ACTS AND RESOLUTIONS OF THE
CONGRESS OF THE CONFEDER
ATE STATES, PASSED AT THE
THIRD SESSION—1S63,
AN AC T to prevent Fraud in the (Quarter
master’s and Commissary’s Depart
ments, and the obtaining under false pre
tence Transportation for Private Prop
erty.
The Congress of the Confederate States
of America do enact, That no officer char
ged with the safe keeping, transfer or dis
bursement of public moneys, shall convett
to his own use, or invest in any kind oi
property or merchandise,on private account,
or lend with or without interest, any por
tion of the public moneys entrusted to him
for safe keeping, transfer, disbursement or
any r other purpose.
Sec. 2. That no ofKcer charged with the
safe keeping, transfer or disbursement of
public moneys, or charged with or assigned
to the duty of purchasing for the govern
ment or any department thereof, shall buy,
trade, traffic or speculate in, either direct
ly or indirectly for the purpose of gain to
liimself or others by re-sale or otherwise,
any article of food or clothing or material
of which the same is made, or which enters
into or constitutes a part of the same, or
any material of war or article whatsoever,
which is or may be required to be purchas
ed for the use of the army or the prosecu
tion of the war.
Sec. 3. No officer shall taken receipt in
blank for any article or articles purchased
by him for the government or any depart
ment thereof; and every receipt shall set
forth the true amount paid, and on what
account ; and when payment is made on
accouut of property purchased, the receipt
shall set forth the name of the persom front
whom such property was purchased, ami
the place of his residence, «tlie thing or
things purchased by items, number, weight
or measurement, as may be customary in
the particular case, the price thereof, and
the date of payment.
See. 4. No officer who is in charge of
transportation, or who is empowered to
grant the same, shall forward by govern
ment conveyance or at the expense ofgov
ernment, or to the exclusion or delay of
government freight, any’ commodity or
property of any kind, unless the same be
longs to the government or some depart
ment thereof, except as authorized by law.
Sec. 5. Any officer who shall violate
any provision in the foregoing section,shall
upon a conviction before a court martial or
military qourt, be cashiered, and placed in
the ranks as a private to serve during the
war: Provided, That nothing herein con
tained shall impair the civil remedy w hich
the government may have against any of
ficer or his sureties for fraud, speculation or
misapplication of the public moneys en
trusted to him by the government.
Sec. «>. lie it further enacted, That any
person in the employment or service of tiic
government as aforesaid, and ail other per
sons coming within the purview of this act,
who sh/ill violate any of the provisions of
the foregoing sections, shall he liable to in
dictment, aud fined in a sum not less than
one thousand dollars, and imprisoned not
less than one year, nor longer than five
years, to be imposed by the judge or jury
trying the cause, according to the course of
judicial proceeding in force in the several
States: Provided, The provisions of this
act shall in no wise interfere with or impair
the civil remedy which the government
may have against any’ of said officers or
their securities or employees for frauds,
speculation or misapplication of the moneys
entrusted to them respectively, by the Con
federate States : Provided also, That all
conservators of the peace, who, by the laws
of the several States, have jurisdiction to
commit or bind over offenders for breaches
of the. criminal laws of the State in which
they may reside, shall have power to com
mit or bind over in a sufficient recogni
zance offenders against the provisions of
this law, to appear at the next term of the
district court of the Confederate States
within the jurisdiction of which the offence
was committed, for trial, in the same man
ner and under the same rules as if such
preliminary trial, were had before the
the judge of such district court, and the
judges of t lie Confederate courts having ju
risdiction of the offence defined by this act
shall at the commencement of each session
of their respective courts give this act and
its provisions especially in charge to the
different grand juries.

