effect of tbe verdict of manslaughter in this
case? In onr jadgmonf, tbe legal effect of tbe
verdict was lo find tbe defendant guilty of tbe
highest grade of manslaughter (to-wit:) volon-
tary manalangbter. Verdicts are to have a rea
sonable intendment, and are to receive a rea
sonable oonatrnotion, and ara not to be avoided
unless from necessity, Code 3803. The defend
ant waa charged with the offenoS of mnrder.

then tbo verdiot should bavo specified whether

or in tbe commission of a lawful act witbont tbe
necessary discretion and cantion because one is
made a felony, and pnnisbed as inch, bnt the
other is not. Oode, 42G2-42G3. Tbo punish-
ment of manslaughter other than involnntsry
manslaughter, is definitely prescribed by the
Code, and when the jnry fonnd tbe defendant
gnllty of manslaughter witbont saying it was
involuntary, the legal effect and intendment of
(bo verdict was to fls.1 him guilty of voluntary
manslaughter, otherwise tbe verdiot could not
receive a reasonable construction, and Intend-
ment. There are bnt two general grades of
manalangbter reoognized by tbe Code, volants
ry and lr.vo!nntary manslaughter, and aa tbe
jnry did not find the defendant gailly of invol-
notary manslaughter tbo legal presumption is,
that they intended to find him guilty of tbe

mnrder. Oa tbe trial tbe jury foand him
gnllty of tbe leaser offense of stabbing,
motion waa made for a new trial on tbo grunnds
set forth la tbo record, which was ovcrrnlod, anil
tbe defendant excepted. Tbo principal ground
of error insisted on beforo this Conrt war that
tbe Uonrt below limited the defendant’s conn-
ad to thirty minntea in bis argument before
tbo jnry, over bia protest that bo oonld not do
jaatioe to bis client's ease within the limited
time prescribed by the Conrt. It appears from
the certificate of tbe presiding Jndgo that be
allowed the defendant's counsel forty minutes
toadlreas the jary, that ia to say, ho allowed
him ten mlnntim ovor tbe tlmo proscribed at
tho commencement of tho argument. In view
of tbe provisoes of tbe Constitution whleb de
clares that every person charged with an of-
fenao againat the laws, aball bavo the privi
lege and benefit of oonnael, tbo Conrt below
commuted n grave error In limiling tho argn
ment of oonnael aa d aolosed by tbo record,
which this Conrt cannot sanction. If the evi
dence contained in tbo record had boon so do
otdcdly strong os to bavo re (j aired tho verdict
rendered by tbe jary, we might not bavo inter
fered with it for the error complained of, hat
tbo evidenco is conflicting ns to whether tbo
stabbing was done in self dafenso, and inas
much m tho defondant was provented by the
Conrt from haviog tbo privllegs and benefit of
oonnael in hit defense as contemplated by, (he
Constitntlon, we reverse the jadgment of tbe
Conrt below end order a new trial.

Wanna, O. J.—This was an notion of cove
nant brought by tbo plaintiff against tbo de
fendant, to reoover tba amount of a jadgment
against one ICassell, which tbe defendant cove
nanted be would pay in consideration that a cer
tain Injunction then pending against him at the
sail of (be plaintiff ahon.’d bo dissolved, that is
to say. tbo defendant covenanted that bo wonld
pay to the plaintiff whatever amount might be
finally recovered against said Hassell in a snit
then pending on tiio common law side of tho
Oonrt in favor of tbe plaintiff against said 11ns.

twelve months after dato for the sum of $3,600,
besides Interest. It appears from the reoorda
before ns, that nn n trul had on the note at the
(September term cf the Conrt in 1S66, tbe jnry
sealed, or redneed the plaintiff's debt agues:
Kassel', and fonnd a verdict in favor of tbe
plaintiff for only the sum of $1,090 34 with in
terest and cost, npou which verdict a jadgment
was regularly entered and signed. Subse
quently at tbe Msroti term, 18*1, of tbe Oonrt,
tne defendant made a motion to have the judg
ment render, d in 18C6, opened and reduced un
der tbe Helief Act, and upon the trial of that
motion, the jury fonnd c verdict reducing the
platDtiff's judgment against Hassell to tho snm
of $700 00. Upon this last verdiot no jndg
msnt appears.10 have been entered. Whether
the jadgment was arrested, or whether there
was a motion made and pending for a new
trial, dots not affirmatively appear on the face of
the record offered in evidence by tho plaintiff.
The Conrt held and directed that a verdiot
abonid be rendered In favor of the plaintiff
against tbe defendant for only the sum
of $700 00, tho amount fonnd by the last
verdict, instead of the snm of $1,909 34, tbe
amonnt of the judgment. It was contended on
tbe argnment tnat inasmuch as it appears from
other parts of the record (net offered in evi
dence by tbe plaintiff at tne trial) that there ia
now a motion for a new trial pending In the
Conrt below from tho finding of the $700 ver
dict ; that this Court should consider that fact
in this motion for a new trial in the Oonrt be
low which was overruled thore, and which is
assigned for error here. We can only oonsider
each evidence as was offered by the plaintiff in
the Conrt below, and the legal effect of that
evidence. The defendant introduced no evi
dence at the trial. What is the legal effect of
the evidence contained in tbe record offered by
tM plaintiff I That record shows a verdict and
judgment thereon agaicst Unveil in favor of
tbe plaintiff for tbe sum of $1,090 34. That
roeord also shows a verdiot of :hs jury reducing
the amonnt cf that jadgment to 1)799. bnt there
is no judgment of tbe Cjurt upon that verdict,
and the legal presumption is that the judgment’
waa arrested, or a new trial was granted, or
aome other valid legal reason existed why a
judgment w«s not rendered upon, that verdict,
and especially is this so under the provisions of
the second seotion of the Helief Act of 156$,
which declares that the judgment rendered
under the provisions of that Act aball supersede
the prior jadgment. There was no judgment of
the Oourt contained in the record offered in
evidence by the plain'.iff which superseded the
jadgment obtained by tbe plaintiff against Has
sell in 1866 for the sum of $1,99? 31, and the
Gourt erred in holdlcg and deciding that the
judgment obtained in 1566 had been reduced
or superseded according to the evidence before
the problem: they mast sink and beoome sob-
tarraneau streams and finally r’aa in the Gntf.
