved by the-Surgeon General or the General commanding the army or depart ment to which the soldier belongs, shall entitle him to a discharge aud transporta tion to the place of his enlistment or resi dence. Sec. 4, Be it further enacted, That in places where there are but two hospitals two surgeons in charge of a hospital or division shall constitute a hoard for the purposes aforesaid ; and in places where there is but one, tlie surgeon in charge, and two assistant surgeons, if there lie two, and if lint, then, one, shall constitute a boaul for the purpose aforesaid, and may furlough and recommend discharges as aforesaid : Provided, That no furlough ci.nil ||p pr^.r.t.,,1 under the provisions of this act, if, iu the opinion of the board, the life or convalescence of the patient would he endangered thereby. The Congress of the Confederate States of America do enact, That all laws or parts of laws establishing any port or ports of delivery in the Confederate States he, and the same are hereby repealed, and that all ports of delivery heretofore estab lished be, and tbe same are hereby abolish ed, except such ports of delivery as are also ports of entry. The Congress of the Confederate States of America do enact, That in the several Indian Nations entitled Ly treaty to Dele gates in the Congress of the Confederate States, the regulations for holding elections for such Delegates idjalI be as follows :— Such elections sIictI Jm: lut'd in all such Indian Nations otV the {first Monday in September, A. D., eighteen hundred and sixty-three, and on the/ first Monday of September, in each second year thereaf ter. Sec. 2. Such elections shall be conduct ed according to the mode prescribed by the laws of the several Nations, except so far as such laws may be modified by this act. Sc2. -3. Iu such elections, every citizen of the Nation entitled to a Delegate, who lias not forfeited his citizenship by desert ing to tbe public enemy, or seeking protec tion from the Government of the United States, who shall be qualified to vote for a member of the legislative body of such Nation, shall be entitled to vote for such Delegate at any place in such Nation where lie would be entitled to vote for Gov ernor or PrinerjTaTChief. Sec. 4. In cas’e such citizen shall be in the military service of the Confederate States, or in case the elections cannot be held at tbe usual place of holding elections such citizens shall he allowed to vote in ♦he camps of the army as hereinafter pro vided. Sec. o. I11 every Nation in which elec tions are authorized by tIlls act, polls shall be opened at the usual time and jdaces of holding elections and the returning officers shall make the usual returns to the Gov ernor or Principal Chief of the Nation, within ten days after such elections. Tlie Congress of the Confederate States of America do enact, That all persons serving in the land forces of the Confeder ate States who shall desire to be trans ferred to the naval service, and whose transfer as seamen or ordinary seamen shall he applied for by the Secretary of the Navy, sLall be transferred from the land to the naval service : Prodded, That nothing in this act shall be so con strued as to alter or repeal any law now in force limiting the number of seamen. [No. 85.J AN AC 1’ Regulating the Grauting of Furloughs and Discharges in Hospi tals. 1 Congress of tbo Confederate States tion, who shall hold the same, and make out the poll books and retires in the same manner, as is usual in holding other elec tions in the Nations, from which such regi ment or command came, and the returns of said election shall be made within ten days. See. 7. The returns of such elections in camps shall he forwarded by tlie several commanding officers appointing the judges and clerks as aforesaid to the Governor or Principal Chief of the nation, for which such election is so held. Sec. 8. T he Governor or principal Chief of the Nation for which such election is held, shall examine the returns forwarded to him, and give to such persons as he shall ascertain to have received the high est number of votes, a certificate of such fact. Sec, 9. The ofiicer authorized to appoint the judges and clerks shall be authorized to administer ihe jiroper oaths to the judges and clerks, or they may administer the same to each other.