AN ACT to pay Officers, Non-Commis
sioned Officers and Privates not Legally’
Mustered into the Service of the Con
federate States, for Services Actually
Performed.
Tbe Congress of the Confederate States
of America do enact, That all officers, non
commissioned officers and privates of any
legally cons'ituted military organization,
which may have been actually received
into tbe service of the Confederate States
by anv general officer thereof, but were
never legally mustered into service, in
consequence <>f the loss of the muster-rolls
of such military organization, shall be
entitled to receive pay from the time they!
wore so received : Prodded, 1 lie fact of
their having been so received into the ser
vice, and the time they served, is duly
proved to the satisfaction of the Secretary
of War, under rules to be prescribed by
him.

AN ACT to provide for the payment
of certain North Carolina Troops from
the time of their Enlistment.
The Congress of the Confederate States
of America do enact, That the troops
heretofore raised by the State of North
Carolina, and afterwards received into the
service of the Confederate States, by the
Confederate States, shall be paid from tlie
date of tbeir enlistment.

AN ACT to provide for the transfer of
persons serving in the Army to the
Navy.
Tiie Congress of the Confederate States
of America do enact, That all persons
serving in the land forces of the Confeder
ate States who shall desire to be trans
ferred to the naval service, aud whose
transfer as seamen or ordjjpary seamen
shall be applied for by the Secretary of
the Navy, shall be transferred from the
laud to the naval service : Prodded,
That nothing in this act shall be so con
strued as to alter or repeal any law uov.'
in force limiting the number of seamen.

AN ACT Regulating the Granting of
Furloughs aud Discharges in Hospi
tals.
The Cor gress of the Confederate States
| of America do enact, That sick, wounded,
and disabled soldiers in hospitals shall be
entitled to furloughs and discharges undir
the following rules and regulations: In
places where there are three or more
hospitals, three surgeons in charge of
hospitals or divisions in hospitals, shall
constitute a Board of Examiners for the
hospitals to which they belong, whose
duty it shall be, twice in each week, to
visit said hospitals, and examine applicants
for furloughs and discharges ; and in all
cases where they shall find an applicant
■ or furlough unfit for military duty, either
from disease or wounds, and likely’ so to
remain for thirty’ days or upwards, they
shall grant a furlough for such time as
they’ shall deem him unfit for duty, not to
exceed sixty days. Said board sball keep
a secretary or clerk, who shall issne all
furloughs by’ order of the board, and sball
specify therein the time of furlough, the
place of the residence of the soldier, his
company, regiment, and brigade.
Sec. 2. Be it further enacted, That no
further regulation shall be required of the
soldier, and no passport required other
than his furlough.
Sec. 3. Be it further enacted. That the
said board may recommend discharges,
staling the ground thereof, which, when
approved by the Surgeon General or the
General commanding the army or depart
ment to which the soldier belongs, shall
entitle him to a discharge and transporta
tion to the place of his enlistment or resi
dence.
Sec. 4, Be it further enacted, That in

two surgeons in charge of a hospital or
division shall constitute a board for tbe
purposes aforesaid ; and in places where
there is but one, the surgeon in charge,
and two assistant surgeous, if there bo
two, and if not, then, one, shall constitute
a board for tbe purpose aforesaid, and
may’ furlough and recommend discharges
as aforesaid : Provided, That no furlough
shall be granted under the provisions of
this act, if, in the opinion of the board,
tbe life or convalescence of the patient
would be endangered thereby.
Sec. 5. Tbe bouse surgeon in all hos
pitals shall see each patient under his
charge once every day.

AN ACT to Abolish all Ports of Delive
ry in the Confederate States.
'The Congress of the Confederate States
of America do enact. That all law’s or
parts of laws establishing any port or ports
of delivery in tbe Confederate States be,
and the same arc hereby repealed, and
that all ports of delivery heretofore estab
lished be, and t lie same arc hereby abolish
cd, except such ports of delivery’ as are
also ports of entry.

AN ACT to Provide Certain Regulations
for Holding Elections for Delegates to
the Congress of tbe Confederate States
in certain Indian Nations.
The Congress of the Confederate States
of America do enact, That in the several
Indian Nations entitled by treaty to Dele
gates in tbe Congress of tbe Confederate
States, the regulations for holding elections
for such Delegate.-) shall be as follows :—
Such elections shall be held in all such
Indian Nations on the first Monday in
September, A. D., eighteen hundred and
sixtv-three, and on tlie first Monday of
September, in each second year thereaf
ter.
Sec. 2. Such elections shall be conduct
ed according to the mode prescribed by
the laws of tbe several Nations, except so
far as such laws may be modified by this
act.
So;. 3. In such elections, every citizen
of the Nation entitled to a Delegate, who
has not forfaited his citizenship by’ desert
ing to the public enemy, or«eeking protec
tion from tlie Government of tbe United
States, who shall bequalified to vote for a
member of tbe legislative body of such
Nation, shall be entitled to vote for such
Delegate at any place in such Nation
where he would be entitled to vote for Gov
ernor or Principal Chief.
Sec. 4. In case such citizen shall be in
the military service of the Confederate
States, or m case the elections cannot be
held at tlie usual place of holding elections
such citizens shall be allowed to vote in
tbe catnps of tbe army as hereinafter pro
vided.
Sec. 5. In every Nation in which elec
tions are authorized by this act, polls shall
be opened at the usual time and places o'
bolding elections and the returning officers
shall make the usual returns to tlie Gov
ernor or Principal Cliiet of tlio Nation,
within ter, days after such elections.
Sec. 6. In every regiment or battalion in
the military service of the Confederate
States, the Colonel or other officer in com
mand of the same, ortho officer in com
mand of any less body’ of troops on detach
ed service, shall appoint two judges and
three clerks, to open and hold such elec
tion, who shall hold the same, and make
out the poll books and returns in the same
manner, as is usual in holding other elec
tions in the Nations, from which such regi
ment or command came, and the returns of :
said election shall be made within ten days.
Sec. 7. The returns of such elections in
camps shall be forwarded by’tlie several
commanding officers appointing the judges
and clerks as aforesaid to the Governor or
Principal Chief of the nation, for which
such election is so held.
Sec- 8. Tlie Governor or principal Chief
of the Nation for which such election is
held, shall examine the returns forwarded
to Lim, aud give to such persons as lie
shall ascertain to have received the high
est number of votes, a certificate of such
fact.
See, 9. The officer authorized to appoint
the judges and clerks shall be authorized
to administer the proper oaths to the
judges and clerks, or they may’ administer
the same to each other.
Sec. 10. Every person concerned in
holding such elections in any Nation or
camp shall take an o.tth to support tbe
Constitution of the Confederate States
and to discharge his duty’ in holding such
election faithfully and impartially.

serve under General Howell Cobb, in his d .-part-
ment of .Middle Florida, ail persons who nave
raised cr may design to riase Companies, are in-
vitfid to correspond with mo at Macon. Georgia.
Companies of sixty four, squads, non conscripts
or exempts from nay portion of the Slate, an i al
so persons subject to consciiption, residing- in
the district of Middle Florida, an 1 in the fol
lowing named counties: B i ter, Calhoun, Clav,
Decatur Dougherty. Early Lee, Mitchell, Milier,
Randolph, Terrell I, Thomas, Wi r ii, Chattahoo
chee, MRrion, Qiiitiiiaii, Stewart, Sumter, Schley,
Taylor, Webster, Muscogee.
Also, non-conscripts, exempts and THOSE
SUBJECT TO CONSCRIPTION, 'in General
Cobb’s Department.
A bounty off $50 and a complete outfit will be
furnished to every Volunteer, as soon as he is
mustered in. «
The Regimetfl;. will be thoroughly equipped,
armed with Enfield Rifles, and rendezvous at Ma
con.

Notice, wherein they nru declared exchanged, are iu
